COMMUNITY MEMBERS! Please familiarize yourselves with laws regarding "e-bikes". Many of those we see around may not be compliant with Iowa law.

We have received some questions and concerns about E-bikes and other motorized devices being used around Tama County, especially by younger riders.
We want to help clear up what Iowa law allows, what it does not, and why it matters.
Not every electric device is a legal E-bike. Some devices may look like E-bikes, but under Iowa law they may actually fall into a different category, such as a motorized bicycle, motorcycle, or another type of motor vehicle.
Under Iowa Code ยง 321.1(36A) and ยง 321.235B, a legal low speed electric bicycle must meet certain requirements.
To qualify as a legal E-bike under Iowa law, the device must:
โข Have a seat or saddle
โข Have two or three wheels
โข Have fully operable pedals
โข Have an electric motor of less than 750 watts
โข Fit into Class 1, Class 2, or Class 3
โข Have a permanent label from the manufacturer or distributor showing the class, top assisted speed, and motor wattage
โข Be designed so the motor assist stops when the rider stops pedaling, applies the brakes, or disengages the motor
โข Have a working speedometer if it is a Class 3 E-bike
Iowa law recognizes three classes of legal E-bikes:
Class 1: The motor only helps while the rider is pedaling. The motor assist stops at 20 mph.
Class 2: The motor can move the bike without pedaling. The motor assist stops at 20 mph.
Class 3: The motor only helps while the rider is pedaling. The motor assist stops at 28 mph.
A person under age 16 may not operate a Class 3 E-bike.

Before buying an E-bike for your child, here are a few simple things to check.
A legal E-bike should have:
โข Real working pedals
โข A motor of less than 750 watts
โข A label showing Class 1, Class 2, or Class 3
โข A listed top assisted speed of 20 mph for Class 1 or Class 2, or 28 mph for Class 3
โข A motor that cuts off as required by law
โข A bicycle style design, not something built to operate like a small motorcycle
Be cautious if the device:
โข Has no pedals
โข Has pedals that are only there for looks
โข Has a motor of 750 watts or more
โข Is advertised as a dirt bike, pit bike, mini bike, or electric motorcycle
โข Goes faster than the legal E-bike limits
โข Does not have a class label showing wattage and top assisted speed
A simple rule for parents is this:
If it does not have real working pedals, does not have the proper label, or is built to run like a small motorcycle, do more checking before buying it.
Just because a product can be purchased does not mean it is legal for a child to ride on streets, sidewalks, trails, parks, or other public areas.

If a device meets Iowaโs E-bike requirements, it is generally treated like a bicycle.
That means it does not require:
โข A driverโs license
โข Registration
โข Title
โข Inspection
โข Proof of insurance
A legal E-bike may generally be used where bicycles are allowed. This includes streets, shoulders, bike lanes, bikeways, and multi use paths, unless local rules say otherwise.
Class 3 E-bikes have one extra rule. They cannot be operated on a bicycle lane or multi use path faster than the posted speed limit. If no speed limit is posted, the limit is 20 mph.

A device may not qualify as a legal E-bike if it:
โข Does not have fully operable pedals
โข Has a motor of 750 watts or more
โข Does not meet Iowaโs speed or class limits
โข Has been modified so it no longer fits within Class 1, Class 2, or Class 3
โข Operates more like a small motorcycle than a bicycle
If a device does not qualify as a legal E-bike, it may fall under another part of Iowa law. Depending on the device, it may require registration, a valid driverโs license, and other legal requirements before it can be operated on a public highway.

Even when a device qualifies as a legal E-bike under Iowa law, cities and towns may still have local rules about where bicycles and E-bikes can be used.
That may include rules for sidewalks, trails, parks, business districts, or other public areas.
Please check the rules in the city or town where you are riding.

Parents, please take a close look at what your kids are riding.
Some of these devices are fast, powerful, and not built or operated like normal bicycles. When they are used around pedestrians, on sidewalks, or on trails, they can create real safety concerns.
We want people to understand the law and make good decisions.
That said, reckless or unlawful operation will be addressed when needed.
