Virginia has finally come into the 1990s and updated the larceny code from $200 to $500 to be a felony. Most states make people felons for much more than that.

§ 18.2-96. Petit larceny defined; how punished.
Any person who:
1. Commits larceny from the person of another of money or other thing of value of less than $5, or
2. Commits simple larceny not from the person of another of goods and chattels of the value of less than $500, except as provided in clause (iii) of § 18.2-95, shall be deemed guilty of petit larceny, which shall be punishable as a Class 1 misdemeanor.


It is against the law in Virginia to have those air fresheners hanging from your rear view mirror. Same with other objects dangling like dice or a rosary. It is an invitation for a police officer to stop you then your investigate license, registration, insurance, inspection. Hope they are all in order.


If the schools close tomorrow January 6, 2017 in Virginia Beach then the Courts here will also be closed. Check with the local news stations. Looks like late Friday and Saturday the significant snow arrives. Hope everyone is careful and safe.

This time of year brings us more opportunities for celebration and good cheer. With that comes a dramatic increase in DUI offenses and alcohol-related highway deaths. So, Devendorf Law is reminding our clients and colleagues to drink responsibly.

When on the road during the holidays, remember the police work extra shifts. They mostly want to be home with their families and often give warnings rather than tickets. However the DUI enforcement is stepped up. That includes extra officers on patrol. There will be safety check stops where a road is blocked and all cars stopped for proof of registration, insurance, inspection so have those papers handy. But the real reason is to look for driving while intoxicated drivers.

If you get stopped be respectful. The time to argue is when we get to court. I can help you with that but hope you have safe and Happy Holidays.
