Dear Washington College of Law Community:

We write to express our hopes to advocate for a better, more inclusive Washington College of Law (WCL) community. The internal processes of the WCL Mock Trial Honor Society (MTHS) have allowed for discriminatory policies and practices to perpetuate throughout years of the organization, resulting in harms like those experienced by Jordan Hulseberg and other students, and the WCL Administration has failed to do enough. The lack of expeditious and dedicated efforts to resolve such issues has allowed both a system and a culture where abuses of student power are common and often unaddressed. The Student Bar Association (SBA) calls on the Dean’s Office and WCL Administration to dedicate comprehensive efforts to improve all of WCL’s Honors Societies (Societies) immediately and fully.

The SBA encourages the Dean’s Office and WCL Administration to address ongoing problems among all Societies and appreciates the efforts and transparency of Jordan Hulseberg in crafting practical strategies to affect such changes. Provided below are broader recommendations, based on those provided by Mr. Hulseberg, that should be applied to Mock Trial Honor Society, Moot Court Honor Society, Alternative Dispute Resolution Society, and prospective and future Societies of WCL.

First, all Societies must publicly commit to exclusively using objective standards and data in determining team admission decisions. The Societies must adhere to a transparent process in deliberations and be supervised by a neutral-third party observer when deliberations take place. The Societies must codify these changes in their Constitutions to ensure they are permanent.

Second, all Societies should amend their Constitutions in the following manner:
○ The team leadership must be chosen by a democratic vote of all Society members.
○ The Constitutions must be amended to remove the ability of students to unilaterally decide team assignments, and give such power to a rotating committee of administrators, faculty, coaches, and team members who are both on the executive board and not on the executive board of the Society.
○ The Constitutions must be amended to remove unilateral authority from students to expel members of the team, and give such adjudicatory power to a committee of administrators, faculty, and coaches.

Third, the Office of Diversity, Inclusion and Affinity Relations, led by Dean Lisa Taylor, must conduct a full audit of recruitment and deliberation records, as far back as available, for all Honors Societies to identify discriminatory practices and opportunities for students to insert bias, consciously or unconsciously.

Fourth, the WCL Faculty and Administration must approve a formal process for students to submit grievances against other students, faculty, staff, and administrators, and make that process available to the student body. While it would be beneficial for such a process to exist with the Dean of Student Affairs, we fear Dean David Jaffe is not capable of handling such complaints. Therefore, we encourage this process to be handled by someone equipped to meet these particular needs of students.

Fifth, the WCL Administration must agree to allow students to maintain their status for the semester if leaving the Society puts their total credit hours below the mandatory minimum for the student’s respective program.

The SBA applauds the independent efforts of the Societies to address such issues, but it is clear their efforts do not go far enough. To ensure a stable resolution for present and future students, the Dean’s Office and WCL Administration must be involved with affecting and maintaining changes that amplify the educational experience of the Societies. While we appreciate the Administration and Faculty’s wishes to keep student organizations student-led, it has become clear that oversight is necessary to ensure the Societies function without prejudice. Above all, the Societies are educational opportunities where all students and members should feel they have an equal chance to learn and develop their skills for the professional world beyond law school. Unfortunately, under the current system and culture, students do not support one another adequately in that effort. It is now the duty of the Dean’s Office and WCL Administration to make systemic changes where there are systemic issues. The SBA offers to facilitate conversations between and among the Administration and Societies to achieve the aforementioned goals.

We are excited to announce the newly appointed members of the 2021-2022 Student Bar Association!

Through these Executive Orders, signed by President Abdulai, the SBA Executive and Judicial Branches will commence business over the summer to begin serving the WCL community prior to Senate confirmation, and the positions of Director of Accessibility and Director of Sustainability are re-established to serve the crucial tasks of improving student access to necessary services and resources and promoting environmental stewardship at WCL, respectively.

We are beyond excited that you chose us to serve you over the next year. As we begin the first day of our SBA term today (and study for finals😬), we are thinking of all the ways we can make this year even better! In light of the recent events the Senate is convening an Emergency Senate Meeting tonight at 10:10 pm. Per the SBA Bylaws Senate meetings must be public [notification of the meeting must be made] and the meeting must be open. However, the Bylaws only allow Senators to speak during the meeting.

Tonights meeting is an unofficial meeting and no official senate business will be transacted. Instead, tonights meeting will be to inform senators of appropriate procedure per the SBA Bylaws and Constitution.

In a message to the American University Washington College of Law community, Acting Dean Robert Dinerstein and AUWCL Student Bar Association President Tim Schmeling write: "What we saw occur in Washington, D.C., on Wednesday, January 6, 2021, shook many of us to our core. Although it was not unique – as the Washington Post reported, “not since the British set fire to the Capitol in 1814 has a mob overrun the ultimate symbol of American freedom” – it was highly unusual and, frankly, appalling. As President-elect Biden said: “This is not dissent, it’s disorder. It’s chaos, it borders on sedition, and it must end now. Which is why, to protect our hard-won freedoms, we must continue to be vigilant and engaged.
