Municipal Advisory Council (MAC) Meeting

The Municipal Advisory Council meeting was conducted earlier and presided over by Vice Mayor Ganda Lañada. Updates on the implementation of 4Ps, KALAHI-CIDSS NCDDP, SLP, and Walang Gutom Program were discussed.

As one of the stakeholders, we participated in the meeting and reaffirmed our commitment to supporting programs that promote the welfare and development of our communities.

LEGISLATION 101: Understanding the Corporate Powers of our Sangguniang Bayan

Ever wondered how our local government works behind the scenes to secure development, manage public properties, and fund community projects?

As the legislative body of our municipal government, the Sangguniang Bayan plays a vital role. While the Executive branch implements programs, the Sangguniang Bayan serves as the backbone that provides the legal authority, funding, and regulations necessary to move our municipality forward.

Anchored in Republic Act No. 7160 (Local Government Code of 1991), here is a quick look at the core corporate powers exercised through local legislation:

1. Contractual Authority & Procurement – Authorizing agreements, loans, and reviewing the Approved Budget for contracts to ensure transparency and local development.
2. Property Management – Governing how municipal properties are acquired, managed, or utilized for public good.
3. Enterprise & Franchise Grants – Approving franchises for local public utilities like markets, slaughterhouses, and ferries to boost our local economy.
4. Taxation & Revenue Generation – Enacting local tax ordinances to raise the necessary revenues that fund our public services.
5. Eminent Domain – Authorizing the proper acquisition of land for vital public infrastructure and community projects.

LEGISLATION 101: POWER OF THE PURSE OF SANGGUNIAN

Where does your town’s money go? Ever wondered how municipal projects get funded, how local taxes are decided, or who holds the key to the local treasury? It all comes down to a fundamental legislative check-and-balance tool: The Power of the Purse.

In our local government setup, this immense responsibility belongs exclusively to the Sangguniang Bayan, led by our Vice Mayor as the presiding officer.

WHAT IS THE "POWER OF THE PURSE"?
It is the ultimate authority of the Sangguniang Bayan to control municipal finances by reviewing, amending, and approving annual and supplemental budgets. This ensures public money is directly allocated to address the true needs of our town.

THE LEGAL BASIS (Local Government Code of 1991 / RA 7160)
The council’s financial powers are strictly guided by law:

Section 16 (General Welfare Clause): Appropriating funds to actively promote health, safety, prosperity, and comfort.

Section 447 (a)(2): The explicit power to pass ordinances that secure funding for effective municipal operations.

Section 319 (Legislative Authorization): The mandate requiring the council to officially enact budget ordinances based on the executive's estimates.

4 KEY RESPONSIBILITIES OF THE COUNCIL
Approving Budgets: Reviewing and passing the crucial Appropriation Ordinance to set department spending limits.

Levying Taxes & Fees: Enacting ordinances to generate local revenue safely and fairly.

Budget Scrutiny & Veto Override: Carefully analyzing proposed expenses—holding the power to reduce items or override an executive veto with a 2/3 majority vote.

Oversight & Accountability: Monitoring disbursements strictly to ensure every peso aligns with our approved town development plans.

Mga kahimanwa, naniniwala po tayo na ang epektibong pamamahala ay nagsisimula sa pakikinig sa boses ng mamamayan. Kaya naman sa ating lokal na lehislatura sa Sangguniang Bayan, napakahalaga ng papel ng Public Hearing.

Ano nga ba ito?
Ito ay isang bukas na pagtitipon kung saan ang bawat mamamayan ay binibigyan ng pagkakataon na maglahad ng kanilang opinyon, mungkahi, o saloobin ukol sa mga ipinapanukalang ordinansa bago ito tuluyang maipasa bilang batas.

Legal Basis n?
Hindi lang ito basta tradisyon—ito ay itinatadhana ng batas!

Constitutional Right: Karapatan ng bawat Pilipino ang makilahok at mapakinggan.

Local Government Code of 1991 (RA 7160): Malinaw na iniutos dito (tulad ng Sec. 186 at 191) ang pagsasagawa ng konsultasyon, lalo na sa mga ordinansang may kinalaman sa buwis at iba pang lokal na regulasyon.
