Many people in our community have asked what the Orphans’ Court does and what my role as a judge involves.
The Orphans’ Court in Wicomico County oversees the probate process after someone passes away. When a person dies with assets in their name alone, such as a home, bank account, or other property, the court helps ensure those assets are handled properly and distributed according to the law.
As an Orphans’ Court Judge, my responsibility is to make sure this process is fair, orderly, and respectful to the wishes of the person who has passed and to the family members who remain.
The court oversees the administration of estates, ensuring debts are paid and assets are distributed according to a will or, if there is no will, according to Maryland law. We also hear disputes that sometimes arise between heirs, including questions about the validity of a will or concerns about undue influence or fraud.
Another important responsibility of the Orphans’ Court is protecting the property of minors who inherit assets. When a child receives an inheritance, the court can appoint a guardian to manage that property until the child becomes an adult.
In addition, the court reviews and approves administration accounts and ensures that the personal representatives handling an estate are carrying out their duties properly.
While the work of the Orphans’ Court often happens quietly and without much public attention, it plays an important role in helping families move through difficult moments with dignity.
It remains a sacred duty to stand for those who are no longer here and to ensure that their final wishes are honored.
