Good Day.

Everyone is presumed innocent until proven otherwise (guilty).

An accused person is entitled to a release on bail, and his release on bail must not be denied as a way of punishment.

NB. a police officer may detain a person for 48hrs, bail can only be applied after the accused has been charged. Therefore, bail can only be posted after the accused person has been charged.

We wanted to discuss LEASE AGREEMENT for this month. However, this is important, we have received many instructions from our clients and their matters have prescribed and some are running the risk of prescription.

Prescription on Road Accident Fund Matters.

Guide to your RAF matters.

Identified Motor Vehicle.
Say you are involved in a motor vehicle accident and the insured driver/s is/are identified, you have three years to lodge your claim with the Road Accident Fund, and five years to issue your summons against the Road Accident Fund. this period runs concurrently.

Say your accident was on this day the 17th of June 2017. you will have up until 16th June 2020 to lodge your claim, and 16th June 2022 to issue your summons.

let's look into the unidentified motor vehicle.
this is the situation wherein an insured driver/motor vehicle is unknown (hit and run) in this instance you only have 2 years to lodge your claim and five years to issue your summons against the Road Accident Fund.

Say the accident was on this day the 17th of June 2017, you will have up until the 16th of June 2019 to lodge your claim and up until the 16th of June 2022 to issue your summons.

Prescription does not run against the minor. age suspend the running of prescription. It will also not run against certain individuals who are of age but due to some circumstances, they are unable to act, eg mentally incapacitated individuals.

ANOTHER DECREE OF DIVORCE GRANTED.
NB. All monogamous customary marriages are marriage in Community of Property (with profit and loss) the validity do not rely upon their registration. ONLY THE COURT MAY GRANT A DECREE OF DIVORCE, NOT YOUR ELDERS OR SEPARATION.

THIS WEEK WE DISCUSS THE LEASE AGREEMENT
Lease agreement
A lease agreement is entered into when the lessor gives use and enjoyment of his/her property to the lessee for a specific period of time in return for the payment of rent. It is not a requirement to have it in writing, however, it is advisable to have it in writing to avoid disputes between the parties. This agreement binds the lessor and the lessee into the terms contained in the lease agreement. A lease agreement for purposes of housing is governed by The Rental Housing Act. This Act do not apply to a lease agreement entered into for business purposes.

The lessor’s obligations:
1. Deliver the property for the lessee’s use and enjoyment
2. Maintain the property
3. Warrant the lessee against unlawful evection by third parties
4. Pay municipality rates and taxes

The lessee’s obligations:
1. To enjoy and use the property (fair wear and tear)
2. To use the property for a purpose to which it is leased for
3. Pay agreed rentals
4. To vacate the property upon termination
(Both the lessor and the lessee’s obligations as listed above are just for guide)

A lease agreement may be terminated upon effluxion of time, on notice to the other part and death. A lease agreement may exclude subletting of the property. Subletting means the lessee enters into a lease agreement with a third party for use and enjoyment of the lessor’s property in return for payment of rent. Unless a lease agreement provide otherwise the lessee is entitled to subletting. Should the Lease Agreement excludes subletting and the Lessee Sublet the property, the Lessor is entitled to terminate the Lease Agreement and the Subletting Agreement is void.

THE LANDLORD HYPOTHEC
The Lessor may approach the appropriate court for an order to remove and attach the belongings of the Lessee with the assistant of a sheriff, who will then sell the Lessee’s belongings to satisfy the court order. It serves as an interdict preventing the Lessee from removing his/her belongings prior sale by the sheriff.
