“The High Court has overturned a landmark case that had allowed a judge to be sued for the first time in Australia, depriving the Queensland father who had been wrongly jailed for contempt by Federal Circuit Court judge.

But on Wednesday the High Court unanimously allowed an appeal by Justice Vasta, finding that "despite the many and egregious errors" in his treatment of Mr Stradford", all judges of courts referred to in section 71 of the Constitution were immune to a civil suit arising out of acts done in the exercise of their judicial function or capacity.

The judgment leaves Mr Stradford without redress against the judge's undisputed wrong conduct and is likely to revive calls for a federal judicial commission to investigate complaints against judges, promised by the Albanese government but not delivered.

Justice Vasta had ordered Mr Stradford to hand over gambling account statements in a property dispute with his ex-wife in 2018.

Mr Stradford said he had tried to produce them but Justice Vasta did not believe him, telling him: "I hope you brought your toothbrush." The father of two, who was not represented by a lawyer, was found in contempt and sentenced to 12 months in jail.

He spent six days in jail before he was released.
The orders were overturned by the full bench of the Family Court, which described the case as a "gross miscarriage of justice.””

March 2024 marks 2 years since Boggo Road Gaol closed just as Queensland had reopened following Covid. Over that time there was no reason why tours, functions and events could not have been conducted at the Gaol.

For 10 years we operated the Gaol 7 days a week providing unprecedented access to the community to the historic prison. Currently the heritage-listed Gaol’s forecourt is a carpark for workers. Graffiti is appearing on the walls. Our guides and staff - including former prisoners and officers - living history connected to the Gaol – are in a state of limbo. It is utterly unfair.

We need to get the Gaol reopened for our popular history tours, for school and university students, community and non-profit organisations, film productions, events and functions, interstate tour operators and cruise ships.

Trent Dalton's award-winning book has been turned into a Netflix series, premiering this Thursday 11 January. It will deliver 1980s Brisbane to viewers world-wide.
The story features many iconic Brisbane locations - including Boggo Road Gaol (Jail). One of the significant characters is Slim Halliday, the notorious "lifer" and escape-artist - played by legendary Australian actor Bryan Brown.

It will be amazing to see one of Boggo Road's infamous inmates on screen. Several former officers and prisoners from the tours we operate at Boggo Road Gaol made it on camera too! Make sure to support this incredible local production and watch.
