Ausino Group Pty Ltd & Hong (Robin) Sang have been fined $20,000 and $8,000 respectively in the Industrial Court of NSW as a result of a prosecution by SafeWork NSW.
The proceedings arose from a serious incident on 29 September 2022, when an unsecured mobile scaffold was blown over a rooftop hand railing by high winds. It fell approximately 6 storeys onto the glass roof of a neighbouring building causing damage to the glass roof. Glass shattered from the rooftop and fell into the dining area below, including into a patron’s food.
Ausino Group Pty Ltd pleaded guilty to an offence pursuant to section 33 of the Work Health and Safety Act 2011 (NSW) for failing to comply with its duty to persons other than workers under section 19(2) of the Act.
Mr Hong (Robin) Sang, Director and sole employee of Ausino Group Pty Ltd, pleaded guilty to an offence under section 27(1) of the Work Health and Safety Act 2011 (NSW) for failing to exercise due diligence to ensure that Ausino Group complied with its duty under section 19(2) of the Act.
Ausino Group Pty Ltd & Hong (Robin) Sang have the right to appeal against their sentences.
