SMB Australia Car Transport Pty Ltd, SMB Australia Car Transport Employment Pty Ltd and director Andrew Mytkowski have been convicted and fined a total of $420,000 in the District Court of NSW as a result of a prosecution by SafeWork NSW.

The proceedings arose from an incident on 24 March 2022, when a worker sustained serious injuries when struck by an industrial gate which overran vertical supports while being closed.

SMB Australia Car Transport Employment Pty Ltd plead guilty to an offence pursuant to section 32 of the Work Health and Safety Act 2011 for failing to comply with its health and safety duty to workers under section 19(1) of the Act. The company was fined $180,000.

SMB Australia Car Transport Pty Ltd plead guilty to an offence pursuant to section 32 of the Act for failing to comply with duty under section 21(2) of the Act. The company was fined $180,000.

Mr Mytkowski, who was the sole director of SMB Australia Car Transport Pty Ltd and SMB Australia Car Transport Employment Pty Ltd at the time of the incident, plead guilty to two offences under section 32 of the Act for failing to exercise due diligence as an officer of both companies as required under section 27(1) of the Act. He was fined a total of $60,000.

Ms Mary Gladys Coates has been convicted and fined $21,000 in the Industrial Court of NSW as a result of a prosecution by SafeWork NSW.​

These proceedings arose from an incident on 28 July 2023, when a grain auger known as a pencil auger was found to be in use at her Southgate, NSW business without the appropriate safety mechanisms, such as a guard, in place. ​

Ms Coates pleaded guilty to an offence pursuant to section 33 of the Work Health and Safety Act 2011 for failing to comply with her duty to workers under section 19(1) of the Act. ​

The Court also issued an adverse publicity order, which required Ms Coates to publish a public notice in local newspaper The Land newspaper containing details of the incident and conviction by the Court.​

Ms Coates has the right to appeal against their conviction and sentence.

These proceedings arose from an incident on 23 October 2023, when a worker was seriously injured after falling about three metres through a skylight void from one level to another. ​

Fitzmoore Group Pty Ltd pleaded guilty to an offence pursuant to section 32 of the Work Health and Safety Act 2011) for failing to comply with its health and safety duty to workers under section 19(1) of the Act.​

Fitzmoore Group Pty Ltd has the right to appeal against their convictions and sentences.

These proceedings arose from an incident on 13 February 2022, when a worker was seriously injured after being struck by metal debris while working on a bucket elevator conveyer. ​

Fenner Dunlop Australia plead guilty to an offence pursuant to section 32 of the Work Health and Safety Act 2011 for failing to comply with its health and safety duty to workers under section 19(1) of the Act.​

Ausko Design Constructions Pty Ltd, Oh Haan Constructions Pty Ltd and Oh Haan Constructions Pty Ltd Director Mr Ju S*k Oh have been fined $100,000, $15,000 and $90,000 respectively in the Industrial Court of NSW as a result of a prosecution by SafeWork NSW. ​

These proceedings arose from an incident on 5 October 2023, when a worker was seriously injured after falling about six metres from an unsafely constructed scaffold.​

Ausko Design Constructions pleaded guilty to an offence pursuant to section 32 of the Work Health and Safety Act 2011 (the Act) for failing to comply with its health and safety duty to workers under section 19(1) of the Act.​

Mr Oh, who was the sole director and site foreman, pleaded guilty to an offence pursuant to section 32 of the Act for failing to comply with his health and safety duty under section 28(b) of the Act.​

Ausko Design & Construction Pty Ltd, Oh Haan Constructions Pty Ltd and Mr Oh have the right to appeal against their convictions and sentences.
