A fake building surveyor who filed a late appeal against a BPC prosecution has been ordered to pay an extra $40,000 in costs – bringing the total bill for his offences to $120,000.
Khanh Ho was previously convicted and fined $80,000 including costs for issuing fraudulent permits, forging documents and taking payments while posing as a registered building surveyor and inspector at 9 Melbourne locations.
He appealed the Magistrates' Court’s decision which was struck out by the County Court this week for being out of time.
The BPC sought to recover legal fees following one of its most complex investigations to date, and was granted a costs order.
The judge’s decision reinforces the importance of complying with court processes and undertakings, and the seriousness of Ho’s misconduct.
