• Confirming contractors hold the correct licence
• Conducting on‑site inspections during installation to verify pipework meets Australian Standards

Wet weather can expose dodgy building work 🌧️

If you’ve recently built or renovated, keep an eye out for these red flags:

🚩 Water stains or damp patches

🚩 Peeling or bubbling paint

🚩 Mould or musty smells

🚩 Drips or pooling water

🚩 Blocked gutters or pipes

Check your ceilings, walls, floors, windows, doors, kitchen and bathroom.

Remember: major defects are covered by a 6-year statutory warranty, and 2 years for other defects.

We’re making it easier for certifiers to manage their workload and build experience with new ‘Inspecting Up’ provisions.

🔹 Individuals registered in the ‘building surveyor – restricted (class 1 and 10 buildings)’ and ‘building surveyor – restricted (all classes of building)’ classes are now able to carry out critical stage inspections (other than the final critical stage inspection) in the class above their own

🔹 These inspections must be carried out with the consent and under the supervision of the principal certifier, in alignment with the new supervision chapter in volumes 1 and 2 of the Practice Standard for Registered Certifiers

🔹In the event that the principal certifier is a local council or registered body corporate, supervision must be delegated to an individual registered in an appropriate building surveyor class

A repeat offender in unlicensed building work, Hong Thanh Dang Tran’s appeal for a lighter sentence has been dismissed, with the District Court upholding the original sentence and victim compensation orders in full.

Tran carried out residential building work without a licence despite prior convictions for similar conduct, continuing to engage in unlawful practices in 2022 and 2023.

His original sentencing took place in December 2025, where he received an aggregate term of 2 years and 3 months’ imprisonment, with a non-parole period of 18 months, and was ordered to pay more than $82,000 in victim compensation.

Despite attempting to challenge the severity of his NSW sentence, the appeal was dismissed in April 2026, with the Court confirming the sentence was not excessive and that all original orders would stand.

This decision reinforces a clear message: individuals who engage in unlawful building work and disregard regulatory requirements will be held accountable, with courts emphasising the importance of general and specific deterrence.

Got dodgy building work to report?

Here’s what you need to lodge a complaint:
• Details of the property owner.
• Details of the contractor who undertook the work.
• The type of work done and date commenced, including plans and contracts.
• Evidence of the date the work was completed. For example, occupational certificates.
• Copies of correspondence about the dispute.
• Copies of reports or photos in relation to defects.

For complaints within a multi-unit dwelling, we also need information about the builder, developer, certifier and strata managing agent.

More homes, sooner. NSW has introduced a bill to Parliament proposing new building laws to make home building faster and simpler.

The proposed reforms focus on key areas, including:
• Providing a clear regulatory framework for prefabricated homes and modular buildings.
• Modernising the building approvals system.
• Enhancing dispute resolution processes for occupied apartment buildings.
• Clarifying the role of certifiers and strengthening conflict of interest laws and penalties.

These changes will help deliver more high-quality homes across NSW.

Building Commission NSW and SafeWork NSW inspectors joined forces in March to inspect building sites across the Hunter. They also engaged directly with students and the local community to help lift standards across the region.

Here’s what we found:

🏠 36 sites inspected by Building Commission NSW and 18 penalty notices issued, totalling $12,000 in fines.

🏠 Issues identified by Building Commission NSW have now been rectified or are being rectified. 2 penalties were issued for unlicensed contracting and 1 penalty issued for missing builder signage.

🏠 27 worksites inspected by SafeWork NSW, resulting in 57 improvement notices and 5 prohibition notices targeting serious safety risks.

🏠 Issues identified included poor site security, missing signage and lack of basic amenities.

We’ll continue working on the ground to support quality construction and safer building practices across NSW.
