At a Council meeting held on 6 August 2026, Council resolved to make the Shire of Toodyay Activities in Thoroughfares and Public Places and Trading Local Law 2026 pursuant to section 3.12 of the Local Government Act 1995 the purpose and effect of which are:
Purpose: to regulate the use of thoroughfares, public places and local government property in order to promote public safety, manage obstructions, protect the natural environment, ensure fair and orderly trading, and provide clear standards for activities such as verge treatments, signage, street trading, outdoor eating facilities, and other uses of public land within the Shire of Toodyay.
Effect: to provide a legal framework that:
๐ธ Prescribes the activities that require a permit;
๐ธ Sets conditions under which those activities may be conducted;
๐ธ Regulates trading, events and signage in public places;
๐ธ Manages vegetation, firebreaks, environmental protection and activities that may impact thoroughfares;
๐ธEstablishes offences for nonโcompliance, including prescribed modified penalties; and
๐ธ Enables the Shire to issue notices and take enforcement action to protect public health, amenity, safety and environmental values.
The Shire of Toodyay Activities in Thoroughfares and Public Places and Trading Local Law 2026 was published in the government gazette, on Monday 31 August 2026 (No. 112). It will come into operation on Monday 14 September 2026.
