Justice Minister Sean Fraser and Health Minister Marjorie Michel announced on October 7 that the federal government will introduce legislation to prevent euthanasia for people whose sole underlying medical condition is a mental illness.

However, the government’s legislation will also permit euthanasia by advance request.

Euthanasia by advance request is a dangerous concept. It could allow doctors and nurse practitioners to end the life of someone who has become mentally incompetent, based on a request made in advance.

Even more concerning, euthanasia by advance request falls outside federal jurisdiction, raising serious questions about the federal government’s authority to legislate on this matter.

Health care falls primarily under provincial jurisdiction. So why is the federal government proposing legislation on a matter of provincial jurisdiction?

Vulnerable Canadians deserve protection—not a system that risks ending their lives when they can no longer speak for themselves.

Bill C-218 has been defeated.

Yesterday, MPs voted 187–141 against legislation that would have permanently prevented euthanasia when mental illness is the sole underlying medical condition.

The Liberal government says it will introduce its own legislation to keep this expansion paused—but at the same time, it plans to expand euthanasia through advance requests, allowing someone to request death before they lose the capacity to consent.

Euthanasia by advanced request is a very dangerous concept as it would permit doctors and nurse practitioners to kill someone who has become incompetent, based on an advanced request.

As Alex Schadenberg warns, this raises serious questions about consent, vulnerability and where Canada’s euthanasia regime is heading.
