AFFIDAVIT OF SERVICE

An affidavit is a written statement of facts, confirmed by an oath or affirmation.

Affidavits are sworn before an officer having the authority to administer oaths or affirmations, such as a notary public or commissioner of oaths.

An Affidavit of Service (also called Proof of Service) confirms to the courts that certain legal documents have been successfully delivered to an individual. The person who served the documents must sign the affidavit in the presence of a notary public or commissioner of oaths.

Affidavits of Service should include:

the name and address of the server
the name of the person served
the date, time, and place the documents were presented to that individual
how the individual was identified
a copy of the served papers is attached as an exhibit

SMOOTH DESTINATION WEDDING PLANNING

Getting married is the first step in creating a new life together. It’s a magical time for any couple. Given the high cost of hosting a wedding at home, more and more couples are choosing an exotic locale to exchange their vows. There are a few more logistical challenges when saying, “I do” in another country, but with some careful planning the paperwork can be squared away long before your special day.

Valid Travel Documents
Every country has its own entry and exit requirements and rules regarding weddings in that country. If you are planning to get married abroad, check with the applicable Embassy or Consulate to make sure you meet all of the requirements in the country you plan to wed. At a minimum, you will require valid travel documents like a passport that doesn’t expire for at least six months beyond your expected date of return. The latter isn’t a requirement for every country, but it is common enough that you should consider renewing your soon-to-be expired passport anyway.

You will also need to check the Visa entry requirements for your destination wedding and ensure that you, your prospective spouse, and every member of your wedding party understand what is necessary for their trip. Border officials won’t make an exception to entry requirements for your special day. Your arrival will be smoother if you have information on your departing flight and details on the hotel at your destination readily accessible upon request.

MEDICAL CORPORATION RENEWAL

Into everybody’s life, a little red tape must fall. The members of the College of Physicians and Surgeons of Ontario (CPSO) are no exception. In addition to keeping up with the latest advances in medical treatments and managing their practice and patient concerns, doctors have to fulfill the requirements of the CPSO.

For example, physicians who have chosen to establish a corporation for the purposes of practicing medicine are required to apply to the College for a Certificate of Authorization, and to renew that certificate annually. Administering the Statutory Declaration in the annual Medical Corporation Renewal application is just one of the many ways Red Seal Notary can help you.

Annual Renewal of Certificate of Authorization
As previously mentioned, the Certificate of Authorization for Medical Corporations must be renewed each year. While the College does issue reminder notices for this renewal, shareholders in the corporation are responsible for ensuring the validity does not lapse. Renewal applications take approximately six weeks to process, forms must be completed in full for consideration, and any forms that are incomplete or incorrectly filled out will be returned.

LETTERS OF INVITATION FOR A VISA

Every year, the world gets a little smaller. When Canada was initially settled, those who first arrived in this land of ours had no idea if they would ever see their cherished family back home again. Now that air travel has made it possible to span the globe in a matter of hours instead of months, families are reuniting at a faster pace than ever. If you have family abroad that you would like to come to Canada for a visit, it all starts with a Letter of Invitation.

Letter of Invitation
Visitors from some countries may need a Letter of Invitation to be considered for a visitor’s visa. With the exception of the parent and grandparent super visa, issuing an invitation DOES NOT mean that you are legally or financially responsible for your visitor upon their arrival. However, you must intend to keep any promises of assistance you make in the letter. This letter is a lot more detailed than your standard invite to a backyard barbeque, but the basic principles are the same. It must include personal information about you and about the person you are inviting to Canada.

In nearly all cases, the visa office will require that the Letter of Invitation be notarized by a Notary Public. The Letter of Invitation does not guarantee that your visitor will be granted a visa, but taking the time to complete it accurately and honestly will go a long way to ensure that the visa process isn’t hindered by missing information in the invitation.

MEDICAL COUNCIL OF CANADA CERTIFIED IDENTITY CONFIRMATION

The Medical Council of Canada (MCC) is an organization dedicated to the uniform assessment of Doctors across Canada. It holds examinations and maintains ongoing standards of evaluation for Canadian Doctors to practice Medicine. Medical Licences themselves are issued by regulatory authorities in each Province and Territory. The MCC however ensures that patients across Canada can rest assured that their Doctor must meet the same rigorous requirements as Doctors in any other Canadian jurisdiction.

The MCC also maintains a record of the qualifications of each Medical Doctor in Canada. This allows for physician mobility, making it much easier for Doctors practicing in one jurisdiction to transfer to another.

Not surprisingly, the MCC needs to ensure that the assessment and qualification records they maintain are for the individual actually assessed. The Certified Identity Confirmation form is for this purpose. Candidates must complete the form and sign it before a Certifying Official, such as a Notary Public. The candidate must attach two identical photos to the form, one securely glued in the space near the top, and one with a single piece of scotch tape near the bottom of the form, so it is easily removed by MCC staff. When the form is Notarized, the Notary seal will be partially over the glued photo, so the MCC can be assured it is the same photo verified by the Notary.

FINGERPRINTS FOR GOVERNMENT CONTRACT SECURITY SCREENING

The Government of Canada recently increased the criminal record check requirements for Government Security screenings of private contractors. Although many contractors and their staff previously required a check based only on name and date of birth, this has now been upgraded to checks based on fingerprints, which are far more reliable and conclusive.

Most Government contractor security screenings are handled by the Contract Security Program of Public Services and Procurement Canada (formerly Public Works and Government Services Canada). Application procedures vary based on the level of clearance required. However, even the lowest screening level (“reliability status” at the time of this writing) now requires that fingerprints be taken.

TRAVEL CONSENT FOR YOUR CHILDREN

Travel Consent Letters
As holidays draw near, often so do travel plans. In today’s hectic world, we can’t always coordinate the entire family to travel at the same time. Maybe Mom or Dad has a last-minute project at work and can’t get the travel day off. Or maybe the children are going to see Grandma on their own.

Whatever the reason, it is more common for children to be traveling without one or both parents. In those circumstances, officials at the border may ask if the accompanying parent or adult has a consent letter from the absent parent(s). It is recommended that these letters be notarized, providing assurance to the border official that the named parent (or parents) did indeed sign the letter. WHAT IS AN AFFIDAVIT OF EX*****ON?

Although to some this may sound like something morbid, Affidavits of Ex*****on have nothing to do with capital punishment. Ex*****on in legal jargon is, in essence, signing. They are a common sworn statement, sometimes more descriptively titled ‘Affidavit of a Witness’, or ‘Witness Affidavit’. Although they vary somewhat in terms of their exact contents, in essence, they are simply a sworn statement from a witness to the signing of a document, that she or he in fact did so. They may also include other details to show that the document was properly ‘executed’, such as that the person signing was an adult, or that the witness has no financial interest in the transaction.

What are they for?
These sworn statements are commonly used in Estates law, at least in some jurisdictions. This is partly for practical reasons – the original person that signed may be deceased or otherwise incapacitated, and thus unable to attest to the signing for herself. In some cases, particularly when the document is being used many years after it was signed, the witness may also be deceased or incapacitated. Having the affidavit kept with the document thus provides evidence of its proper ex*****on. It is important to note, however, that the Affidavit does not make the document necessarily valid. For example, a subsequent Will will normally invalidate a prior Will, whether or not the prior Will was properly executed.

How do I get a proof of life certificate for my pension notarized?
Being asked to prove that you are alive might seem like a strange request, but if you receive a pension from outside of Canada, it is likely that you will be asked to do this at some point. Many countries ask pensioners to submit a proof of life form, also called a life certificate, certificate of life, or certificate of existence.

What is a proof of life document?
A proof of life document, or life certificate, is a document used by governments, pension funds, and insurance companies to make sure that individuals are alive and continue to qualify for benefits. Usually, the proof of life document requires a professional like a notary public to confirm that the recipient of the benefit is alive.

When do I submit this document?
Many organizations ask that these documents be submitted every one to two years, while some require them every six months. This often varies by country.

Do I need to get my life certificate notarized?
It is important to read the instructions for the document very carefully, to make sure that your form can be witnessed by a Notary Public who checks your identification. A notary public cannot sign a form that requires a witness or guarantor to state that they know you personally, often for two years or more.
