A significant victory before the Egyptian Court of Cassation.

Yassien & Partners is proud to announce a landmark judgment issued in favor of our client by the Egyptian Court of Cassation, reaffirming two critical principles in civil litigation and contractual disputes:

▪️ The Court’s authority to review the legal and factual grounds relied upon for contractual termination or annulment — even where the contract contains an automatic termination clause.

▪️ The power of the Court of Cassation to decide the merits of a civil dispute directly from the very first cassation challenge, without remanding the matter back to the lower court.

This ruling reflects a progressive judicial approach toward strengthening judicial oversight over contractual enforcement mechanisms while promoting procedural efficiency and legal certainty.
Most importantly, the judgment sends a clear message:

Contractual autonomy is not absolute, and the enforcement of termination clauses remains subject to judicial scrutiny.

تفخر شركة ياسين وشركاه بالإعلان عن صدور حكم تاريخي لصالح أحد عملائها من محكمة النقض المصرية، والذي أعاد التأكيد على مبدأين جوهريين في مجال المنازعات المدنية والتعاقدية:

▪️ سلطة المحكمة في مراجعة الأسس القانونية والواقعية التي يستند إليها فسخ أو إنهاء العقود، حتى في حال تضمّن العقد شرط فسخ تلقائي.

▪️ اختصاص محكمة النقض بالفصل في موضوع النزاع مباشرةً منذ أول طعن بالنقض، دون الحاجة إلى إعادة القضية إلى محكمة الموضوع.

يعكس هذا الحكم توجهًا قضائيًا متقدمًا نحو تعزيز الرقابة القضائية على تنفيذ العقود، بما يحقق مزيدًا من الكفاءة الإجرائية والاستقرار القانوني.

في إنجاز جديد يعكس المكانة الرائدة لمكتب ياسين وشركاؤه في إدارة وتسوية منازعات الاستثمار، يسرنا الإعلان عن صدور قرار اللجنة الوزارية لفض منازعات الاستثمار لصالح شركتين من كبار عملاء المكتب، واللتين تُعدان من الشركات الرائدة في قطاع استيراد وتصنيع المواد الغذائية في جمهورية مصر العربية.

وقد تضمن القرار إلغاء قرار مصلحة الجمارك – جمارك الإسكندرية – بشأن إيقاف أرقام المتعاملين الخاصة بالشركتين، وذلك تنفيذًا لقرار اللجنة الوزارية الصادر بتاريخ 29 ديسمبر 2025 والمعتمد من مجلس الوزراء بتاريخ 6 يناير 2026، بما يعيد للشركتين كامل حقوقهما القانونية ويمكنهما من استئناف أنشطتهما التشغيلية دون عوائق.

وتكتسب هذه النتيجة أهمية استثنائية، حيث ساهم هذا القرار في الحفاظ على مصالح مالية جوهرية لعملائنا، وتجنيبهم خسائر تُقدّر بملايين الدولارات، فضلًا عن ضمان استمرارية أعمالهم واستقرار مراكزهم القانونية والتجارية.

ويجسد هذا القرار أهمية التمثيل القانوني الاستراتيجي في التعامل مع المنازعات ذات الطابع التنظيمي والاستثماري، ويؤكد الدور المحوري للدعم القانوني المتخصص في حماية الكيانات التجارية وضمان استقرار أعمالها أمام الجهات التنظيمية والحكومية.
