New on Substack: The Rule, Not the Exception
The Treason Act of 1708 wasn't an isolated breach of the Treaty of Union.
It established a method: preserve Scotland's protections in form, override them in substance, and call the result lawful.

Why Andy Burnham’s written constitution could be the Union’s undoing. 🧵

Prime Minister Andy Burnham’s call for a written UK constitution is a dangerous game for the Union but as Dr. Kirsty Hughes recently asked: Would it actually spell out what a "voluntary union" means?

​Rebuilding the UK’s unwritten, piecemeal constitutional framework isn't just reform, it’s a minefield. To write down the rules of the Union, drafters would have to confront the ultimate contradiction: the collision between Scottish popular sovereignty and English parliamentary supremacy.

​You cannot codify the Union without re-examining its foundational legal document, the Treaty of Union, in the cold light of international law.

​What worked as a vague, top-down devolution debate in 2014 won't hold up in 2026. Today, the conversation has moved to external self determination. Opening the constitutional curtain won't save the UK; it will expose the structural fictions holding it together.

Be careful what you wish for, Andy, a written constitution might just be the Union’s self-destruct button.
