“My agent says it’s not a legal requirement for landlords.”

Whilst it isn’t a criminal offence to not carry out PAT Testing, a residential landlord would find it difficult to prove due diligence was followed if an incident occured without a PAT Certificate in place.

It falls under Health & Safety legislation. If a fire occurred or someone got hurt, a landlord may have to prove due diligence was met to avoid severe repercussions.

Health & Safety law and Criminal law are often misunderstood.

The Electrical Safety Council’s Guidance recommends Portable Appliance Testing to satisfy a Landlord’s obligation to ensure that any portable electrical appliances provided under the tenancy are safe at the point of letting, and at periodic intervals after that.

PAT Testing For Landlords

The regulations on electrical appliances for landlords and/or letting agents, The Electrical Equipment (Safety) Regulations, mandatory since 1 January 1997, state that all electrical appliances supplied with let accommodation must be safe. As landlord, it's your duty of care to prevent harm to your tenants from any electrical appliances which you have supplied. Portable appliance testing is widely regarded as being the best way of complying with this obligation.

This applies to both new and second-hand appliances and covers all electrical items supplied for the intended use of the Tenant. The only sure method of ensuring that these appliances are safe is to have them tested by a trained competent person using the appropriate calibrated portable appliance testing equipment.

PAT Testing For Business

As a business, you have a duty to prevent any harm coming to your employees and customers. The responsibility of employers under the Electricity at work regulations states: 'As may be necessary to prevent danger all systems should be maintained to prevent so far as is reasonably practicable such danger.'

To meet the requirements of the Electricity at work regulations, it is widely regarded to be necessary to implement a programme of planned inspection and testing of portable appliances.

The PAT Testing Process
Portable appliance testing includes a thorough visual check of the appliance and a series of tests on professional PAT testing equipment. The appliance or lead being tested is checked for a variety of faults, and given a pass or fail sticker as appropriate. A certificate of testing is also provided for the business showing the results of all tests.

We will effect minor repairs at the time of testing (for example an incorrect fuse rating or damaged plug or IEC lead) in order that the equipment is safe to use and can be passed; more significant faults or damage will be reported to the manager.

All testing is carried out in accordance with The Institute of Electrical Engineers (IEE) code of practice, with full public liability insurance. We also issue NICEIC Certification on all electrical works completed by ourselves where required.

Added Value - Socket Testing
If requested to do so, we can check a customer's socket outlets, particularly their earthing integrity, whilst testing the appliances. Performing these two tasks concurrently is worthwhile and cost-effective.

Why PAT Test?
Around 1000 accidents at work involving electric shock or burns are reported to the Health & Safety Executive (HSE) each year. Portable electrical appliances are a major cause of fires both in the home and at work. Over 2,500 people are killed or injured as a result of electrical fires every year.

When you take out insurance cover, the insurance company will often make the assumption that the insured business is complying with all regulations necessary. If a claim is made during your insurance period, the insurance company may reduce, delay, or even refuse to pay if the damage has been caused by an appliance that has not been tested.

All electrical equipment is subject to wear and tear during use, and this damage could render the equipment dangerous to use. Without a regular programme of PAT testing and inspection, you have not taken reasonable steps to ensure the safety of users.

Tests and inspections should be made at reasonable and regular intervals, bearing in mind the rate of use of both portable and fixed appliances. Whilst PAT testing is not strictly compulsory, it is generally regarded as being the best way of meeting the electrical regulations that exist to protect employees, customers and tenants. Without it you could be in a very difficult situation if an electrical accident were to happen.

What are the benefits of PAT testing?

Getting your appliances tested has many benefits, the biggest one being ‘saving lives’. However for most workplaces the biggest benefit of PAT testing is it ticks the box to say you’re doing what you can to ensure the electrical equipment you provide is safe to use, and thus meeting your obligations for health and safety at work.

Approximately 15% of all domestic fires in England and Wales are caused by electrical faults, with electrical appliance breakdowns and broken cables among the leading causes. The average year sees almost 8,000 electrical fires in the UK alone, with nearly 4,000 injuries and more than 30 deaths.

Will these shocking figures compel you to get your electrical system checked out?

Reducing these numbers is a benefit of PAT testing – the main reason for getting electrical equipment tested these days is to reduce the chances of an appliance starting a fire.
