September is getting closer, but what happens if your child still doesn’t have a school place?

If your child is disabled or has additional needs and you’re still waiting for a placement to be confirmed, you may be feeling worried, frustrated or unsure where to turn.

Your local authority or Education Authority still has responsibilities to make sure your child can access an appropriate education. You do not simply have to accept that they will be left without one.

Proposed SEND reforms would mean the support your child needs is no longer written into a legally enforceable Education, Health and Care (EHC) plan.

Instead, detailed support would move into a new Individual Support Plan (ISP).

What does this mean?

✔️ Today, the support in an EHC plan is legally enforceable and your child is entitled to the special educational provision they require to meet their individual needs.

❌ Under the proposals, support in an ISP would not carry the same legal protections.

If families disagree with the support provided, or the agreed support in an ISP is not delivered by a setting, the only likely option would be to submit a complaint to the school setting.

Every child and young person with SEND needs to retain their legally enforceable rights, not rely on discretion and aspiration.

SEND Tribunal to pilot case manage Section I only appeals, from 17th August.

SEND Tribunal pilot for section I only appeals registered from 17 August 2026 📣

The SEND Tribunal is going to case manage appeals which are only about placement differently.

What you need to know for section I only appeals:

🔷 Hearing dates will not be included in the initial case directions sent out on registration

🔶 After the bundle deadline, the SEND Tribunal will respond to any SEND7 Request for change forms (earlier responses will only be in exceptional circumstances) and consider if the appeal is ready to be heard

🔷 If the appeal is ready to be heard, it will be listed for the next available hearing date and/or a JADR hearing

🔶 If the appeal is not ready at that point, the SEND Tribunal will set further directions. This may include a revised timetable or action relating to non-compliance.

DISABILITY DISCRIMINATION

What is it?

If someone is treated unfairly because of their disability, or because of something arising from their disability, this may be disability discrimination.

All early year's settings, schools, colleges and local authorities (LA) must make sure that they:

Do not treat children and young people worse than others, or badly, because of their disability

Do not treat non-disabled children and young people worse than others because of their association with a disabled person or because the school thinks they’re disabled when they’re not

Do not follow policies or practices which unfairly disadvantage disabled children and young people (if they do, it could also be discrimination against a non-disabled child or young person if they are disadvantaged in the same way), and change what they do (or were planning to do) to make sure a disabled child or young person is not disadvantaged. The type of changes they have to make are called reasonable adjustments.

What is reasonable for them to do will depend on the facts.
