🫐As late summer arrives across the UK, thousands of families head out into the countryside to enjoy a classic British tradition.
☀For many people, going outside in nature and picking wild blackberries is one of the most memorable parts of enjoying wildlife in summer.
👉From crumble to jam, these berries are a favourite seasonal treat. However, forage-lovers are being warned that picking blackberries in the wrong place could result in a steep £300 fine. Knowing what to avoid can help people avoid fines while protecting wildlife.
The best time to pick blackberries is from late August to September, when they are completely black, juicy, and easily come off the stem with a light tug. Steer clear of red or hard berries, since they won't ripen once they're off the vine. Experts advise people to avoid picking berries close to the ground (where dogs can reach) or directly next to busy roads.
What are the legal rules and rights?
People should be aware of the legal rules of foraging and the difference between public land and common rights. Under the Theft Act 1968, it is generally legal to pick fruit, foliage, fungi, or flowers growing wild on public land, provided it is strictly for personal consumption and not for commercial sale.
Local councils and wildlife bodies can enforce strict bylaws that ban foraging altogether in protected zones. Nature reserves, Royal Parks, and Sites of Special Scientific Interest (SSSIs) often prohibit picking to safeguard delicate habitats.
You can't pick wild fruit from private property unless you get clear permission from the landowner, as going onto private land without their consent is considered trespassing, which is a civil wrong. You must legally access land before picking anything.
Why are fines issued?
Fixed penalty notices, which range anywhere from £100 to £300, are primarily issued to prevent ecological damage. Over-foraging deprives local wildlife—such as birds, small mammals, and essential pollinating insects—of a crucial autumn food source before winter sets in. Council wardens may also crack down on people who damage or uproot entire bushes while collecting.
How can you forage responsibly?
Check local signs. Always look out for council notices or rules posted at the entrances to parks and public spaces before you start picking.
Take only what you need. Stick to reasonable quantities for personal use and leave plenty behind for nature and other walkers.
Given the recent hot weather and severe heatwaves the UK has experienced this summer, experts are advising people to strictly limit their harvest to leave plenty of fruit for birds, small rodents, and insects that are struggling to find hydration and food.
Protect the plant while picking. Gently collect fruit without breaking branches, trampling surrounding roots, or digging up plants.
