How Did Scotland Get Here?

We hear a lot about Scottish independence today. But to understand the debate, it helps to go back a little.

Actually, quite a long way back.

So, how did we get here?

It starts before the Union

Scotland was an independent kingdom with its own Parliament long before the United Kingdom existed.

Scotland and England had shared a monarch since 1603, but they remained separate countries with separate parliaments.

Scotland's own Parliament closed.

But Scotland didn't simply become the same as England. Important parts of Scottish national life remained distinct, including its legal system, education system and established church. That distinction still matters today.

๐—ง๐—ต๐—ฒ ๐—น๐—ผ๐—ป๐—ด ๐—ฟ๐—ผ๐—ฎ๐—ฑ ๐—ฏ๐—ฎ๐—ฐ๐—ธ ๐˜๐—ผ ๐—ฎ ๐—ฆ๐—ฐ๐—ผ๐˜๐˜๐—ถ๐˜€๐—ต ๐—ฃ๐—ฎ๐—ฟ๐—น๐—ถ๐—ฎ๐—บ๐—ฒ๐—ป๐˜

For generations, Scotland was governed without its own national legislature. But the idea of Scottish self-government never entirely disappeared.

During the 20th century, demands for greater control over Scotland's own affairs grew.

๐—œ๐—ป ๐Ÿญ๐Ÿต๐Ÿณ๐Ÿต, ๐—ฆ๐—ฐ๐—ผ๐˜๐—น๐—ฎ๐—ป๐—ฑ ๐—ต๐—ฒ๐—น๐—ฑ ๐—ถ๐˜๐˜€ ๐—ณ๐—ถ๐—ฟ๐˜€๐˜ ๐—ฟ๐—ฒ๐—ณ๐—ฒ๐—ฟ๐—ฒ๐—ป๐—ฑ๐˜‚๐—บ ๐—ผ๐—ป ๐—ฑ๐—ฒ๐˜ƒ๐—ผ๐—น๐˜‚๐˜๐—ถ๐—ผ๐—ป. A majority of those who voted backed the proposal, but a special rule required at least 40% of the entire registered electorate to vote Yes. That threshold wasn't reached, so devolution didn't happen.

The story didn't end there.

Campaigning continued, and eighteen years later Scotland was asked again.

๐—œ๐—ป ๐˜๐—ต๐—ฒ ๐Ÿญ๐Ÿต๐Ÿต๐Ÿณ ๐—ฟ๐—ฒ๐—ณ๐—ฒ๐—ฟ๐—ฒ๐—ป๐—ฑ๐˜‚๐—บ, ๐Ÿณ๐Ÿฐ.๐Ÿฏ% ๐˜ƒ๐—ผ๐˜๐—ฒ๐—ฑ ๐—ณ๐—ผ๐—ฟ ๐—ฎ ๐—ฆ๐—ฐ๐—ผ๐˜๐˜๐—ถ๐˜€๐—ต ๐—ฃ๐—ฎ๐—ฟ๐—น๐—ถ๐—ฎ๐—บ๐—ฒ๐—ป๐˜, while 63.5% also backed giving it tax-varying powers.

This time, change followed.

Devolution changed Scotland, but it wasn't independence

The new Parliament could make decisions in areas such as health, education and justice.

Other major areas remained reserved to Westminster, including much of the constitution, defence and foreign affairs.

Over time, the Scottish Parliament gained additional powers. But Scotland remained part of the United Kingdom, with sovereignty over reserved matters continuing to rest at Westminster.

And that takes us to the next big moment.

On 18 September 2014, people in Scotland were asked:

โ€œShould Scotland be an independent country?โ€

๐—ง๐˜‚๐—ฟ๐—ป๐—ผ๐˜‚๐˜ ๐˜„๐—ฎ๐˜€ ๐—ฒ๐˜…๐˜๐—ฟ๐—ฎ๐—ผ๐—ฟ๐—ฑ๐—ถ๐—ป๐—ฎ๐—ฟ๐˜†: ๐Ÿด๐Ÿฐ.๐Ÿฒ%.

The result was:

No: 55.3%
Yes: 44.7%

Scotland remained part of the United Kingdom.

For some people, that settled the question. For others, it didn't.

And events soon added another chapter.

Then came Brexit

In the 2016 EU referendum, the UK as a whole voted to leave the European Union.

๐—ฆ๐—ฐ๐—ผ๐˜๐—น๐—ฎ๐—ป๐—ฑ ๐˜ƒ๐—ผ๐˜๐—ฒ๐—ฑ ๐—ฑ๐—ถ๐—ณ๐—ณ๐—ฒ๐—ฟ๐—ฒ๐—ป๐˜๐—น๐˜†: ๐—ฎ๐—ฟ๐—ผ๐˜‚๐—ป๐—ฑ ๐Ÿฒ๐Ÿฎ% ๐˜ƒ๐—ผ๐˜๐—ฒ๐—ฑ ๐—ฅ๐—ฒ๐—บ๐—ฎ๐—ถ๐—ป.

When the UK subsequently left the EU, Scotland left with it.

That difference in voting patterns became another important part of the independence debate, particularly for people who argued that Scotland's constitutional future could be affected by decisions made across the UK even when a majority in Scotland voted another way.

Others continued to argue that decisions affecting the whole United Kingdom should be made on the basis of votes across the UK as a whole.

And that difference of view gets us remarkably close to where we are today.

Scotland has travelled from an independent kingdom, through political union, to nearly 300 years without its own Parliament, and then back to having a devolved Parliament with substantial, but limited powers.

The 2014 referendum answered the independence question put to voters at that time.

But it didn't end the wider debate about where power should sit, how Scotland should be governed, or whether Scotland's future should ultimately be within or outside the United Kingdom.

And that's why, more than three centuries after the Union of 1707, Scotland's constitutional story is still being written.

The Scottish Government has today published a draft Independence Referendum Bill, setting out ๐—ต๐—ผ๐˜„ ๐—ฎ ๐—ณ๐˜‚๐˜๐˜‚๐—ฟ๐—ฒ ๐—ฟ๐—ฒ๐—ณ๐—ฒ๐—ฟ๐—ฒ๐—ป๐—ฑ๐˜‚๐—บ ๐—ผ๐—ป ๐—ฆ๐—ฐ๐—ผ๐˜๐˜๐—ถ๐˜€๐—ต ๐—ถ๐—ป๐—ฑ๐—ฒ๐—ฝ๐—ฒ๐—ป๐—ฑ๐—ฒ๐—ป๐—ฐ๐—ฒ ๐—ฐ๐—ผ๐˜‚๐—น๐—ฑ ๐—ผ๐—ฝ๐—ฒ๐—ฟ๐—ฎ๐˜๐—ฒ.

But what has actually changed โ€” and does this mean another referendum is now going ahead?

The draft Bill proposes that voters would be asked:

However, there is an important distinction.

The Scottish Government states that the Bill would be introduced to the Scottish Parliament once the necessary powers have been secured.

The legal position is important. In 2022, the UK Supreme Court ruled that the Scottish Parliament could not legislate for the proposed independence referendum under its existing powers. ๐—ง๐—ผ๐—ฑ๐—ฎ๐˜†'๐˜€ ๐—ฑ๐—ฟ๐—ฎ๐—ณ๐˜ ๐—•๐—ถ๐—น๐—น ๐—ฑ๐—ผ๐—ฒ๐˜€ ๐—ป๐—ผ๐˜ ๐—ฐ๐—ต๐—ฎ๐—ป๐—ด๐—ฒ ๐˜๐—ต๐—ฎ๐˜ ๐—ฝ๐—ผ๐˜€๐—ถ๐˜๐—ถ๐—ผ๐—ป ๐—ฏ๐˜† ๐—ถ๐˜๐˜€๐—ฒ๐—น๐—ณ.

So, today's publication is an important political development, but it is not, by itself, the legal authority to hold another referendum.

What happens next will depend on the political and constitutional route pursued to secure those powers.

Some complaints are too complex or serious to resolve quickly. Others move to this stage if the person remains dissatisfied after Stage 1.

The NHS organisation investigates the issues raised, which may involve reviewing records, gathering information and speaking to the staff involved.

A full response should normally be provided within 20 working days, although some investigations can take longer. If more time is needed, the person making the complaint should be told why.

The response should address the points raised and explain the outcome of the investigation.

Where something has gone wrong, this can include an apology and information about action that has been takenโ€”or will be takenโ€”to help prevent the same problem happening again.

Once the NHS complaints procedure has been completed, a patient who remains dissatisfied can ask the Scottish Public Services Ombudsman (SPSO) to consider the complaint.

The SPSO is independent of the NHS and can investigate complaints about NHS services in Scotland.

Patients can also receive free, confidential and independent help with making an NHS complaint through the Patient Advice and Support Service (PASS).
