🏛️ Scotland Explained

𝗛𝗢𝗪 𝗔𝗥𝗘 𝗟𝗔𝗪𝗦 𝗠𝗔𝗗𝗘 𝗜𝗡 𝗦𝗖𝗢𝗧𝗟𝗔𝗡𝗗?

When a new law is proposed in Scotland, it goes through a process designed to allow debate, scrutiny and amendment before it can come into force.

The process usually follows these steps:

📄 The Scottish Government or an MSP proposes a new law (called a Bill)

🔍 MSPs examine the proposal and gather evidence

💬 The Bill is debated and can be amended

🗳️ MSPs vote on the final version

👑 After MSPs approve the Bill, it is formally approved by the King (known as Royal Assent) and becomes an Act of the Scottish Parliament.

This process helps ensure that new laws are carefully considered before they take effect.

The Scottish Parliament can make laws in areas that are devolved to Scotland, including health, education, housing, transport and justice.

Understanding how laws are made helps us understand how decisions affecting everyday life are developed, debated and approved.

𝗪𝗵𝗮𝘁'𝘀 𝘁𝗵𝗲 𝗗𝗶𝗳𝗳𝗲𝗿𝗲𝗻𝗰𝗲 𝗕𝗲𝘁𝘄𝗲𝗲𝗻 𝘁𝗵𝗲 𝗦𝗰𝗼𝘁𝘁𝗶𝘀𝗵 𝗣𝗮𝗿𝗹𝗶𝗮𝗺𝗲𝗻𝘁 𝗮𝗻𝗱 𝘁𝗵𝗲 𝗦𝗰𝗼𝘁𝘁𝗶𝘀𝗵 𝗚𝗼𝘃𝗲𝗿𝗻𝗺𝗲𝗻𝘁?

Many people use the terms Scottish Parliament and Scottish Government as if they mean the same thing, but they are different.

𝗧𝗵𝗲 𝗦𝗰𝗼𝘁𝘁𝗶𝘀𝗵 𝗣𝗮𝗿𝗹𝗶𝗮𝗺𝗲𝗻𝘁 𝗶𝘀 𝗺𝗮𝗱𝗲 𝘂𝗽 𝗼𝗳 𝗮𝗹𝗹 𝟭𝟮𝟵 𝗠𝗦𝗣𝘀 selected from all across Scotland. These MSPs come from all political parties and represent a wide range of views. Their job is to debate issues, examine proposals, vote on laws and hold the Government to account.

𝗧𝗵𝗲 𝗦𝗰𝗼𝘁𝘁𝗶𝘀𝗵 𝗚𝗼𝘃𝗲𝗿𝗻𝗺𝗲𝗻𝘁 𝗶𝘀 𝗮 𝘀𝗺𝗮𝗹𝗹𝗲𝗿 𝗴𝗿𝗼𝘂𝗽 𝗼𝗳 𝗠𝗦𝗣𝘀, called ministers, chosen by the First Minister to manage devolved areas such as health, education, transport and finance, and to put policies into practice. Ministers are given responsibility for specific areas and can be appointed or replaced by the First Minister.

The First Minister and Government ministers are members of the SNP because the SNP had the most votes in the Scottish election.

A simple way to think about it is:

⚙️ 𝗧𝗵𝗲 𝗚𝗼𝘃𝗲𝗿𝗻𝗺𝗲𝗻𝘁 𝗶𝘀 𝘁𝗵𝗲 𝘁𝗲𝗮𝗺 𝗼𝗳 𝗺𝗶𝗻𝗶𝘀𝘁𝗲𝗿𝘀 chosen by the First Minister to run services and deliver policy.

Both are based at Holyrood in Edinburgh.

Many people are surprised to learn that Scotland has its own legal system, separate from the legal system used in England and Wales.

You may have heard politicians talk about a "Section 30 Order" when discussing Scottish independence.

But what does it actually mean?

A Section 30 Order is an 𝗮𝗴𝗿𝗲𝗲𝗺𝗲𝗻𝘁 𝗯𝗲𝘁𝘄𝗲𝗲𝗻 𝗪𝗲𝘀𝘁𝗺𝗶𝗻𝘀𝘁𝗲𝗿 𝗮𝗻𝗱 𝗛𝗼𝗹𝘆𝗿𝗼𝗼𝗱.

A Section 30 Order takes its name from 𝗦𝗲𝗰𝘁𝗶𝗼𝗻 𝟯𝟬 𝗼𝗳 𝘁𝗵𝗲 𝗦𝗰𝗼𝘁𝗹𝗮𝗻𝗱 𝗔𝗰𝘁 𝟭𝟵𝟵𝟴, the law that established the Scottish Parliament.

It allows the Scottish Parliament to temporarily gain powers that it does not normally have.

𝘼 𝙎𝙚𝙘𝙩𝙞𝙤𝙣 30 𝙊𝙧𝙙𝙚𝙧 𝙧𝙚𝙦𝙪𝙞𝙧𝙚𝙨 𝙖𝙜𝙧𝙚𝙚𝙢𝙚𝙣𝙩 𝙗𝙚𝙩𝙬𝙚𝙚𝙣 𝙗𝙤𝙩𝙝 𝙒𝙚𝙨𝙩𝙢𝙞𝙣𝙨𝙩𝙚𝙧 𝙖𝙣𝙙 𝙃𝙤𝙡𝙮𝙧𝙤𝙤𝙙. 𝙉𝙚𝙞𝙩𝙝𝙚𝙧 𝙋𝙖𝙧𝙡𝙞𝙖𝙢𝙚𝙣𝙩 𝙘𝙖𝙣 𝙘𝙧𝙚𝙖𝙩𝙚 𝙤𝙣𝙚 𝙤𝙣 𝙞𝙩𝙨 𝙤𝙬𝙣.

In 2012, a Section 30 Order was agreed between Westminster and Holyrood, allowing the Scottish Parliament to hold the 2014 independence referendum.

The Union between Scotland and the rest of the UK is normally a matter decided by Westminster.

Because of this, supporters of another independence referendum often argue that a new Section 30 Order would be needed before one could take place.

How Are MSPs Elected?

When you vote in a Scottish Parliament election, you receive 𝘁𝘄𝗼 𝗯𝗮𝗹𝗹𝗼𝘁 𝗽𝗮𝗽𝗲𝗿𝘀.

𝙒𝙝𝙮?

𝗧𝗵𝗲 𝗳𝗶𝗿𝘀𝘁 𝘃𝗼𝘁𝗲 is used to choose a local MSP for your area, called a constituency.

𝗧𝗵𝗲 𝘀𝗲𝗰𝗼𝗻𝗱 𝘃𝗼𝘁𝗲 helps decide how many MSPs each party has in the Scottish Parliament.

This means voters have a say both in who represents their local area and in how many MSPs each party has in the Scottish Parliament.

The Scottish Parliament uses this two-vote system to give voters a say both locally and nationally.

Many people have heard the word 𝗱𝗲𝘃𝗼𝗹𝘂𝘁𝗶𝗼𝗻. But what does it actually mean?

You will often hear these places used as shorthand in political discussions. "𝗪𝗲𝘀𝘁𝗺𝗶𝗻𝘀𝘁𝗲𝗿" usually refers to the UK Parliament and UK Government, while "𝗛𝗼𝗹𝘆𝗿𝗼𝗼𝗱" refers to the Scottish Parliament and Scottish Government.

Before devolution, decisions about Scotland were made almost entirely by the UK Parliament at Westminster. Following a referendum in 1997, people in Scotland voted in favour of creating a Scottish Parliament.

The Scottish Parliament opened in 1999 and was given responsibility for areas such as health, education, housing and transport.

While many powers were transferred from Westminster to Holyrood, some remained at Westminster.

This means that decisions on devolved matters are made at Holyrood, while decisions on reserved matters are made at Westminster.

Some matters remain the responsibility of the UK Parliament and UK Government at Westminster, including defence, immigration, foreign affairs and currency.
Devolution allows decisions on many day-to-day issues affecting Scotland to be made in Scotland.

It does 𝗻𝗼𝘁 make Scotland independent.

Instead, it creates a system where powers are shared between Holyrood and Westminster.

Understanding devolution helps explain why some political decisions are made by the Scottish Parliament and Scottish Government at Holyrood, while others are made by the UK Parliament and UK Government at Westminster.
