In a notable divorce hearing, the Supreme Court of India declined to immediately grant divorce to a couple despite 16 years of separation, highlighting concerns over financial support and reconciliation.
During the proceedings, the husband 54 years old and earning around ₹65,000 per month argued that the long separation and ongoing “temperamental issues” made the marriage unworkable.
He also pointed out that he has been paying ₹15,000 monthly maintenance.
However, the wife’s counsel stated she is still willing to live with him.
The court responded by questioning the adequacy of the maintenance amount, observing that ₹15,000 is “hardly anything” in present times, and asked about permanent alimony.
When the husband expressed financial constraints and lack of pension, the court advised him to continue paying the existing maintenance and encouraged a peaceful resolution instead of dissolving the marriage immediately.
The case reflects the judiciary’s cautious approach in matrimonial disputes, often prioritizing reconciliation and financial security over instant dissolution.
