In Pradeep Kumar Kesarwani v. The State of Uttar Pradesh & Anr.

The Supreme Court has said that when someone asks the High Court to quash a criminal case under Section 482 CrPC, the judge must check four things before deciding:

1. Is the evidence given by the accused very strong and unquestionable?

2. Does that evidence clearly prove that the allegations are false?

3. Can the prosecution reasonably challenge that evidence or not?

4. Will continuing the trial be a misuse of the court process and unfair?
