Even though the PM is the ex-officio chairman of the trust, and three cabinet ministers are its trustees, PM CARES is not public Authority. Is it then, pvt Organisation?

Also various ministries and government departments had issued circulars to its employees to contribute one day’s salary to the Fund

The PMO has rejected an RTI application seeking details of the PM CARES Fund, stating that the fund is not a public authority under the Act.

Whether the concept of independence of judiciary requires and demands the prohibition of furnishing of the information sought? Whether the information sought for amounts to interference in the functioning of the judiciary? Whether the information sought for cannot be furnished to avoid any erosion in the credibility of the decisions and to ensure a free and frank expression of honest opinion by all the constitutional functionaries, which is essential for effective consultation and for taking the right decision? Whether the information sought for is exempt under Section 8(i)(j) of the Right to Information Act?

Cases pertaining to Land Acquisition Matters, Immunity of Legislators, have also been listed for hearing before the Constitution Bench from March 27th.

CIC will function with only three commissioners – as opposed to a sanctioned strength of 11, including the chief. The present crisis has arisen because the Narendra Modi government has since 2016 failed to fill any vacancies in the body – probably because the commission has been at the forefront of issuing orders inconvenient to the ruling BJP.

No new appointments have been made to the Central Information Commission since 2016.
