DRI seizes more than 300 kg of co***ne valued at approx. Rs. 2,000 crore in international market at Tuticorin Port

Based on specific intelligence that co***ne will be concealed in a consignment imported in container reaching V O C Port, Tuticorin, the officers of Directorate of Revenue Intelligence (DRI) have intercepted the container declared to be containing wooden logs. The suspected container has originated from Panama, transited through the ports of Antwerp and Colombo.
On examination the suspected container was found to contain 9 bags concealed between the rows of wooden logs. On opening the said bags 302 white coloured compressed bricks wrapped in multiple layers of packing material were found. The contraband weighed 303 kg and it is highly suspected to be co***ne. The contraband along with cover goods i.e. wooden logs are seized under the provisions of the NDPS Act, 1985.
Further investigation about the origin of the consignment and concealment of narcotic drugs is being carried out.

DRI seizes more than 300 kg of co***ne valued at approx. Rs. 2,000 crore in international market at Tuticorin Port

Based on specific intelligence that co***ne will be concealed in a consignment imported in container reaching V O C Port, Tuticorin, the officers of Directorate of Revenue Intelligence (DRI) have intercepted the container declared to be containing wooden logs. The suspected container has originated from Panama, transited through the ports of Antwerp and Colombo.
On examination the suspected container was found to contain 9 bags concealed between the rows of wooden logs. On opening the said bags 302 white coloured compressed bricks wrapped in multiple layers of packing material were found. The contraband weighed 303 kg and it is highly suspected to be co***ne. The contraband along with cover goods i.e. wooden logs are seized under the provisions of the NDPS Act, 1985.
Further investigation about the origin of the consignment and concealment of narcotic drugs is being carried out.

CGST East Delhi Commissionerate arrests two for defrauding Government Exchequer of more than Rs 392 crore

In their continuous endeavour to uproot fake billing operations, officers of Central Goods and Services Tax (CGST) Commissionerate, Delhi (East) achieved yet another success when investigations led to unearthing of a massive network of fictitious firms to generate and avail fake Input Tax Credit (ITC) of Goods and Services Tax (GST). The network of fictitious companies was being operated by one Shri Naresh Dhoundiyal in connivance with one Shri Devender Kumar Goyal, who is a Charted Accountant by profession. Both Shri Naresh Dhoundiyal and Shri Devender Kumar Goyal are former employees of Essel Group. Though they are presently not working with the Essel group officially, however, they are passing on inadmissible ITC to the said group. Investigations indicate that a layer of genuine looking fictitious intermediatory companies was created to pass on bogus ITC from non-existent and fake firms to the companies of Essel Group without actual supply of any goods or services. This was apparently done to enable Essel Group to avail inadmissible Input Tax Credit of GST, book expenses to evade Income Tax and inflate their turnover to push the share prices of their listed companies.
Shri Naresh Dhoundiyal incorporated multiple fictitious intermediatory companies for Essel Group whereas, Shri Devender Kumar Goyal, CA arranged the fake invoices of various other fictitious and non-existent firms for such fictitious intermediatory companies. The total fake Input Tax Credit passed on by such fictitious intermediatory companies is quantified to be Rs. 92.18 crore whereas, the total fake Input Tax Credit passed on by other fictitious and non-existent firms pertaining to the larger network is quantified to be more than Rs. 300 crore.

The Government of India has notified the appointment of two new Special Secretary & Member of the Central Board of Indirect Taxes and Customs (CBIC).

The Appointments Committee of the Cabinet has approved the appointment of the 2 officers as Members of CBIC. The Government appointed Senior IRS Officer Shri Om Prakash Dadhich, Principal Director General, GST Intelligence (DGGI) Headquarters, New Delhi as a Member of CBIC against the vacancy date of June 1, 2020.

The other member appointed was Sandeep Kumar, IRS (C&CE:1987), Principal Director General, Directorate General of Systems & Data Management, New Delhi against the vacancy date of August 1, 2020

Central GST Officials arrest one after busting network of 46 fake firms involved in fake input tax credit of Rs 82.23 crore

New Delhi : In the ongoing drive against fake billing operations, the officers of Central Goods and Services Tax (#CGST) Commissionerate, Delhi East, have unearthed a multi-layered network of fictitious firms being used by their operators to generate and pass on fake ITC.
Through the use of extensive data analytics, officers of Delhi East GST were able to identify and unravel a network of 46 fake firms which were operating since 2017 and had passed on fake ITC to multiple of beneficiaries. The investigation conducted revealed that the fictitious firms were being controlled by Shri Arvind Kumar and his associates. He was arrested on 17.01.2021 and is in judicial custody till date. The key associate of Shri Arvind Kumar, one Shri K**al Singh (alias “K**al Solanki”), had been absconding for the past one month. However, through persistent efforts the officers could finally apprehend Shri K**al Singh who has confessed to have been involved in the racket of fake billing through which fake invoices of Rs. 541.13 crore were raised involving fake ITC of Rs. 82.23 crore, which is expected to increase as the investigation progresses.
Shri K**al Singh was arrested under Section 69(1) of the CGST Act, 2017 and produced before the Duty Magistrate on 09.02.2021, who remanded him to judicial custody of 14 days till 23.02.2021. This is the second arrest made in the investigation.
It is pertinent to mention here that since the inception of GST Central Tax, Delhi Zone has made 21 arrests in various cases involving GST evasion amounting to more than Rs. 3791.65 crore.

Ahmedabad : Fake GST invoices racket worth over Rs 2,400 cr busted in Ahmedabad.

The total value of the fake invoices issued by the six firms was Rs 2,435.96 crore, which resulted in fraudulent transfer of input tax credit of Rs 72.25 crore, the statement added.

At a time when the government is already struggling with low revenue collection due to the Covid-19 pandemic, cases of fake GST invoices fraud are making a further dent in the government’s pocket and its ability to spend.

The Anti Evasion 'Preventive Wing' of Central GST Department (CGST) Wednesday said it has arrested a New Ranip-resident Bharat Bhagwandas Soni for allegedly operating a racket of issuing fake GST invoices worth Rs 2,435.96 crore.

“Investigation revealed that Soni had hatched a well-orchestrated conspiracy with many other similar fraudsters to enable various bullion dealers in the city to fraudulently show purchase of gold, silver and diamond products and avail bogus input tax credit in such purchase invoices.

As a part of this conspiracy, Soni floated six different trading firms in his name and in names of his son, daughters, sons-in-law, etc, and obtained GST registrations. He also operated bank accounts, opened in the names of fictitious entities, by using chequebooks signed in advance by the respective family members and kept by him,” a statement issued by the office of the Commissioner CGST and Central Excise department, Ahmedabad-North, stated Wednesday.

The total value of the fake invoices issued by the six firms was Rs 2,435.96 crore, which resulted in fraudulent transfer of input tax credit of Rs 72.25 crore, the statement added.

Input tax credit is usually claimed by a manufacturer, supplier, agent, e-commerce entity , etc who are registered under GST while paying tax on the final product or output. At the time of paying this tax on output, one can reduce the tax already paid on input and pay only the balance amount.

Rs 831.72 Crore Duty evasion at Guthka unit, Central GST Delhi West Commissionerate arrests 1 person

New Delhi : Delhi West Commissionerate of Central Goods and Services Tax (CGST) arrested one person on Sunday for duty evasion of around Rs 831.72 crore from a manufacturing unit that was illegally producing Guthka, pan masala, to***co products.

"The Central GST Delhi West Commissionerate has unearthed evasion of GST by way of manufacture and clandestine supply of gutkha/pan masala/to***co products without any registration and payment of duty.

On basis of the search at the premise of manufacture, it was found that illegal manufacturing of Gutkha/pan masala/to***co product was going on, evidenced by a godown, machines, raw materials and manufactured products at the premises," read a press statement from the Union Ministry of Finance.

According to reports, the finished product of gutkha produced illegally at the unit is being supplied to various states in the country and around 65 labourers were found working at the illegal factory.

Finished gutkha and raw materials such as chuna, sada kattha, to***co leaves, etc, were seized after the searches. The seized materials are valued at Rs. 4.14 crore approximately.

"One person has been arrested in the matter on the basis of his involvement in the manufacture and supply of goods without issue of any invoice with the intention to evade tax, as well as in transporting, removing, depositing, keeping, concealing, supplying, or purchasing any goods in violation of the provisions of Section 132(1)(a) and (h) of CGST Act, 2017, which are cognizable and non-bailable under Section 132(5) being punishable under Section 132(1)(i) of the said Act," the statement read.

The accused person has been arrested and sent to 14 days judicial custody after being produced before the Metropolitan Magistrate (MM), Patiala House Court on January 2, 2021.

CGST East Delhi Commissionerate arrests two for defrauding Government Exchequer of more than Rs 392 crore In their continuous endeavour to uproot fake billing operations, officers of Central Goods and Services Tax (CGST) Commissionerate, Delhi (East) achieved yet another success when investigations led to unearthing of a massive network of fictitious firms to generate and avail fake Input Tax Credit (ITC) of Goods and Services Tax (GST). The network of fictitious companies was being operated by one Shri Naresh Dhoundiyal in connivance with one Shri Devender Kumar Goyal, who is a Charted Accountant by profession. Both Shri Naresh Dhoundiyal and Shri Devender Kumar Goyal are former employees of Essel Group. Though they are presently not working with the Essel group officially, however, they are passing on inadmissible ITC to the said group. Investigations indicate that a layer of genuine looking fictitious intermediatory companies was created to pass on bogus ITC from non-existent and fake firms to the companies of Essel Group without actual supply of any goods or services. This was apparently done to enable Essel Group to avail inadmissible Input Tax Credit of GST, book expenses to evade Income Tax and inflate their turnover to push the share prices of their listed companies. Shri Naresh Dhoundiyal incorporated multiple fictitious intermediatory companies for Essel Group whereas, Shri Devender Kumar Goyal, CA arranged the fake invoices of various other fictitious and non-existent firms for such fictitious intermediatory companies. The total fake Input Tax Credit passed on by such fictitious intermediatory companies is quantified to be Rs. 92.18 crore whereas, the total fake Input Tax Credit passed on by other fictitious and non-existent firms pertaining to the larger network is quantified to be more than Rs. 300 crore.
