DEMAND FOR A FAIR AND IMPARTIAL INVESTIGATION INTO THE ALLEGED ASSAULT OF A TOURIST TAXI DRIVER IN SIKKIM

The Social Justice for International Civil Rights Council (SJFICRC) expresses its deep concern regarding reports circulating on social media and various public platforms about the alleged assault of a tourist taxi driver by military personnel in the Halji area of Sikkim.

As an organization committed to the protection of human rights, civil liberties, and the rule of law, SJFICRC believes that every individual, regardless of profession, status, or background, deserves to be treated with dignity and respect. Any allegation involving the use of excessive force against a civilian must be thoroughly, transparently, and impartially investigated by the competent authorities.

At this stage, we are not making any conclusions regarding the incident, as all facts have yet to be officially established. However, the seriousness of the allegations warrants an independent inquiry to ascertain the truth and ensure accountability where necessary.

We respectfully call upon the concerned authorities to:

Conduct a prompt, fair, and impartial investigation into the incident.
Ensure that the rights of the alleged victim are protected throughout the process.
Maintain transparency by informing the public of the findings of the investigation.
Take appropriate legal and disciplinary action if any misconduct is found.
Ensure that similar incidents are prevented in the future through adherence to human rights principles and established legal procedures.

Supreme Court Ends Marriage After 23 Years of Separation, Says Courts Cannot Force a Husband-Wife Relationship
New Delhi: In a significant judgment emphasizing individual dignity and personal freedom, the Supreme Court of India dissolved a marriage that had effectively ceased to exist for more than 23 years. The Court observed that a husband cannot be treated as a prisoner in a dead marriage and that no court can compel two individuals to continue a marital relationship that has completely broken down.
The case involved a couple who had been living separately for over two decades. Despite their long separation and the absence of any meaningful marital relationship, the legal dispute continued for years, leaving the marriage alive only on paper.
While hearing the matter, the Supreme Court noted that the relationship between the husband and wife had reached a stage where there was no possibility of reconciliation. The bench emphasized that marriage is based on mutual companionship, trust, and willingness to live together. When those essential elements no longer exist, forcing the parties to remain legally bound serves no meaningful purpose.
The Court further observed that the law should not become an instrument of suffering for individuals trapped in irretrievably broken marriages. It stated that continuing such a marriage against the wishes of the parties would only prolong emotional distress and deny them the opportunity to rebuild their lives.
Invoking its constitutional powers, the Supreme Court dissolved the marriage, bringing an end to a legal battle that had lasted for years. The judgment underlined that personal liberty, dignity, and the right to live peacefully are fundamental rights that cannot be ignored merely to preserve a marriage that exists only in legal records.
Legal experts have described the ruling as an important step toward recognizing the realities of modern relationships and the need for compassionate solutions in matrimonial disputes. The judgment also highlights that both men and women deserve the opportunity to move forward with their lives when a marriage has irretrievably failed.
The ruling serves as a reminder that marriage is a partnership built on mutual consent and respect. When a relationship has completely collapsed and there is no hope of restoration, the law should facilitate closure rather than prolong hardship.
The Supreme Court's decision has been widely discussed as a landmark affirmation that a failed marriage should not become a lifelong punishment and that every individual deserves the chance to live with dignity, peace, and freedom.
