High Court Upholds Supreme Court Precedents on Withdrawal of Benefits from False Caste Claims

The Bombay High Court at its Nagpur Bench has dismissed a writ petition challenging the invalidation of a caste certificate that was used to secure educational and employment benefits. The judgment, delivered by Justices Nitin W. Sambre and Abhay J. Mantri, underscores the imperative to withdraw benefits secured through invalid caste certificates, aligning with the Supreme Court’s judgments, notably in Jagdish Bahira & Others v. State of Maharashtra. july 2024

The Central Government has issued a notification to the effect that any reference of the Indian Penal Code, 1860, Code of Criminal Procedure, 1973, and the Indian Evidence Act, 1872, in any existing statute, rule, regulation, order or notification will be read as a reference to their replacements the Bharatiya Nyaya Sanhita (BNS), Bharatiya Nagarik Suraksha Sanhita (BNSS) and the Bharatiya Sakshya Adhiniyam (BSA) respectively.

The notification was issued by the Ministry of Law and Justice in exercise of the powers under Section 8 of the General Clauses Act 1897. As per Section 8 of the General Clauses Act, references to repealed provisions will be construed as references to the re-enacted provisions.

The new criminal laws - BNS, BNSS and BSA - repealed and replaced the IPC, CrPC and the Evidence Act with effect from July 1, 2024.

The Supreme Court observed that the lethargy or the carelessness on the part of the State Government in not getting the revenue records corrected would not take away the rights conferred on the State under a deed.

The Court said that once the property is transferred to the State by way of a valid gift deed, then the property would be deemed to be owned by the State. The mere appearance of the transferor's legal heirs' name in the revenue records would not confer any title on them, the court held.

"merely because the name of the plaintiff continued in the revenue records (Jama Bandis), it would not confer any title upon him. Revenue records (Jama Bandis) are only entries for the purpose of realising tax by the Municipal Corporations or land revenue by Gram Sabhas....The lethargy/carelessness on the part of the State in not getting the revenue records corrected on the basis of the gift deed would not take away the rights conferred on the State under the gift deed," the Court observed

स्तर पर एक मजबूत लीडरशिप का अभाव है। जरूरत है केंद्रीय वा पर्देशिक पर अनुसूचित जाति/जनजाति के समूह नेतृत्व को एक होकर अनुसूचित जाति जनजाति वर्ग के कल्याण के लिए कार्य करने की वा एक होकर आवाज उठाने की। अनुसूचित जाति/जनजाति वर्ग की भी ये जिम्मेदारी बनती है की अपनी लीडरशिप का साथ दे कर उन्हे राजनीतिक तौर पर मजबूती प्रदान करें वा अपने राजनीतिक अधिकारों के लिए डट कर संघर्ष करें।
