(Operators & Drivers – As per BOCW Act & Maharashtra Rules)

1. Mandatory Medical Fitness before Deployment

Legal Reference
- Section 38 – Safety measures
- Section 45 – Employment of trained & fit persons
- Maharashtra BOCW Rules – Rule 45

BOCW Requirement
- Employer shall ensure that only medically fit workers are deployed on hazardous operations.
- Operators and drivers handling machinery must be physically and medically capable.

2. Vision Test Requirement

Legal Reference
- Section 38
- Rule 45 (Fitness for hazardous work)

Legal Requirement
Workers engaged in:
- Crane operation
- Vehicle driving
- Lifting & hoisting operations must have adequate vision to ensure safe operation.

BOCW does not specify Titmus test by name; however, it mandates visual fitness → Titmus/orthorator tests are acceptable recognized medical tools.

3. Night Vision & Depth Perception

Justification
- Poor night vision or depth perception increases accident risk during:
- Night work
- Blind lifting
- Reversing & slewing operations

Client requirement strengthens statutory intent.

4. Peripheral Vision

Requirement
Operators must be able to detect:
- Moving objects
- Pedestrians
- Adjacent equipment

Ensures compliance with “safe system of work”.

5. Glare Resistance & Recovery

Justification
Construction sites have:
- High glare from concrete, metal, floodlights
- Sudden light variation

Glare recovery reduces collision and lifting incidents.

6. Breathing / Pulmonary Function Test

Legal Requirement
Workers exposed to:
- Dust
- Exhaust fumes
- Diesel equipment
must be medically assessed for respiratory fitness.

Peak Flow Meter test is an accepted medical screening tool.

7. Separate Medical Reports

Requirement
Employer shall maintain:
- Medical fitness records
- Examination reports
- Fitness certificates

Reports must be produced during inspection.

8. Periodic Medical Examination

TOWER CRANE – SAFETY & COMPLIANCE REQUIREMENTS
As per BOCW Act, 1996 & Maharashtra BOCW Rules

1. Inspection of Tower Crane Older Than 5 Years (Pre-Mobilization)

Maharashtra BOCW Rules
- Rule 40 & 41

BOCW Requirement
All lifting appliances shall be:
- Of sound construction
- Properly maintained
- Thoroughly examined by a competent person

Legal Note:
The Act does not prescribe an age limit; however, it mandates thorough examination.
Requiring full inspection for equipment older than 5 years is a risk-based control and strengthens statutory compliance.

2. Third-Party / Competent Person Inspection & Certification

- Rule 40(1)

Mandatory Requirement
Before first use at site, the following shall be ensured:
- Valid third-party / competent person test certificate
- Load test certificate
- Structural integrity assessment
- Functional safety verification

Applicability:
- Tower crane

- Material hoist

Older equipment = higher risk → detailed inspection legally justified.

3. Tower Crane Operator – License & Experience

Maharashtra BOCW Rules

Legal Requirement:
Tower crane shall be operated only by:
- Trained
- Experienced
- Authorized operator
- Valid license / competency certificate mandatory

Client requirement of minimum 2 years’ experience is aligned with Rule 45 and strengthens safety assurance.

4. Mandatory Signalman Deployment (Minimum Two)

BOCW Requirement:
Safe lifting operations require:
- Clear communication
- Trained signalman
- Continuous visual / radio control

Minimum two signalmen required to manage:

5. Signalman Training, Competency & Authorization

P&M – Deployment of Full-Time Plant & Machinery (P&M) Supervisor / Foreman
As per BOCW Act, 1996 & Maharashtra BOCW Rules

1. Mandatory Deployment of Full-Time P&M Supervisor / Foreman

Legal Reference:
- Section 12 – Duties of Contractor
- Section 38 – Safety & health measures
- Section 44 – Responsibility of Employer

Maharashtra BOCW Rules – Rule 38, 40, 41, 45

Statutory Requirement:
- The contractor shall ensure continuous and competent supervision of all construction plant and machinery.
- Employer is legally responsible to ensure that machinery is operated safely and under competent control.

Deployment of a full-time P&M Supervisor is a statutory compliance mechanism.

2. Legal Justification for P&M Supervisor (Compliance Logic)

Legal Interpretation:
Although the Act does not expressly use the term “P&M Supervisor”, it mandates that:
- Construction machinery shall be properly maintained
- Machinery shall be operated only under competent supervision
- Unsafe machinery shall not be allowed to operate

BOCW Compliance Mapping:
Appointment of a full-time P&M Supervisor ensures compliance with:
- Section 38 – Safety measures
- Rule 38 – Construction equipment safety
- Rule 45 – Employment of trained persons

Hence, P&M Supervisor = legally required “competent supervisory control.”

- Adequate access, egress and visibility
- Prevention of unauthorized use
- Immediate stoppage of unsafe equipment

Maharashtra BOCW Rule 38 – Construction Equipment Safety
- Equipment inspected before use
- Defects immediately rectified
- Unsafe machinery withdrawn from service
- Compliance with manufacturer’s safety guidelines

P&M Supervisor is the designated authority for equipment safety at site.

4. Operator Competency & Authorization Control

Maharashtra BOCW Rule 45 – Employment of trained persons

Statutory Requirement:
- Only trained, certified and authorized operators shall operate machinery.
- Valid license / competency records shall be maintained.

7. Accountability in Case of Accident or Equipment Failure
