The Human Rights activist Harsh Mander on the state of India. A 14 year old boy in Navi Mumbai Maharashtra was arrested allegedly because someone heard him supporting the Pakistan Cricket team and his parents’ scrap shop was bulldozed (in spite of Supreme Court rulings to stop this illegal practice).

This is the state of law and order in the country, run by bigotry and arbitrary Executive action.

Now an act that is included as a fundamental right under Article 25 of the Indian Constitution is being sought to be punished by life imprisonment. First of all, it shouldn’t even be the Government’s business why someone is converting to some other religion; then to punish it like murder is medieval and regressive.

While the proposed law refers to things like assault, use of force, promise of marriage etc it is rife for misuse since anyone can file a complaint.

Also to be noted: women are lumped together with minors and mentally challenged persons. India has chosen to go the way of Pakistan. What else can one say?

Article 25 (emphasis added):

“Subject to public order, morality and health and to the other provisions of this Part, all persons are equally entitled to freedom of conscience and the right freely to profess, practise AND PROPAGATE religion”.

Saying that the existing provisions under the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021, are “not sufficient”, the government sought to make its anti-conversion law more stringent.

The continued incarceration of Umar Khalid, who has spent 1400 days in prison for peacefully protesting against an unjust, disciminatory law is a blot on our judicial system. His bail plea was refused or postponed 14 times by the SC.

To quote from the article-

“In October 2022, a former Supreme Court judge, three retired high court judges and a former Union home secretary examined the UAPA case against Umar Khalid and observed that they could not find any substantiating evidence to warrant the imposition of terrorism charges.

Exactly two months before Umar completed 1,400 days in jail without bail, a Bangalore court had granted bail to JDS MLA HD Revanna, accused in the Karnataka serial sexual assault case, on a bond of Rs 5 lakh.”

Homes of Muslims have been broken in MP; there have been lynchings in Chattisgarh and Aligarh; the description of how blacks were treated in the US, by American Professor of Philosophy, Cornel West - “unsafe, unprotected, subject to random violence, and (facing) hatred for who they are” appears equally applicable to Minorities in Modi-fied India.

Everyone who has voted for the BJP has voted for this environment of hatred and fear; we received a liberal democratic country where it was the norm to say “हिंदू मुस्लिम सिख ईसाई, आपस में हैं भाई भाई”. You will bequeath a saffron Pakistan to your children, where people will be beating each other to death over the meat they eat. Congratulations!

This is an interesting investigation by the Indian Express- out of the 25 politicians who were under investigation by the law enforcement agencies like ED, CBI, IT etc and who crossed over to the BJP, 23 have got relief. This establishes clear quid pro quo; while some cases have been quietly buried, in many cases, the courts have actually granted relief, probably because the prosecution abandoned all interest once the defendant joined the Sangh Parivaar. Very disconcerting, both for democracy and the rule of law.
