*PETITION FOR INTERNATIONAL LEGAL SCRUTINY*
This representation is respectfully submitted before the International Court of Justice, seeking attention to a matter of grave international maritime concern involving the reported destruction of the Iranian naval warship IRIS Dena in the Indian Ocean region near Sri Lanka.
This complaint is submitted in the interest of:
Protection of international maritime law
Preservation of naval diplomacy
Accountability in the use of military force
Protection of human life at sea
I. IDENTITY AND STANDING OF THE PETITIONER
The Petitioner Sureddy Siva Kumar, Advocate from the Republic of India and a Veteran of the Indian Navy, submits this representation as:
• A legal professional concerned with international legality
• A former naval serviceman with maritime operational knowledge
• A public-interest petitioner seeking protection of international maritime norms
The petition is submitted in the larger interest of global maritime peace and rule-based international order.
II. NATURE OF THE INCIDENT
According to circulating maritime reports and naval commentary:
The Iranian naval warship IRIS Dena, belonging to the Islamic Republic of Iran Navy, is alleged to have been struck by a torpedo fired from a United States submarine in waters of the Indian Ocean near Sri Lanka.
The alleged consequences include:
• Severe structural damage to the vessel
• Reported sinking or disabling of the warship
• Casualties among naval personnel
• Injured sailors reportedly transported to hospitals in Sri Lanka
• Emergency response reportedly coordinated by the Sri Lankan Navy
If verified through international investigation, such an event represents a matter of serious international legal concern.
III. DIPLOMATIC BACKGROUND OF THE VESSEL
Available maritime information indicates that the vessel:
• Participated in naval goodwill interactions in the Indian Ocean region.
• Visited Visakhapatnam during an international naval engagement in February 2026.
Such naval visits are recognized worldwide as confidence-building diplomatic practices intended to promote:
maritime cooperation
naval professionalism
peaceful engagement among nations.
The vessel reportedly departed Indian waters on 25 February 2026, proceeding westward through maritime routes passing near Sri Lanka.
IV. INTERNATIONAL LEGAL FRAMEWORK
1. Prohibition of Use of Force
Article 2(4) of the United Nations Charter prohibits the threat or use of force against the sovereignty of any state.
A naval warship is widely recognized under international law as a sovereign instrument of the state, and an attack against such a vessel may constitute a violation of this principle.
2. Sovereign Immunity of Warships
International maritime law recognizes warships as extensions of the sovereign territory of the flag state.
This principle is recognized in numerous international legal authorities and jurisprudence interpreting maritime sovereignty.
3. UNCLOS Maritime Framework
The United Nations Convention on the Law of the Sea (UNCLOS) establishes legal regimes governing:
• Territorial waters
• Exclusive Economic Zones (EEZ)
• Navigation rights in international waters
An armed military engagement in or near the maritime zones of another country raises important questions concerning:
sovereignty
neutrality
maritime safety
V. RELEVANT INTERNATIONAL COURT OF JUSTICE JURISPRUDENCE
Several decisions of the International Court of Justice have addressed unlawful use of force and state responsibility.
1. Corfu Channel Case
In this landmark judgment, the Court emphasized that states must ensure that their territories or waters are not used for acts contrary to the rights of other states, establishing principles of maritime responsibility and international accountability.
2. Military and Paramilitary Activities in and against Nicaragua
The Court affirmed that the use of force against another state without lawful justification violates international law, and such actions may give rise to international responsibility.
3. Oil Platforms Case
The Court examined the legality of attacks on maritime installations and reaffirmed the importance of strict legal scrutiny when force is used at sea.
These cases collectively establish that military action affecting sovereign assets at sea must meet strict legal standards and is subject to international judicial review.
VI. STRATEGIC MARITIME CONTEXT
Waters around Sri Lanka form part of one of the most important maritime trade corridors in the world.
The Six-Degree Channel south of Sri Lanka is a major route connecting:
Middle East
Europe
Southeast Asia
East Asia
Any military confrontation in this area may therefore impact:
• Global shipping security
• Maritime trade flows
• Energy supply routes
VII. GLOBAL ECONOMIC AND HUMANITARIAN CONSEQUENCES
History shows that attacks on naval vessels often trigger retaliatory actions between states.
Such escalation can produce:
• Military confrontation
• Disruption of global shipping routes
• Increased maritime insurance costs
• Instability in international energy markets
• Economic consequences affecting multiple nations
Retaliatory cycles between states may ultimately cause:
large-scale human casualties
disruption of global commerce
widespread economic hardship affects millions of civilians worldwide.
Therefore, unexplained acts of force at sea carry serious consequences not only for the nations involved but for the global community as a whole.
VIII. HUMANITARIAN DIMENSION
Naval personnel aboard a warship represent human lives serving their nations.
If a warship is destroyed:
• Navy Sailors lose their lives
• Families suffer irreversible loss
• The humanitarian consequences extend far beyond the battlefield
Protection of human life at sea is therefore a fundamental moral and legal responsibility of the international community.
IX. PRAYER FOR INTERNATIONAL ACTION
In light of the above circumstances, the petitioner respectfully calls for:
1. An independent international investigation into the reported USA torpedo attack on IRIS Dena.
2. Determination of the exact location, circumstances, and responsible actors involved in the incident.
3. Assessment of casualties, humanitarian impact, and maritime safety implications.
4. Clarification regarding whether the alleged attack involved unauthorized use of force under international law.
5. Reinforcement of the principle that military power must remain subject to international legal accountability.
6. it is respectfully requested that if the investigation establishes responsibility for the reported attack, the competent international legal authorities may direct that the responsible party fully compensate and pay all damages to the affected state, the victims, and any third-party countries whose economic or maritime interests were adversely impacted. It is further prayed that appropriate legal action be taken in accordance with international law and the principles of international justice, without bias or political influence, so that accountability is ensured. This request is made in the spirit of the universally recognized principle that “Justice must not only be done, but must also be seen to be done.”
X. APPEAL TO INTERNATIONAL LEGAL CONSCIENCE
The oceans are shared spaces of humanity and must remain governed by:
International law
Diplomatic restraint
Maritime cooperation
Preservation of peaceful navigation and maritime stability is essential for global economic security and international peace.
DECLARATION
I, Sureddy Siva Kumar, Advocate and Indian Navy Veteran, respectfully submit this representation seeking international attention in the interest of:
International legality
Maritime peace
Humanitarian protection.
