Cabinet Secretary Hassan Ali Joho Orders Immediate Suspension of Tata Chemicals Magadi Mining Operations
In a major regulatory crackdown within Kenya's mining sector, the Cabinet Secretary for Mining, Blue Economy and Maritime Affairs, Hon. Hassan Ali Joho, has ordered the immediate suspension of all mining operations conducted by Tata Chemicals Magadi Limited. The company will be barred from continuing its activities until it achieves full compliance with the Mining Act, its associated regulations, and all governing national laws.
The directive comes after years of ongoing discussions between the State Department for Mining and the firm regarding its statutory duties under the Mining Act (Cap. 306), the Mining (Licence and Permit) Regulations 2017, and the Mining (Royalty Collection and Management) Regulations 2024.
According to official communications, critical compliance failures remain unresolved despite extended engagements. The Ministry highlighted several key areas of non-compliance, including the absence of a clear mineral beneficiation and value-addition strategy, unresolved royalty reconciliations alongside unpaid obligations, and insufficient export reporting. Additionally, the company was cited for failing to properly implement Community Development Agreements (CDA), lacking adequate plans for citizen employment and skills transfer, demonstrating weak local procurement, and falling short on environmental standards.
To resume operations, Tata Chemicals Magadi Limited must submit comprehensive documentation and evidence proving full compliance with all statutory obligations, while also settling any outstanding liabilities. CS Joho emphasized that the Ministry stands firm in its commitment to responsible and sustainable mineral extraction, ensuring Kenya’s natural resources deliver maximum economic value while protecting local host communities and the environment.
