STATUTORY FUNCTIONS

13 (1) The Commission shall have all powers generally necessary for the ex*****on of its functions under the Constitution, this Act, and any other written law. (2) Without prejudice to the generality of subsection (1), the Commission shall have the power

Educate and create awareness on any matter within the Commissionโ€™s mandate;

Undertake preventive measures against unethical and corrupt practices;
Conduct investigations on its own initiative or on a complaint made by any person, and, Conduct mediation, conciliation and negotiation.

A former Revenue Officer at Nairobi City Water and Sewerage Company Limited has been convicted and sentenced to pay a fine of KES 5,049,597 or serve a five-year prison term after being found guilty of using forged academic credentials to secure employment and fraudulently earning public funds.

Mr. Okandah William John was convicted by the Milimani Anti-Corruption Court on multiple counts of forgery, uttering a false document, deceiving a principal, and fraudulent acquisition of public property.
Investigations conducted by the Ethics and Anti-Corruption Commission (EACC) established that Mr. Okandah secured employment at the public utility company using a forged Bachelor of Commerce (Accounting Option) degree purportedly issued by the University of Nairobi. As a result, he unlawfully received Kes4,749,597 in salary and benefits during his period of employment.

In a judgment delivered on 28 May 2026, the Court underscored the importance of integrity in public service, noting that honesty and adherence to ethical principles are essential in safeguarding public resources and promoting accountability.

The Court observed that integrity plays a critical role in reducing fraud, corruption, and legal disputes, thereby easing the burden on the justice system and enabling public institutions to function more effectively and efficiently.

On 3 June 2026, Hon. Celesa Okare sentenced the accused to pay a mandatory fine equivalent to the amount fraudulently acquired, Kes4,749,597, or serve two yearsโ€™ imprisonment in default. The Court further imposed fines of Kes100,000 for each of the remaining counts, with a default sentence of 12 monthsโ€™ imprisonment. The sentences are to run concurrently, bringing the total financial penalty to Kes5,049,597, or a five-year custodial sentence in default.

The conviction highlights EACCโ€™s continued commitment to protecting public resources, upholding integrity in public service, and ensuring accountability in recruitment and employment processes within public institutions.

The Ethics and Anti-Corruption Commission (EACC) has launched a week-long anti-corruption campaign in Kakamega County to empower citizens to take an active role in promoting integrity, accountability, and good governance.

The initiative, officially launched in Kakamega Town, will reach 57 shopping and market centres through public awareness caravans, and will also engage schools, county government officials, county assembly staff, and private sector stakeholders.

Speaking during the launch, EACC Western Regional Manager Eric Ngumbi emphasized that corruption deprives citizens of essential services such as healthcare, education, water, electricity, and infrastructure, while contributing to unemployment, poverty, and declining trust in public institutions.

Deputy County Commissioner Titus Murei urged young people to uphold ethical values and resist being used to fuel disorder and criminal activities, while County Secretary Dr. Lawrence Omuhaka welcomed the initiative as a key step toward strengthening accountability and citizen participation in governance.

Under the theme , the campaign seeks to equip citizens with knowledge to reject corruption, report corrupt practices, and champion leadership founded on integrity.

The Ethics and Anti-Corruption Commission (EACC) has arrested and arraigned a clerical officer attached to the Uasin Gishu Lands Office over allegations of soliciting and receiving a bribe to facilitate the subdivision of land.

The accused, Noah Kipkemboi Rotich, was presented before court today and charged with receiving a bribe contrary to the Bribery Act, 2016.

The case arose from a complaint received by the Commission alleging that Rotich had demanded a bribe to facilitate the subdivision process. Investigations established that he had solicited Kes100,000 from the complainant and received part of the bribe.

Following completion of investigations, EACC forwarded the case file to the Director of Public Prosecutions (DPP), who approved the prosecution.
The accused was granted a cash bail of Kes30,000 or, alternatively, a bond of Kes100,000.

EACC remains committed to combating corruption and promoting integrity in public service.

The Ethics and Anti-Corruption Commission has arrested Duke Simeon Onyari, Clerk of the Nyamira County Assembly, over alleged corruption and the loss of KES 30 million in the construction of the Nyamira County Assembly office block.

Investigations indicate that the alleged irregularities relate to the award of the construction tender to Jetta Builders Limited, against the procurement laws.

The Commission is pursuing other suspects believed to be linked to the case.

The Ethics and Anti-Corruption Commission (EACC) has recorded a major victory in the fight against corruption following the conviction and sentencing of 10 individuals and companies involved in a KES 51 million corruption and money-laundering scheme linked to the County Government of Kilifi.

In a sentencing ruling delivered by Hon. E.K. Usui of the Malindi Anti-Corruption Court, following convictions entered on 17 April 2026, the Court observed that the offences occasioned significant economic loss to Kilifi County and undermined development efforts intended to improve the welfare of residents. The Court further noted that the proceeds of crime were largely utilized for personal enrichment and had not been refunded.

The convicted persons and entities were found to have benefited from the illegal and fraudulent transfer of public funds between 19 September and 7 October 2016, during which officials of the County Government of Kilifi irregularly paid out KES 51,569,775 for services not rendered and goods not supplied to six private companies, namely:

Daima One Enterprises

Zohali Services Limited

Makegra Suppliers Limited

Kilingi Investments Limited

Leadership Edge Associates

Jahazi Investments Company Limited

While considering mitigation, the Court acknowledged that the convicts were first offenders, family breadwinners, and had endured lengthy trial proceedings and financial strain during the pendency of the case. However, the Court emphasized the growing prevalence of corruption and economic crimes in the country and underscored the need for deterrent sentences.

The Court imposed substantial fines, mandatory penalties equivalent to the benefits derived from the offences, and custodial sentences in default of payment. All sentences relating to each accused person are to run consecutively.

The sentences imposed are as follows:

(1)Sarah Wangui Kamau was sentenced to cumulative fines amounting to Ksh17,461,880, including mandatory penalties equivalent to benefits derived from the offences. In default of payment, she will serve a cumulative prison term of 5 years and 8 months.

(2)Mary Munyiva Kamau was sentenced to cumulative fines totaling Ksh26,026,356, including mandatory penalties equivalent to benefits derived from the offences. In default, she will serve 13 yearsโ€™ imprisonment.

(3)Makegra Supplies Limited, through its director Mary Munyiva Kamau, was fined a cumulative Ksh25,726,356, with a default custodial sentence of 10 years.

(4)Stephen Mutua Nguzi received cumulative fines totaling Ksh16,301,904. In default, he will serve 7 yearsโ€™ imprisonment.

(5)Kilingi Investment Company Limited through its director Stephen Mutua Nguzi, was fined Ksh15,901,904, with a default custodial sentence of 5 yearsโ€™ imprisonment.

(6)Samuel Buku Macharia was sentenced to cumulative fines totaling Ksh18,581,820. In default, he will serve 7 yearsโ€™ imprisonment.

(7)Leadership Edge Associates through its director Samuel Buku Macharia, was fined Ksh18,181,820, with a default custodial sentence of 5 yearsโ€™ imprisonment.

(8)Lucy Wanjugu Kibogo received cumulative fines amounting to Ksh38,288,054, inclusive of mandatory penalties tied to benefits obtained from the offences. In default, she will serve 15 years and 6 monthsโ€™ imprisonment.

(9)Jahazi Investment Company Limited through its director Lucy Wanjugu Kibogo, was fined Ksh15,205,900 and faces 6 years and 6 monthsโ€™ imprisonment in default.

(10)Zohali Services Limited through its director Lucy Wanjugu Kibogo, was fined a cumulative Ksh24,461,290, with a default custodial sentence of 13 yearsโ€™ imprisonment.
