Chinland Narcotic Drugs and Psychotropic Substances Prevention Law
(Law No. 12/2026 of Chinland Parliament)
2nd February, 2026
Preamble
Whereas, recognizing narcotic drugs as a threat and danger that stunts the development and potential of users; and whereas, deeming the prevention of narcotic drugs and psychotropic substances as a duty of the Chin nationals; the Chinland Parliament hereby enacts this Law under Section 43 of the Chinland Constitution in order to prevent narcotic drugs and psychotropic substances.
Chapter (1)
Title and Definition
1. This Law shall be called the "Narcotic Drugs and Psychotropic Substances Prevention Law."
2. The following expressions contained in this Law shall have the meanings given hereunder:
(a) Narcotic Drugs means the o***m poppy, coca bush, cannabis plant, any kind of plant, and any substance or drug derived from or produced from any such plant; any drug that the Ministry of Health of the Chinland Government has declared to be a narcotic drug by notification; and any substance containing any such drug.
(b) Psychotropic Substances means any drug which has been declared to be a psychotropic substance by the Ministry of Health of the Chinland Government by notification published in the official gazette.
(c) Prevention means the timely prohibition and interdiction of the production, storage, sale, and consumption of narcotic drugs and psychotropic substances.
(d) Production means the cultivation, processing and manufacturing of narcotic drugs or psychotropic substances; the refinement and formulation of such substances by mixing them with chemical or other materials.
(e) Possession means the keeping of narcotic drugs or psychotropic substances on one's person, in one's home, premises, vehicle, or any object; the keeping of any related materials and narcotic drugs; any records relating thereto. This expression also includes possession by arrangement of such person, causing another to possess, and distribution.
(f) Drug User means a person who consumes narcotic drugs or psychotropic substances without lawful authorization.
(g) Narcotic Drugs Prevention Body means a body formed at the Chinland level, township or regional level under this Law for the prevention of narcotic drugs or psychotropic substances.
(h) Government means Chinland Government.
(i) The Relevant Ministry means the Ministry of Home Affairs of Chinland Government.
Chapter (2)
Objectives
3. The objectives of this Law are as follows:
(a) To prevent, as a national duty, the dangers of narcotic drugs and psychotropic substances which can stunt the development and potential of human beings;
(b) To implement the provisions relating to the prevention of and the illegal trafficking in narcotic drugs and psychotropic substances;
(c) To intensify and accelerate the prevention of narcotic drugs and psychotropic substances within Chinland; to impose more effective penalties on offenders;
(d) To establish frameworks in accordance with the Conventions relating to the control of narcotic drugs and psychotropic substances and to prevent the cultivation, production, transportation, illicit trafficking, and consumption of narcotic drugs and psychotropic substances;
(e) To prevent and suppress cross-border illicit trafficking in narcotic drugs and psychotropic substances through collaboration with foreign countries sharing borders with Chinland and with Federal Unit Governments within the country;
(f) To cooperate in the prevention of narcotic drugs and psychotropic substances with international organizations, regional organizations, domestic and foreign non-governmental organizations, and the public.
Chapter (3)
Formation of the Narcotic Drugs Prevention and Suppression Body
4. The Government shall form a Body for the Prevention and Suppression of the Dangers of Narcotic Drugs and Psychotropic Substances.
5. The Narcotic Drugs Prevention and Suppression Body shall be formed as follows:
(a) The Minister of Home Affairs, Chinland Government - Chairman
(b) The Minister of Health, Chinland Government - Member
(c) The Attorney General, Chinland Government - Member
(d) Heads of Local Administration Bodies - Members
(e) The Head of the Chinland People's Police Force - Secretary
Functions and Duties of the Narcotic Drugs Prevention and Suppression Body
6. The functions and duties of the Chinland Narcotic Drugs Prevention and Suppression Body shall be as follows:
(a) To coordinate and implement with Ministries, Local Administration Bodies, and non-governmental organizations concerning activities for the prevention of the dangers of narcotic drugs and psychotropic substances;
(b) To determine the functions and duties of local bodies and to coordinate them as necessary for the successful implementation of the functions and duties of the Narcotic Drugs Prevention and Suppression Body;
(c) To supervise and direct the effective implementation of public awareness activities concerning the harmful effects arising from the consumption of narcotic drugs and psychotropic substances;
(d) To scrutinize, supervise, and direct the systematic implementation and success of the work programs and measures adopted by the Narcotic Drugs Prevention and Suppression Body;
(e) To destroy or cause to destroy narcotic drugs and psychotropic substances in accordance with prescribed procedures;
(f) To permit relevant persons who have the authority to search and seize to inspect financial records relating to offenses under this Law;
(g) To manage, as necessary, narcotic drugs and related materials seized as exhibits for which no owner has come forward;
(h) To take necessary actions, in accordance with the approval of the Government, for the awarding of rewards to informers concerning offenses prosecuted under this Law;
(i) To submit periodic reports to the Government on the status of activities for the prevention of the dangers of narcotic drugs and psychotropic substances;
(j) To carry out such functions and duties as may be assigned periodically by Chinland Government.
(k) To supervise and direct the conduct of extensive public awareness activities through social network media and other news media regarding the harmful effects that may arise from the consumption of narcotic drugs and psychotropic substances;
(l) To supervise and direct persons responsible for public health, education, and law enforcement to effectively cooperate and participate in the prevention of the dangers of narcotic drugs and psychotropic substances;
(m) To inform and clarify to the public at least once a year regarding the implementation of activities for the prevention of the dangers of narcotic drugs and psychotropic substances;
(n) To act in accordance with the Extradition Law whenever matters arise regarding the extradition of offenders connected with narcotic drugs and psychotropic substances between Chinland and foreign countries or Federal Units.
Chapter (4)
Formation of Local Narcotic Drugs Prevention and Suppression Bodies
7. Local Narcotic Drugs Prevention and Suppression Bodies shall be formed as follows:
(a) Prevention and Management Committee;
(b) Public Education and Awareness Committee;
8. The Local Narcotic Drugs Prevention and Suppression Bodies shall be formed in accordance with the Administrative Rules and Regulations of the respective Township and Region.
9. The Local Narcotic Drugs Prevention and Suppression Bodies shall coordinate and liaise with the Chinland Narcotic Drugs Prevention and Suppression Body.
Chapter (5)
Search, Arrest, and Seizure of Exhibits
10. The following matters for action under this Law shall be carried out in accordance with the rule and procedures:
(a) Searching for and seizing offense-related narcotic drugs, psychotropic substances, money, materials and instruments, and arresting the offender;
(b) Searching for and seizing offense-related materials; money, materials and profits derived from the transfer or conversion;
(c) Examining and inspecting bank and financial records, copying and seizing them as exhibits;
(d) Examining and inspecting, and copying offense-related records and communication evidence;
(e) Until the case under proceedings has been concluded, offense-related financial records, money and materials shall be kept in accordance with prescribed procedures and shall not be released or transferred to any person;
(f) The activities of the Local Narcotic Drugs Prevention and Suppression Bodies shall be reported promptly to the Chinland Narcotic Drugs Prevention and Suppression Body, and shall be coordinated and liaised in accordance with the law, rule and procedures.
Chapter (6)
Offenses and Penalties
11. If any person is convicted of committing any of the following acts, such person shall be punished with imprisonment for a term of not less than 1 year, and not more than 5 years and shall also be liable to a fine commensurate with the offense;
(a) Cultivating the o***m poppy, coca bush, cannabis plant or any plant which has been declared to be a narcotic drug by notification issued by the Ministry of Health of Chinland Government;
(b) Possessing, transporting, distributing and selling, without lawful authorization under this Law, any chemical substances which have been declared by notification of the relevant Ministry to be materials used in the production of narcotic drugs or psychotropic substances, or any related equipment used in such production;
(c) Consuming, possessing, transporting, transmitting and transferring narcotic drugs or psychotropic substances;
(d) Transferring narcotic drugs or psychotropic substances by a person lawfully authorized to possess them to a person without such authorization;
(e) In order to cause the misuse of narcotic drugs or psychotropic substances, inciting, financing, inducing, deceiving, coercing, abusing authority or in any other manner acting;
(f) Misappropriating, concealing, destroying, removing or transferring any property seized or sequestered under this Law;
(g) Offering to sell, agreeing to sell, or communicating for the purpose of selling narcotic drugs and psychotropic substances.
12. In connection with any offense under this Law, if any person authorized to carry out a search, arrest, seizure of exhibits and investigation is convicted of committing any of the following
acts, such a person shall be punished with imprisonment for a term of not less than 1 year and not more than 7 years and shall also be liable to a fine commensurate with the offense:
(a) Demanding or accepting any money or property as a bribe, whether for oneself or for another person;
(b) Unlawfully receiving or accepting narcotic drugs or psychotropic substances;
(c) Substituting the offender with another person, or concealing the offender from prosecution;
(d) Destroying, fraudulently altering, substituting, mixing offense-related property, or falsely stating the weight, quantity or amount of such property;
(e) Possessing, transporting, transmitting and transferring narcotic drugs or psychotropic substances for the purpose of sale;
(f) Offering to sell narcotic drugs or psychotropic substances;
(g) Under this Law, concealing or destroying money, property or profits derived from the commission of any offense in order to prevent legal action being taken in respect thereof;
(h) Under this Law, transferring or converting money, property or profits derived from the commission of any offense in order to give them a legitimate appearance;
(i) Using a child under the age of 16 years in the commission of an offense;
(j) Committing an offense or causing an offense to be committed by abusing the influence or authority of a public servant's position;
13. Any person who attempts to commit, conspires to commit, organizes, manages, finances any offense under this Law, or aids or abets in the commission of any such offense, shall be liable to the penalty prescribed for that offense under this Law.
14. If any person is convicted of committing any of the following acts, such person shall be punished with imprisonment for a term of not less than 5 years and not more than 10 years and shall also be liable to a fine commensurate with the offense:
(a) Producing, distributing or selling narcotic drugs or psychotropic substances;
(b) Importing, exporting, or communicating for the purpose of importing or exporting narcotic drugs or psychotropic substances;
(c) Being a member of a domestic or foreign gang or group that commits narcotic drug or psychotropic substance offenses, or participating in the commission of such offenses by connecting with such gangs or groups;
(d) Committing offenses relating to narcotic drugs or psychotropic substances by handling or using weapons or explosive substances.
15. If a person convicted of committing any of the acts prescribed under Sections 11 to 14 has previously been convicted of the same offense, such person shall be liable to the maximum penalty prescribed for the subsequent offense.
16. The Court shall -
(a) pass an order for the confiscation as public property or the management in accordance with prescribed procedures of narcotic drugs, psychotropic substances, money, instruments, movable property, vehicles and animals related to the offense, upon sentencing for any offense prescribed under Sections 11 to 14;
(b) pass an order for the confiscation as public property of immovable property related to the offense and seized as an exhibit, upon sentencing under Sections 11 to 14.
Chapter (7)
Establishment, Maintenance and Management of Funds
17. The Narcotic Drugs Prevention Body shall deposit into the Treasury Fund of Chinland Government, where the Narcotic Drugs Prevention Body confiscates as public property any money, movable property or immovable property related to an offense under Section 16, sub-sections (a) and (b).
18. The Narcotic Drugs Prevention and Suppression Body may, with the approval of Chinland Government, utilize a percentage of the fund deposited under Section 16, sub-section (a) for the prevention activities of narcotic drugs and psychotropic substances.
Chapter (8)
General Provisions
19. The office administration of the Narcotic Drugs Prevention and Suppression Body shall be carried out by the Ministry of Chinland Home Affairs.
20. Any person who is a drug user or has witnessed drug use may report or inform the Chinland Police Force or the local police force.
21. In implementing the provisions of this Law, the Ministry may, with the approval of the Government, issue rule and regulations.
22. The relevant Ministry and the Narcotic Drugs Prevention and Suppression Body may, from time to time, issue notifications, orders, directives and procedures.
