၂၀၂၀ပြည့်နှစ်၊ နိုဝင်ဘာလ(၂၀)ရက်နေ့က ရင်းနှီးမြှုပ်နှံမှုနှင့်နိုင်ငံခြားစီးပွားဆက်သွယ်ရေးဝန်ကြီးဌာနက ရန်ကုန်မြို့တော်မြို့ပြဖွံ့ဖြိုးတိုးတက်ရေးစီမံကိန်းသစ် ပထမအဆင့်တွင် ရင်းနှီးမြှုပ်နှံရန် စိတ်ပါဝင်စာကြောင်း အဆိုပြုလွှာ(Expression of Interest-EOI)တင်သွင်းထားသည့် အဖွဲ့အစည်းများကို အဆိုပြုဖိတ်ခေါ်လွှာများ(Request For Proposal - RFP)များ ဝယ်ယူနိုင်ကြောင်း အကြောင်းကြားခဲ့ရာ အဖွဲ့အစည်း(၉)ဖွဲ့မှ ဝယ်ယူခဲ့ကြောင်း သတင်းထုတ်ပြန်ခဲ့ပါတယ်။
RFP ဝယ်ယူခဲ့တဲ့ အဖွဲ့အစည်း(၉)ခုအနက် BYMA Myanmar Limited(BYMA) ပါဝင်လာပြီး BYMA ကို Bouyuges Construction ရဲ့ အဖွဲ့ခွဲဖြစ်တဲ့ Bouyuges Batiment International နဲ့ Yoma Strategic Holding တို့က ဖက်စပ်တည်ထောင်ထားတာဖြစ်ပါတယ်။
BYMA ဟာ Yoma Strategic Holdings နဲ့ ဆက်နွယ်မှုရှိတဲ့ associated company တခုဖြစ်လို့ Conflict of Interest ဖြစ်မနေဘူးလားဆိုတဲ့ မေးခွန်းတွေပေါ်ထွက်လာပါတယ်။ Yoma Strategic Holdings ဟာ BYMA မှာ ရှယ်ယာအနည်းစုသာပါဝင်တဲ့ minority shareholder ဖြစ်လို့ BYMA သည် Bouyuges ရဲ့ စီမံခန့်ခွဲမှုအောက်တွင်သာရှိပြီး Yoma Strategic Holdings မှ ဝင်ရောက်စွက်ဖက်ခြင်း မရှိပါ။
ဒီနေရာမှာ ကျွန်တော်အားလုံးကို ရှင်းလင်းပြောကြားချင်တာကတော့ BYMA Myanmar Limited အနေနဲ့ RFP ဝယ်ယူခဲ့ခြင်းကို ကျွန်တော်အပါအဝင် Yoma Strategic ထံ အသိပေးခြင်းမရှိခဲ့ပါ။ ရန်ကုန်မြို့တော်မြို့ပြဖွံ့ဖြိုးတိုးတက်ရေးစီမံကိန်းသစ် ပထမအဆင့်အတွက် Swiss Challenge တင်ဒါခေါ်ဆိုရာမှာလည်း ပွင့်လင်းမြင်သာမှုရှိအောင် Swiss Challenge တင်ဒါကော်မတီမှ ဦးဆောင်ပြီး နိုင်ငံတကာအကြံပေးအဖွဲ့ဖြစ်တဲ့ Roland Berger Consultant အဖွဲ့က ကြီးကြပ်ဆောင်ရွက်နေတာပဲ ဖြစ်ပါတယ်။ BYMA ရဲ့ ပြောကြားချက်အရ ၎င်းတို့အနေနဲ့ RFP ကို ဝယ်ယူရခြင်းဟာ ရန်ကုန်မြို့တော်ရဲ့ မြို့ပြဖွံ့ဖြိုးရေးစီမံကိန်းတွေကို ပိုမိုနားလည်နိုင်အောင် လေ့လာဖို့သာဖြစ်ပြီး စီမံကိန်းတည်ဆောက်မှုမှာ တင်ဒါအဆိုပြုလွှာပါဝင်တင်သွင်းယှဉ်ပြိုင်ရန်မဟုတ်ဘူးလို့ ပြောကြားခဲ့ပါတယ်။
NYDC စတင်တည်ထောင်စဥ်ထဲက ကျွန်တော် NYDC ရဲ့အမှုဆောင်အရာရှိချုပ်အဖြစ် တာဝန်ထမ်း ဆောင်စဉ် ကာလအတွင်းမှာ ကျွန်တော်ကိုယ်တိုင်နဲ့ ကျွန်တော့်ရဲ့ ထိန်းချုပ်ကွပ်ကဲမှုအောက်မှာရှိတဲ့ ကုမ္ပဏီတွေအနေနဲ့ NYDC နဲ့ပတ်သက်တဲ့စီမံကိန်းတွေမှာ ဝင်ရောက်ယှဉ်ပြိုင်မှာမဟုတ်ကြောင်း ပြောကြားခဲ့ပြီးဖြစ်ပါတယ်။ ဒါမှလည်း Conflict of Interest ကိုရှောင်ရှားနိုင်ပြီး စီမံအုပ်ချုပ်မှု အလေ့အကျင့်ကောင်းတွေနဲ့ ပွင့်လင်းမြင်သာစွာ လုပ်ငန်းဆောင်ရွက်နိုင်မှာမို့လို့ဖြစ်ပါတယ်။ ကျွန်တော် ကတိပြုထားတဲ့အတိုင်း ဆက်လက်ရပ်တည်သွားမယ်ဆိုတာ ထပ်လောင်းပြောကြားချင်ပါတယ်။

On 20 November 2020, the Ministry of Investment and Foreign Economic Relations announced that nine companies have paid the Request for Proposal (RFP) fee which allows them to access the RFP documents related to investing in Package 1 of the New Urban Development of Yangon City project. This package covers Industrial Park with Essential Ancillary Infrastructures.
One of the nine companies is BYMA Myanmar Limited (BYMA), a joint venture between Bouyuges Batiment International, a member of Bouyuges Construction and Yoma Strategic Holdings.
The presence of BYMA on the list has raised concerns of conflict of interest as BYMA is an associated company of Yoma Strategic Holdings, in which Yoma Strategic Holdings is a minority shareholder. Hence, BYMA is managed by Bouyuges and not by Yoma Strategic Holdings.
I would like to state for the record that neither myself nor Yoma Strategic Holdings were informed of BYMA’s interest in receiving the RFP documents. The tendering process for Package 1 adheres to the Swiss Challenge process, and is headed by a global third-party consultant, Roland Berger, and they are guided by the Swiss Challenge Tender Committee. According to BYMA, their interest in receiving the RFP documents is not to bid but to have a better understanding of the urban development vision of Yangon city project.
I have pledged from the launch of NYDC that during my tenure as CEO, I will not support any bids for any NYDC related public works projects by the group of companies under my control. This is to address the issue of any potential conflict of interests, which is so central to good governance and transparency. I continue to stand by that pledge.
