Following the issuance of an enforcement notice by the Planning Authority, an illegal structure consisting of a tent, together with tables and chairs, which had been placed on public land in front of a food establishment in Sliema, has been removed.

The enforcement notice will, however, remain in force until the site is fully restored to its original state and all outstanding requirements of the notice have been complied with.

The intervention follows an enforcement notice and a public statement issued by the Authority ordering the immediate removal of the unauthorised structure. The Authority had made it clear that, should those responsible fail to comply, enforcement proceedings would be escalated in accordance with the applicable legal framework, including through direct action where necessary to ensure compliance.

In the same statement, the Authority had reaffirmed its commitment and regulatory role in safeguarding the public interest, addressing illegal development, and ensuring that enforcement action is carried out effectively.

Additional note: Planning enforcement in Malta is governed by the Development Planning Act (Cap. 552). When the Authority receives a report of suspected illegal development, its compliance and enforcement officers carry out an inspection of the site.

Works still under way can be halted immediately through a stop notice. Where an illegality is confirmed, an enforcement notice is served requiring its removal and the reinstatement of the site within a set period, and this may carry daily fines until the contravener complies.

The person served has the right of appeal before the Environment and Planning Review Tribunal, and direct action cannot be taken while an appeal is pending. In some cases, the person responsible may apply for sanctioning of the development, which is assessed against planning policy and is not automatically approved.

If the period set in the notice expires without compliance, the Authority may take direct action, entering the site and carrying out the works itself.

The Planning Authority has issued an enforcement notice (EC/122/26) requiring the immediate removal of an unauthorised structure erected in front of a catering establishment at The Strand, Sliema.

The Authority received a number of complaints, including representations from the Sliema Local Council, regarding the structure while it was being erected. These raised concerns relating to the use of public space, pedestrian accessibility and road safety.

The Planning Authority acted immediately upon receiving the complaints, initiating enforcement action without delay to address the unauthorised development and safeguard the public interest.

The enforcement notice formally addresses the unauthorised development through the Authority’s enforcement procedures and follows prior instructions issued to the contravener to cease all works on site.

Should those responsible fail to comply with the enforcement notice without delay, the Planning Authority, as the enforcement authority, will take all necessary enforcement action within its remit to ensure compliance.

The Planning Authority remains committed to safeguarding the public interest, addressing illegal development, and ensuring that enforcement action is pursued effectively.

The Planning Authority has been requested to prepare a partial review of the 2006 Ta’ Qali Action Plan, focusing on:

🔵 A proposed family theme park
🔵 Ta’ Qali Crafts Village
🔵 The Pitkalija site

The review will examine potential planning policies, land-use parameters and development guidelines for these areas. The review process does not grant development permission for any proposed use.

Once an important part of Malta's industrial landscape, the former Pipe Factory stands as a reminder of the country's manufacturing past and the communities that grew around it. Following the identification of the site as heritage at risk, the Emergency Conservation Order ensures that its historic fabric and significant features are safeguarded while further assessment is carried out.⁣

The Order prohibits demolition, excavation, development and unauthorised alterations, helping to preserve this important landmark from deterioration, neglect or inappropriate interventions.
