Property Market Agency The Regulatory Body for the Property Intermediation Industry in Malta & Gozo.

The Agency is regulated under the Property Market Agency Act (Chapter 644 of the Laws of Malta). As of the 1st of January 2022, all real estate agents, property brokers, property consultants and branch managers must be in possession of a license to be able to continue such activity. The role of the Licensing Board, set up in terms of the Real Estate Agents, Property Brokers and Property Consultant

s Act (Chapter 615 of the laws of Malta), is to regulate players within the real estate and property market in Malta by issuing appropriate licenses to applicants. The Board is also tasked with all matters relative to the provision and validity of such licenses.

Il-Ministru għall-Ġustizzja u r-Riforma tas-Settur tal-Kostruzzjoni Jonathan Attard indirizza seminar għal intermedjarji fis-Suq tal-Propjetà organizzat mill-Aġenzija dwar is-Suq tal-Propjetà, fejn kienet diskussa l-kollaborazzjoni bejn l-istakeholders fis-settur rigward il-pass li jmiss, dak li jkun imfassal kodiċi ta’ etika u ta’ prattika għal standards ogħla.

Il-Ministru Jonathan Attard beda biex jenfasizza li s-settur jinsab fi stadju kruċjali ta’ transizzjoni u rrefera għal fatt li l-entitajiet regolatorji qed jieħdu approċċ ibbażat fuq djalogu u kollaborazzjoni aktar b’saħħitha mal-operaturi u l-professjonisti fis-suq. Innota li l-parteċipazzjoni b’saħħitha tal-istess operaturi u professjonisti fis-settur jawgura tajjeb mhux biss biex jitkompla l-proċess riformattiv iżda wkoll biex iċ-ċittadini jkollhom aktar serħan il-moħħ.

Il-ministru fakkar ukoll li r-riformi li qed jitwettqu mhumiex proġetti mfassla minn individwi, iżda frott ta’ konsultazzjoni estensiva mal-operaturi u professjonisti fis-settur. Huwa faħħar ix-xogħol tal-Aġenzija u ta’ dawk kollha li qed jagħtu sehemhom sabiex l-istess Aġenzija tkun effettiva fit-twettiq tal-funzjoni regolatorja tagħha.

“Irridu nifhmu li s-suq tal-proprjetà mhuwiex biss dwar numri u bejgħ – imma dwar id-deċiżjonijiet finanzjarji l-aktar kruċjali fil-ħajja tan-nies. F’mumenti ta’ bidla u sfidi, huwa essenzjali li naħdmu b’kooperazzjoni, b’rispett u b’kollaborazzjoni. Flimkien, nistgħu noħolqu ambjent fejn il-konsumaturi jħossu li għandhom fiduċja fil-proċess, fejn l-investituri jsibu opportunitajiet ġodda, u fejn il-professjonisti tal-proprjetà jistgħu jaħdmu b’ċertezza u b’kuxjenza”, appella l-Ministru Jonathan Attard.

Min-naħa tiegħu l-Kap Eżekuttiv tal-Aġenzija Joe Deguara qal li din l-attività kienet waħda minn sensiela li se jkunu qegħdin isaħħu l-ħidma biex flimkien ma’ aġenziji u entitajiet oħra kemm tal-gvern u dawk li mhumiex, iwasslu lejn suq tal-proprjetà aktar trasparenti, robust u sostenibbli.

Il-Kap Eżekuttiv tal-Awtorità tal-Bini u l-Kostruzzjoni l-Perit Roderick Bonnici ta spjega dwar l-Energy Performance Certificate (EPCs), l-obbligi ta’ Malta rigward l-enerġija u anke studji oħra li għadhom qegħdin isiru fis-settur li jinkludu fost l-oħrajn il-building passport. Dan huwa dokument li jiddefinixxi l-binja u d-dokumentazzjoni kollha relatata ma’ dik il-proprjetà.

“Proprju għal dan il-għan, fil-ġimgħat u x-xhur li ġejjin se nkunu qegħdin inħabbru skemi b’miri li nkomplu noħolqu kuxjenza pubblika dwar il-benefiċċji ta’ bini effiċjenti fl-enerġija, bħal tnaqqis fil-konsum tal-enerġija u ffrankar tal-ispejjeż fit-tul,” temm jgħid il-Perit Bonnici.

Min-naħa tiegħu l-analista Dario Cacopardo ta preżentazzjoni fejn spjega dwar kif bħala parti mill-eżerċizzju sabiex tfassal kodiċi li jirregola l-imġiba ta’ min huwa liċenzjat, l-aġenzija analizzat b’mod kwalitattiv mudelli stabbiliti f’pajjiżi oħra.

F’dan is-Seminar saret ukoll diskussjoni bil-parteċipazzjoni ta’ Sandro Chetcuti, Chairman tal-Malta Development Association (MDA), Michael Stivala, President tal-MDA, Michael Bonello, Kap tas-sezzjoni tal-Aġenti tal-Proprjetà fi ħdan l-MDA, il-Perit Mark Arrigo f’isem il-Kamra tal-Periti u l-Arkitett Noel Ellul f’isem il-BCA.

Minister for Justice and Reform of the Construction Sector, Jonathan Attard, addressed a seminar for property market intermediaries organised by the Property Market Agency. The event focused on enhancing collaboration between stakeholders in the sector, with particular attention given to the next step: the development of a code of ethics and best practices aimed at raising professional standards.

Minister Attard emphasised that the property sector is currently undergoing a crucial period of transition. He highlighted that regulatory bodies are adopting a more collaborative, dialogue-based approach with market operators and professionals. He noted that strong participation from these key players is encouraging—not only for the continuation of the reform process but also for increasing public confidence.

He further noted that the reforms underway are not the product of individual efforts, but the result of extensive consultation with professionals and operators across the industry.

Minister Attard also commended the Agency’s work, and the contributions of all those involved in ensuring it remains effective in fulfilling its regulatory role.

“We must understand that the property market is not merely about numbers and transactions—it involves some of the most significant financial decisions people make in their lives. In times of change and challenge, it is vital that we operate with cooperation, respect, and partnership. Together, we can build an environment where consumers feel confident in the process, investors discover new opportunities, and property professionals can work with integrity and assurance,” the Minister concluded.

The Agency’s Chief Executive, Joe Deguara, noted that this seminar was part of a wider series of initiatives designed to strengthen collaboration among government and non-government entities, with the goal of creating a more transparent, robust, and sustainable property market.

Perit Roderick Bonnici, Chief Executive of the Building and Construction Authority, gave a presentation on Energy Performance Certificates (EPCs), Malta’s energy obligations, and ongoing studies within the sector, including the concept of a “building passport”—a document that outlines a property’s structure along with all associated documentation.

“To this end, in the coming weeks and months we will be announcing schemes aimed at raising public awareness of the benefits of energy-efficient buildings, such as reduced energy consumption and long-term cost savings,” explained Perit Bonnici.

Analyst Dario Cacopardo delivered a presentation outlining how the Agency, as part of its work to develop a regulatory code for licensed professionals, conducted a qualitative analysis of established models from other countries.

The seminar also featured a panel discussion with contributions from Sandro Chetcuti, Chairman of the Malta Development Association (MDA); Michael Stivala, President of the MDA; Michael Bonello, Head of the Property Agents Section within the MDA; Perit Mark Arrigo, representing the Chamber of Architects; and Architect Noel Ellul, representing the BCA.

L-Aġenzija dwar is-Suq tal-Proprjetà hija rregolata taħt l-Att dwar l-Aġenzija dwar is-Suq tal-Proprjetà (Kapitolu 644 tal-Liġijiet ta’ Malta) u hija l-korp regolatorju nazzjonali tal-industrija tal-intermedjazzjoni tal-proprjetà f’Malta u Għawdex.

By Virtue of Parliamentary Act No. XXVII of 2024, the Property Market Agency was established. Any matters commenced by, or under the authority of the Real Estate Licensing Board are to be carried on and completed by the Property Market Agency.
