Government issues Confiscation Fund Regulations

The Government - through the Minister of Finance, Economic Planning and Decentralisation – issued the Financial Crimes (Confiscation Fund) Regulations, 2026 on 24 July 2026.

The Regulations now enable utilisation of money in the Confiscation Fund account, especially the portion that constitutes fully forfeited money to the Government which is around 28 percent. The forfeited funds deposited into the account have never been withdrawn.

Section 128 of the Financial Crimes Act (FCA) establishes the Confiscation Fund which comprises funds and property confiscated to the Government whether under civil or criminal process, funds or property subject to a preservation order and any other funds or property lawfully payable to the Fund under this Act or otherwise.

The Fund is administered by the Financial Intelligence Authority (FIA) on behalf of the Minister of Finance, Economic Planning and Decentralisation.

An account for the Fund was opened in November 2017 for purposes of depositing the money referred to under S.128 of the FCA. The funds come from various sources such as Anti-Corruption Bureau, Malawi Police Service, FIA, Reserve Bank of Malawi and court judgments in relation to various financial crimes. The funds in the Fund are mainly a result of preservation orders and forfeiture orders granted by the courts. Since 2022, the Fund also contains the lowest portion of money realised by the Malawi Police Service through sale of merchandise in containers during the Service’s operation aimed at driving refugees from various locations in Lilongwe to Dzaleka Camp. The larger portion of the Fund is from preserved money.

FIA REPORT EXPOSES RISING FINANCIAL CRIME TRENDS IN MALAWI

The Financial Intelligence Authority (FIA) says financial crimes such as fraud, money laundering, corruption, tax evasion and abuse of public funds remain major threats in Malawi.

In its 2022-2024 Trends and Typologies report, released on 10 June, 2026 the FIA says it uncovered several cases involving fraudulent government payments, fake Value Added Tax (VAT) refund claims, mobile money fraud, business email compromise and the use of false documents to obtain loans or externalise foreign currency.

The report published on www.fia.gov.mw also highlights cases where public officials, businesses, Non-governmental organizations and individuals allegedly used different methods to steal or launder money, with some cases resulting in arrests, prosecutions and referrals to law enforcement agencies.

According to the FIA, the report aims to help law enforcement agencies, financial institutions and the public better understand emerging financial crime trends and strengthen efforts to prevent and detect such offences.

Meanwhile, FIA says it remains committed to producing strategic intelligence products that promote awareness and protect the integrity of Malawi's financial sector and has been producing Trends and Typologies reports since 2011.

The Financial Intelligence Authority is today training officials from the Malawi Revenue Authority (MRA) on Anti-Money Laundering and Combatting Financing of Terrorism (AML/CFT).

The training is part of FIA’s ongoing capacity building of key stakeholders and coordinated national response in the fight against money laundering, terrorist financing and other financial crimes.

In her opening remarks, Director of Compliance and Prevention, Mrs. Anita Mankhambo, said the training programs are important because they help in imparting knowledge and skills of partner institutions thereby enhancing Malawi’s capacity to safeguard the integrity of its financial system.

On her part, MRA Deputy Commissioner (Audit), Mrs. Nancy Chamdimba, said the meeting was important and she emphasized on the need for coordination between FIA and MRA.

The training attracted 13 senior officers from various divisions under MRA.

The training received financial and technical support from the Basel Institute on Governance through the International Centre for Asset Recovery (Icar).
