At the Tribunal, PC STAR WITNESS was unable to defend the frauds they aid and abided on the 20/03/2023. They connived and stopped the defeated Kyuni from putting a congratulatory call on Rt Hon. David Emmanuel Ombugadu (PhD) the chosen choice of the good people of Nasarawa State on his landslide VICTORY under the platform of the party that belongs to the people, Peoples Democratic Party (PDP) at a keely contested Governorship Election in Nasarawa State, Nigeria on the March 18th, 2023.

They bursted of absolute power and enphemia human influence from above and said, "don't can the winner, results of Gayam and Ciroma Electoral Ward Lafia LGA are yet to be computed. So, leave everything to us, we can still do something". Hence, they arrogantly expanded the votes to unimaginable figures three times in variance with the data of BVAS Machines accreditation via the use of compromised INEC Collation Officers of Gayam, Ciroma, Azara and Kanje/Abuni Electoral Wards in Lafia and Awe LGA's of the state while in a dramatic manner claimed cancellation of votes emanated from Ashige Electoral Ward Lafia LGA after a successful transmission of Form EC8A's in a real time situations into the INEC IRev Portal.

Alas! Thinking that it's gonna be business as usual, so they ignorantly told the authentic winner, "if you aren't satisfy, go to court". Indeed, absolute power corrupt absolutely and no doubt, time is the greatest healer.

Now, the heat of the divine power and the intense web of the constitutional provisions, 2022 Electoral Act and Electoral Regulations/Guidelines enshrined in the Manual available for the Tribunal to explore is obviously beyond they anticipated ego, pride.power, government influence and incumbency machineries.

Nasarawa State has been on the News over series of widows, women and Political Youth Groups protest on daily basis vehemently demanding the Governorship Election Petition Tribunal Holden in Lafia Nasarawa State to reverse the wrongful declaration of Alhaji Audu Sule of the All Progressive Congress (APC) by bias INEC State Returning Officer, Prof. Ishaya Tanko.

At the ongoing hearing proceedings, the Petitioners proved their case beyond reasonable doubt and tendered in evidence all the necessary CTC documents produced by INEC especially Form EC8A's Series which are the foundation and sources of votes in an election as enshrined in the Electoral Act 2022 as well as Election Regulations/Guidelines Manual 2023 while, closing their case on Wednesday August 17th, 2023 urged the honorable Tribunal to use these available documents (marked as Exhibits) to dispense undiluted justice in the face of Judicial Legal Purity when the time comes.

On the contrary, on the 18th & 19th of August, 2023 INEC (1st Respondent) and Alhaji Audu Sule (2nd Respondent) have so far tendered some contradictory documents from the Bar in the defense of the Petitioners petition. INEC on it part presented Form EC8B, C, D & E's Series without the foundation/primary source of votes (Form EC8A's Series) while, Alhaji Audu Sule the All Progressive Congress APC candidate through his counsel presented few CTC of Form EC8A's & EC8A's of areas they claim their client's votes were excluded, wrongly entered and results of where APC objected to the votes scored by the strong opposition political party, Peoples Democratic Party (PDP).

Indeed, the above controvercial and conflicting documents and the reasons given in the scenario left the Respondents in a dramatic longer heads with each other. Of course, they are to defend the Petitioners petition against the illegal declaration of the 2nd Respondent who was the candidate of the 3rd Respondent by the 1st Respondent and not to bring ford any complain in the middle of the hearing process. If any then, this is never at all the appropriate time in the eyes of the Law to do so. Furthermore, the present complain of the 2nd Respondent on the ground of irregularities by the 1st Respondent visa-viz the technical refusals of the 1st Respondent as the election empire to include Form EC8A's Series (the primary sources of votes) among the documents so tendered goes to confirm that, the votes that puportedly returned the 2nd Respondent as the winner of the election is mar by irregularities which is the reason why the Petitioners are in the Tribunal seeking for JUSTICE.

Now that the Respondents are fully in support of the Petitioners grounds, the honorable Tribunal is left is a constitutional rights to simple go by the provisions of the 2022 Electoral Act of sitting aside the Manual Form EC8B, C, D & E series and use the real time transmitted Form EC8A's series into the IRev Portal as supervise/monitor by INEC designated officials. These were all tendered by the Petitioners both in CTC Polling Units duplicate and in CTC IRev print out format in consonant with the number of BVAS Machines accredited voters produced, tendered and testify by the Director of ICT (name withheld) National INEC Headquarters showing results of 3,242 Polling Units of the state, equivalent to 99.57% of the transmitted Form EC8A's Series into the INEC IRev Portal In a real time situations...TO GOD BE THE GLORY, documents speak volume of themselves in the election petition Tribunal.

For whatever reasons the Respondents have been fielding the general public with fake, unfounded and baseless news about the proceedings in the Tribunal using some faceless individuals/Media Outlets, State Government owned Media Stations as well as pages of unprofessional Social Media Handlers. If worst become worst, those fake news would end up on the pages of National Dailies and Social Media Platforms, but can not change the records of the Court... Hallelujah!

Finally, the Tribunal Lordships are highly reputable Senior Silk of the Bar, by their track records are models of Justice Niki Tobi of old so, will ensure that justice is done and seen to be done as ALL EYES ARE ON THE JUDICIARY!

The Nasarawa state tribunal story is getting refreshing by the day.
Initially, all their thinking was that they will deny all evidence submitted by PDP as being doctored but they didn't see the side of the document sopeonered by the tribunal.

Now they are confused about how INEC can deny their stamps and the people who signed the documents.

Gaskiya, it's worrisome when people use their mouths to say one term and so what? When the same people say I will not steal a dime from Nasarawa state, when the people say that I control five African countries as a group manager what will I do with Nasarawa state's meager resources, the same people are working tirelessly to do the opposite of what they said.

Not all quiet or gentle people are humble,
don't confuse timid people for humble people...

Why we insist Ombugadu won, it's because we truly need to be human in Nasarawa state. When the majority say they don't want you never impose yourself on them no matter what.

Ombugadu won the 2023 election and it's obvious Ombugadu is coming, the truth about the voices of Nasarawa state votes is still alive.

*GOVERNORSHIP ELECTION PETITION TRIBUNAL SITTING IN LAFIA NASARAWA STATE: 2ND RESPONDENT ACCUSED INEC OF IRREGULARITIES AS IT TENDERED DOCUMENTS IN EVIDENCE*

The sitting of Saturday 19/08/2023 was for the 2nd Respondent, the candidate of the All Progressive Congress (APC) in the March 18th, 2023 Governorship Election in Nasarawa State through his counsel to open defense to the Petitioners (Hon. David Emmanuel Ombugadu & Peoples Democratic Party -PDP) petition which is challenging the wrongful declaration of the 2nd Respondent by the 3rd Respondent (INEC).

Adebayo Adeloru, Lead Counsel to the 2nd Respondent led Prof. O. Y Abdulkarim, A.S Mohammed, Musa Hussaini and A. O Adebo of the Inner Bar and others in appearance for their client. He started the business of the day with tendering from the Bar four (4) sets of documents to include;

1) 31 CTC of Form EC8A's of the Polling Units where the 2nd Respondent is complaining of exclusion of it votes. (Names of the said PU and codes are details in list of items on the schedule of the day).
2) 23 CTC of Form EC8B's of 7 Local Government Areas where the 2nd Respondent is complaining of reduction of it votes. (Names of the Wards and LGA's are contained in page 5 of the schedule of documents of the day).
3) 29 CTC of Form EC8A's of the Polling Units where the 2nd Respondent is objecting to votes recorded for the Petitioners. (Details are on page 5-7 of the schedule of documents of the day).
4) 3 Receipts of payments to the 1st Respondent (INEC) in respect of the CTC documents).

*Objections* The Petitioners counsel led by J.S Okutepa (SAN) objected to the admisibilties of the documents and reserved arguments to the final address stage.

*CROSS-EXAMINATION*
1st Respondent:

To start with, Isiaka Dikko (SAN) before Cross Examinations, applied and tendered from the Bar INEC CTC List of political parties Wards/LGA's Collation Agents for APC, NNPP & PDP. The Petitioners Counsel objected and reserved arguments to the final address stage.

Afterwards, he invited their Star Witness RW1 (Nasarawa State APC Secretary) to the box.

Q: You have before today read the petition? Ans: Yes.
Q: You are aware that part of the Petitioners claim is Ashige Electoral Ward? Ans: Yes.
Q: You are aware that INEC cancelled the results of Ashige Electoral Ward? Ans: Yes.
Q: You are aware that INEC issued Form EC40G in respect of the cancellation of Ashige Electoral Ward results? Ans: Yes.
Q: You are aware that petitioners complaint that votes of Gayam, Ciroma, Azara and Kanje/Abuni Electoral Wards in Lafia and Awe LGA's were tempered with? Ans: Nobody touch votes in those areas.
Q: You will discover in page 49-51 of the petition computation table show that petitioners will be leading with 4130. Is that correct? Ans: Not correct.
Q: Do you know Ayiwulu Baba Ayiwulu? Ans: No. He was never seen near the Collation Center that day.

*2nd Respondent*

The 2nd Respondent Counsel dwelt their energy on the documents earlier tendered to establish the facts that the 2nd Respondent votes were excluded, reduced and generally short changed. Therefore, the star witness answered yes to questions in that regards.

*Petitioners*

J. S Okutepa (SAN) applied for exhibits; 68A, RW3, RW4, C32, RW42-60 and RW61-94.

Q: You have been attending court proceedings seeing how Witness testify? Ans: Not consistently I represented my party two times in the court in the past.
Q: You are aware that INEC produced Manual for 2023 General Elections? Ans: Yes.
Q: Do you know that all parties are expected to have PU Agent? Ans: Yes.
Q: After computation of Form EC8A, the PO is expected to upload it to the INEC IRev Portal? Ans: I have no business with the IRev.
Q: In paragraph 109 of your statements you stated Form EC8A series are collated into Form EC8B's? Ans: Yes.
Q: And Form EC8B's are entered into form EC8C? Ans: Yes.
Q: Are you aware that Form EC8A's are the foundation of election results? Ans: Yes, if there are genuine and concrete.
Q: You are aware that INEC keeps custody of all the election result Forms? Ans: Yes.
Q: Do you have quarrel with INEC? No, but I objected to votes recorded to PDP.
Q: *Did your party Polling Unit Agents signed the results? Ans: I signed but, Ayiwulu refused to sign*.
Q: When INEC deducted your party votes, you weren't happy? Ans: That's why we are here.
Q: *Does your party have cross objections petition? Ans: I don't know, ask my counsel*.
Q: What is the level of your education? Ans: SSCE- Secondary school.
Q: Paragraph 132 and exhibits RW12-42 were Forms for none collation of APC votes while RW66-94 were objection Forms for votes recorded for PDP. Can you confirm the difference? Ans: Yes.
Q: Exhibits RW43-65 are Wards results (Form EC8B's)? Ans: Yes, but were cancelled by INEC.
Q: You are aware that exhibit 68A (Election Manual) shows the procedure to fill Form EC40G in the instance of votes cancellation? Ans: I am not an INEC official.
Q: In exhibit C32 (Ashige Ward) your party Agent signed it on the 19/03/2023 instead of 18/03/2023? Ans: I can proof to you that he's not our agent.
Q: Do you know that the INEC official name that issued exhibits RW3, RW4 and C32 is Adamu Abdullahi as written therein? Ans: Yes.
Q: Do you know Form EC40G? Ans: I don't know.
Q: Do you know that exhibit RW4 indicate where if election didn't hold? Ans: I am not the one to do it.

The 2nd Respondent Counsel applied for the Adjournment of sitting to Thursday 24/08/2023 for continuation of defense.

*Legal Implications*
1) Respondents took the place of the Petitioners instead of defending the petition, they are complaining.
2) They are petitioning the Petitioners in the middle of hearing.
3) Respondents didn't filed any cross objection petitions.
3) 2nd Respondent is accussing the INEC of irregularities.
4) Respondents shown support of the Petitioners ground of irregularities.
5) Ashige Electoral Ward results were uploaded to the IRev while they are showing Form EC40G to that effect...the list is on and on.

Nasarawa state election tribunal: INEC confirms PDPs' hopes as evidence submitted were described as “mere papers without substance.”
The Independent National Electoral Commission INEC could not present any witness at the commencement of their defence as promised from their seating of 16th August, 2023.

After a successful outing of the PDP star witness Bar. Ayiwulu Baba Ayiwulu who earlier established his case based on facts about the irregularities that surrounded the Prof. Ishaya Audu declaration of Engr. Audu Sule as the winner of the 2023 Gubernatorial election in Nasarawa state, the election tribunal sitting took an entirely new dimension as the defense was hoping to take a pinch on the star witness due to some irregularities on the table submitted in his witness statement under oat.

Barr. Ayiwulu the star witness explained that the irregularities from the table as filed to the court were due to some human errors which he said could be clarified and reconciled by the evidence presented to the tribunal which includes certified true copies of form EC8As, Form EC8Bs, the Irev results, BVAS printout, and BVAS screenshot as presented by INEC subpoena witness from the ICT Department of the National Headquarters of INEC and state respectively, including every other documents presented before the court as part of the essential evidence by the PDP and its candidate, David Ombugadu.
After the cross-examination by the respondent's counsel which includes the lawyers of INEC, Engr. Sule and APC, the PDP lead counsel led by J.S Okutepa SAN officially closed their case on Thursday 17th August 2023 amidst great jubilation by PDP supporters who concluded that it was a successful delivery.

Following the PDP closure of their petition, INEC began their defence officially today Friday 18th August 2023 with their Lead counsel Bar. Ishiaku Mudi Dikko (SAN) who earlier mentioned that he would proceed before the arrival of their witness whom he claimed was on his way to the court. He sort to tender some documents to the tribunal from the bar in order to fill the void following acceptance of the request to proceed, Dikko (SAN), among other documents duly submitted Form EC8Bs of some affected areas which include the following:
1. Certified True Copies (CTC) of purported Form EC40G for 36 Polling Units in Ashige Electoral Ward Lafia LGA.
2. Certified True Copy of the poported Form EC40G of a Polling Unit in Gayam Electoral Ward Lafia LGA.
3. Poported manual of Form EC8B for Kanje/Abuni Electoral Ward, Awe LGA.
4. Poported manual Form EC8B for Gayam Electoral Ward Lafia LGA.
5. Poported manual Form EC8B for Ciroma Electoral Ward Lafia LGA.
6. 13 Manual Form EC8C's Series for the 13 LGA of Nasarawa State.
7. Poported manual Form EC8D (Summary of all LGA'S Collation Results at the State Collation Center).
8. Poported manual Form EC8E ( Declaration of Governorship Nasarawa State)
9. INEC Receipt of payments in respect of the above-named documents.

However, INEC deliberately failed to present the form EC8A which is the polling unit results being the foundation of all the collated results in the election under question.

INEC which was the umpire that conducted the March 18th, 2023 Governorship and State House of Assembly Elections through its Lead Counsel Isiaka Dikko (SAN) did not tender any additional document evidence from the Bar before the Honorable Tribunal especially Form EC8As among the documents in evidence to support its defence on Friday 18/08/2023. This raised doubts as to the competence of the records submitted being more a repetition of what the tribunal is already in possession of based on the PDP petition. Form EC8A is the first record of collated results at the polling unit.

After the presentation of the documents by the INEC's lead counsel, the tribunal was set to receive the respondents’ witnesses but was instead, informed by Barr. Dikko, SAN, that the 1st respondent has decided to bring to a close their argument without presenting any witnesses as earlier promised.

Barr. Dikko, SAN, based his position on the grounds that after having earlier listened to the petitioner’s substantive evidence of the star witness, there was no need to waste the resources of government and was unable to present any further witness due to paucity of funds and that based on PDP witness submissions and evidence before the tribunal, it was clear who the winner of the 2023 gubernatorial election was.

Barr. Dikko further stated that as INEC representatives, their responsibility was to ensure that elections are done peacefully and winners are announced from the process but in such a case, the court has the power to exercise their rights as the only temple of justice and the last hope of masses to determine the veracity of claims by petitioners.

Responding, the PDP counsel objected to the documents presented to the tribunal by the defendant counsel arguing that such documents are “mere waste papers that are irrelevant to the case on the ground.” He pleaded to reserve his reasons for the objection for their final written address.

Consequently, the case was adjourned to Saturday the 19th of August 2023 for the second Respondent (A A Sule) to begin his defence in the petition.
Recall that PDP star witness urged the tribunal to rely on evidence already supplied by INEC, and other official records being the sole custodian and handler of pre and post-election materials including CTC of BVAS, IREV and sundry documents.

*INEC TENDERED DOCUMENTS IN EVIDENCE AT THE TRIBUNAL, INJURED APC & A.A SULE*.

Independent National Electoral Commission (INEC) took turn on Friday 18/08/2023 in defense at the ongoing Governorship Election Petition Tribunal Holden in Lafia Nasarawa State after the Petitioners Counsel closed case on Thursday 17/08/2023. In the process, the 2nd Respondent in the matter obviously declined calling of any witnesses on oath or subpoenaed and suddenly closed defence claimed that it's expensive to sponsor witnesses to the Tribunal.

INEC which was the empire that conducted the March 18th , 2023 Governorship and State House of Assembly Elections through it Lead Counsel Isiaka Dikko (SAN) by failing to tendered from the Bar before the honorable Tribunal Form EC8A'S Series among documents in evidence to support it defense dated Friday 18/08/2023 to include;

1) Certified True Copies (CTC) of poported Form EC40G for 36 Polling Units in Ashige Electoral Ward Lafia LGA .
2) Certified True Copy of the poported Form EC40G of a Polling Unit in Gayam Electoral Ward Lafia LGA.
3) Poported manual of Form EC8B for Kanje/Abuni Electoral Ward, Awe LGA.

In response, the Petitioners Lead Counsel of the day, J.J Usman (SAN) objected in totality the admisibility of the above tendered Documents by the 1st Respondent because, they are NOTHING but worthless pieces of papers and we reserved our further arguments to the Final Address Stage.

Finally, 1st Respondent Counsel remarked that, having participated in the cross-examination of the Petitioners witnesses and elicited evidence therein, I humbly apply on behalf of our client to close our defense.
Analogically, the INEC ended up injured APC and Alhaji Audu Sule (2nd & 3rd Respondents) by not tendering Polling Unit Results (Form EC8A's) in the list of documents so tendered during it defense contrary to the provisions of the 2022 Electoral Act and 2023 General Elections Regulations/Guidelines that, *election is won or lost at the Polling Unit*. And on the other hand, supporting the complain of the Petitioners in their petition that, *their lawful votes from the Polling Units of areas under contention were expanded by the INEC (1st Respondent) in favour of the 2nd & 3rd Respondents* because there can be no Collation of Results in Form EC8B without the primary source of data (results) emanating from Form EC8A's Series.

The 2nd Respondent in the petition is billed to open it defense on Saturday 19/08/2023 as the court adjourned sitting on Friday 18/08/2023.

This "Go to court" matter by APC done turn to had I know issue for the 21st century election riggers. Hahaha 🤣🤣🤣! SU KIRA RUWA!
