*RE: PDP VS. INEC THREE OTHERS*

Contrary to the rumors going round that the Federal High Court has today given an order directing the Niger State Independent Electoral Commission ( NSIEC) not to do anything pending the determination of the suit before the Court on the proposed Local Government Council election. The correct position is that during the Court sitting today, learned Counsel Ndayako SAN informed the Court that the NSIEC is taking a step which is subjudice to their case before the Court as they have written a letter to his client rescheduling the proposed election date. We responded that the status quo before the commencement of the action remains. The NSIEC has released the Election timetable before the commencement of this action. The Court asked whether there was anything to show the steps taken by NSIEC and there was nothing before the Court to prove the allegation of subjudice.
The Court advised the Counsel to advise their clients. Therefore, I am not aware of any Court Order directing the NSIEC not to do anything pending the determination of the Suit before the Court. Thank you.
