Public Conditions of Use
Council social media channels are a safe place where users are encouraged to communicate respectfully. Those who participate in engaging through Council social media channels are asked to be respectful of each other, Officers and Elected Members.
All users should be aware that Council Officers monitor all social media activity associated with Council. As social media is a 24 hours a day/seven days a week medium, the monitoring period will vary.
The Council Officers responsible have the authority to manage comments on Council pages based on breaches to the Public conditions of use as outlined in the Social Media Policy.
Complying with Electoral rules: During the four months leading up to any Local Government Election, Council will remove any statement or image in comment that relates to a candidate whether they are a current Elected Member or not. Horowhenua District Council pages are elections campaign free zones.
Council aims to comply with the Harmful Digital Communications Act 2015 and as such Council has three categories regarding inappropriate commentary and they are:
1. Minor – general name calling
2. Major – unacceptable language, inappropriate imagery
3. Extreme – threatening or explicit commentary and/or images
What happens in the event of:
1. Noncompliance:
a. Minor: The comment being hidden (so that only the person commenting, and their Facebook friends can see the comment).
b. Major: The comment being deleted from the page. In this instance a Council Officer will direct message the person to advise:
The comment has been deleted in accordance with Council’s Social Media Policy
That a condition of use of Council’s social media platforms is that they are respectful for each other, Officers and Elected Members
That a further breach of Council’s policy may lead them being banned from the social media channel.
c. Extreme:
A direct message is sent to the person who made the comment advising they will be banned from the page following which they are banned. This option is reserved for the most serious breaches of the Social Media Policy, and is for a period of no less than three years.
2. Repeated breaches:
a. Minor: All Minor breaches will be treated as per 1.a) above. However, if the behavior is repeated then for that person all future Minor Breaches will be treated as Major Breaches as per 1.b) above.
b. Major: In the event of a second Major breach, by the same person, then the author will be sent a Direct Message advising that due to a second Major breach of Council’s Social Media Policy they will be banned for a period of no less than one year.
Council’s Communication Lead will keep a record of noncompliance and bans and bans will be lifted after the specific time-frame.
Council’s Social Media Advisor will keep a record of noncompliance and banned users.
Horowhenua District Council reserves the right to refer all commentary regarding:
illegal activities to the New Zealand Police
racism to the Race Relations Commissioner
privacy breaches of an individual to the Office of the Privacy Commissioner.
Council’s social media channels are subject to the Public Records Act 2005. As such, Council is legally obliged to save and maintain records of social media activity on its channels. These records are subject to official information requests under the Local Government Official Information and Meetings Act 1987.
