🔹 Constitutional Role the PSC is established under Section 190 of PNG’s Constitution. It reviews personnel matters such as discipline, selection, and employment conditions for permanent public servants. This ensures employees’ rights are protected and decisions are not illogical.
🔹 Merit-Based Appointments In 2019, the Supreme Court restored PSC’s authority over senior appointments (departmental heads, provincial administrators, statutory authority leaders). This reinforced merit-based selection and reduced political manipulation.

Who is a Provincial Administrator?

📢A Provincial Administrator is the Head of a Provincial Administration that oversees all government departments and agencies operating within the province, and is responsible for managing provincial administration, implementing government policies, and supporting the Governor in delivering services to the people.

🍁How is a Provincial Administrator Appointed

When a Provincial Administrator’s position becomes vacant (or is about to):
1. Department of Personnel Management (DPM) must:
o Declare the vacancy.
o Get minimum requirements for the role from the Central Agencies Co-ordination Committee.
o Notify the Public Services Commission (PSC) and the Provincial Executive Council (PEC).
o Advertise the position nationally (at least twice in newspapers).

2. Assessment of applicants is based on:
o Minimum requirements.
o Past performance and discipline records.
o Other prescribed criteria.

3. Selection process:
o DPM compiles a list of at least 5 qualified candidates.
o Submits the list and all applications to the PSC.
o PSC assess the applications and recommends three (3) candidates in order of preference.
o Sends this list to the PEC.
o PEC then makes the final appointment.

4. If no suitable candidate is found:
o the process starts again from advertising and assessment.

🔹 Policy implementation: Ensures national and provincial government policies are carried out effectively.
🔹 Advisor to the Governor: Provides guidance on administrative matters, service delivery, and development priorities.
🔹 Coordinator of local-level governments: Aligns provincial strategies with district and local-level government activities.
🔹 Manager of public servants: Responsible for recruitment, discipline, and performance of provincial staff.
🔹 Financial oversight: Ensures provincial funds are managed properly and spent according to approved budgets.
🔹 Service delivery leadership: Drives programs in health, education, infrastructure, and community development.

🥳Victory for Good Governance in PNG

📢In 2019, the Supreme Court of Papua New Guinea restored the constitutional role of the Public Services Commission (PSC) in appointment processes, reinforcing merit-based selection and institutional accountability.

The Court declared unconstitutional the 2014 Constitutional Amendment Laws that had stripped PSC of its independent powers over the appointment, suspension, and revocation of:

• Departmental Heads
• Provincial Administrators
• Heads of Statutory Authorities (RSA)

🚫 The following laws and regulations were also struck down as invalid:

1. Public Service Management Act 2014
2. Regulatory Statutory (Appointment to Certain Offices) (Amendment) Act 2013
3. Public Service (Management) (Employment of Departmental Heads) Regulations 2014
4. Public Service (Management) (Employment of Provincial Administrators) Regulations 2014
5. Regulatory Statutory (Appointment to Certain Offices) Regulations 2013

✅ Legal effect:

• Section 193 and 208B of the Constitution remain in force
• PSMA 1995 and RSA 2004 remain valid
• No gaps, no confusion, the system stands strong
