Pursuant to Article 5 of the Labor Code of the Philippines, as amended, and Section 1 of Republic Act No. 1'1058, this Advisory is issued to promote safe and healthful workplaces and working conditions for all workers by affording them full protection against injuries, illnesses, or accidents before, during, and after disruptive events.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ. ๐ƒ๐ข๐ฌ๐ซ๐ฎ๐ฉ๐ญ๐ข๐ฏ๐ž ๐„๐ฏ๐ž๐ง๐ญ๐ฌ. Disruptive events are unforeseen and extraordinary occurrences that interrupt normal work operations and pose imminent danger to workers while at work, or when going to or from their place of work. These include natural disasters (e g, earthquakes, typhoons, floods, volcanic eruptions), human-induced disasters (e.g, armed conflict, cyberattacks, industrial accidents), public health emergencies (e.9., pandemic, epidemic), social and political events, and other similar occurrences. lmminent danger refers to a situation caused by a condition or practice that could reasonably be expected to lead to death or serious physical harm.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ. ๐€๐๐จ๐ฉ๐ญ๐ข๐จ๐ง ๐จ๐Ÿ ๐š ๐‚๐จ๐ฆ๐ฉ๐ซ๐ž๐ก๐ž๐ง๐ฌ๐ข๐ฏ๐ž ๐š๐ง๐ ๐‘๐ž๐ฌ๐ฉ๐จ๐ง๐ฌ๐ข๐ฏ๐ž ๐Ž๐œ๐œ๐ฎ๐ฉ๐š๐ญ๐ข๐จ๐ง๐š๐ฅ ๐’๐š๐Ÿ๐ž๐ญ๐ฒ ๐š๐ง๐ ๐‡๐ž๐š๐ฅ๐ญ๐ก ๐๐ซ๐จ๐ ๐ซ๐š๐ฆ. All employers are required to formulate and adopt a comprehensive and responsive occupational safety and health program, which shall include a business continuity and disaster preparedness plan for disruptive events. For the purpose of formulating this plan, employers through their respective safety officers and safety and health committees, shall:

1. conduct hazard identification and risk assessment, and implement control measures (HIRAC);
2. adopt strategies for emergency response and crisis management;
3. create crisis management and recovery committee;
4. include measures to address the specific vulnerabilities of women, differently-abled workers, and other workers;
5. and test and update the plan at least annually or after every major incident.

Employers shall inform workers of their Occupational Safety and Health Program in a language or dialect they understand.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ‘. ๐ฅ๐ฆ๐ฉ๐ฅ๐ž๐ฆ๐ž๐ง๐ญ๐š๐ญ๐ข๐จ๐ง ๐จ๐Ÿ ๐‚๐จ๐ง๐ญ๐ซ๐จ๐ฅ ๐Œ๐ž๐š๐ฌ๐ฎ๐ซ๐ž๐ฌ. Employers, through their respective safety officers and safety and health committees, shall apply appropriate control measures, as follows:

a. elimination or substitution - suspend work in affected site or production areas when imminent danger is present, temporarily relocate operations to safer locations if possible, and replace hazardous tasks with safer options, such as using remote monitoring instead of on-site inspection during severe weather.
b. engineering controls - structural safety measures (reinforce windows and buildings, install flood barriers, earthquake-resistant fixtures, fire suppression systems), emergency power and utilities (backup generators, water storage, and back-up communication systems), safe shelters and evacuation routes (clearly marked, accessible, and regularly maintained), ventilation and filtration systems (for chemical spills, smoke, or airborne hazards)
c. administrative controls - adopt alternative work arrangements, assign safety officers to keep records of workers' routes to and from work and their ability to work remotely or use alternative arrangements, set up clear communication protocols, such as early warning systems, SMS or email alerts in a language or dialect understood by all workers, and emergency response plans, hold regular training and drills for emergencies like earthquakes, fires, floods, or civil disturbances, and work closely with local, regional, and national disaster management councils to align workplace actions with their advisories.
d. personal protective equipment (PPE) - provide basic PPE like helmets, masks, gloves, and boots for hazards such as floods, fires, or debris, use specialized PPE, such as respirators for chemical exposure, and flame-resistant clothing for fire hazards, make sure emergency kits include first aid supplies, flashlights, whistles, and communication devices.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ’. ๐€๐ซ๐ซ๐š๐ง๐ ๐ž๐ฆ๐ž๐ง๐ญ๐ฌ ๐ญ๐จ ๐„๐ง๐ฌ๐ฎ๐ซ๐ž ๐–๐จ๐ซ๐ค๐ž๐ซ๐ฌ' ๐’๐š๐Ÿ๐ž๐ญ๐ฒ ๐š๐ง๐ ๐‡๐ž๐š๐ฅ๐ญ๐ก. Employers are advised to suspend work or implement alternative work arrangements (e.9., telecommuting) when imminent danger arises from disruptive events considering the nature of their business as well as, among others, information issued by the Philippine Atmospheric, Geophysical and Astronomical Services Administration (PAGASA), National Disaster Risk Reduction and Management Council (NDRRMC), Philippine lnstitute of Volcanology and Seismology (PHIVOLCS), Department of Health, and work suspensions in the public sector declared by the Office of the President or by local government units.

For establishments engaged in public utilities, health services, and other vital operations, employers are encouraged to maintain only the minimum number of personnel or a skeleton force necessary to ensure the continuity of essential services or to render emergency overtime and rest day work.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ“. ๐๐š๐ฒ๐ฆ๐ž๐ง๐ญ ๐จ๐Ÿ ๐–๐š๐ ๐ž๐ฌ ๐š๐ง๐ ๐†๐ซ๐š๐ง๐ญ ๐จ๐Ÿ ๐๐ž๐ง๐ž๐Ÿ๐ข๐ญ๐ฌ ๐ญ๐จ ๐–๐จ๐ซ๐ค๐ž๐ซ๐ฌ. Unless otherwise specified in the applicable employment contract, company policy or collective bargaining agreement, or when accrued leave benefits are utilized, the "no work, no pay" policy applies during work suspensions due to disruptive events.

Workers in establishments engaged in public utilities, health services, and other vital operations, those who are part of a skeleton force, or those who rendered emergency overtime or rest day work shall receive not less than the wage and wage-related benefits under the Labor Code of the Philippines, as amended.

Employers may offer additional incentives such as hazard pay, compensatory time off, transport service, or food allowance to workers who report to work during disruptive events.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ”. ๐–๐จ๐ซ๐ค๐ž๐ซ๐ฌ' ๐–๐ž๐ฅ๐Ÿ๐š๐ซ๐ž ๐…๐š๐œ๐ข๐ฅ๐ข๐ญ๐ข๐ž๐ฌ. Employers shall ensure humane working conditions of workers in establishments engaged in public utilities, health services, and other vital operations, those who are part of a skeleton force, or those who rendered emergency overtime or rest day work by providing welfare facilities such as adequate supply of safe drinking water and sanitary facilities, suitable temporary living accommodation, separate sleeping facilities for men and women workers, and other similar facilities, as may be necessary and applicable.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ•. ๐–๐จ๐ซ๐ค๐ž๐ซ๐ฌ' ๐ƒ๐ฎ๐ญ๐ฒ ๐ญ๐จ ๐ฅ๐ง๐Ÿ๐จ๐ซ๐ฆ ๐„๐ฆ๐ฉ๐ฅ๐จ๐ฒ๐ž๐ซ๐ฌ ๐จ๐Ÿ ๐ฅ๐ฆ๐ฆ๐ข๐ง๐ž๐ง๐ญ ๐ƒ๐š๐ง๐ ๐ž๐ซ. Workers shall, to the extent practicable, promptly notify their employers of any imminent danger arising from disruptive events which may pose a threat to their safety and health while going to or coming from work, consistent with company policies and practices.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ–. ๐๐ซ๐จ๐ญ๐ž๐œ๐ญ๐ข๐จ๐ง ๐€๐ ๐š๐ข๐ง๐ฌ๐ญ ๐”๐ง๐ฐ๐š๐ซ๐ซ๐š๐ง๐ญ๐ž๐ ๐ƒ๐ข๐ฌ๐œ๐ข๐ฉ๐ฅ๐ข๐ง๐š๐ซ๐ฒ ๐€๐œ๐ญ๐ข๐จ๐ง๐ฌ. Workers who report imminent danger or fail or refuse to report to work due to imminent danger during disruptive events should not be subject to administrative sanctions.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ—. ๐‹๐ข๐š๐›๐ข๐ฅ๐ข๐ญ๐ฒ ๐ข๐ง ๐‚๐š๐ฌ๐ž ๐จ๐Ÿ ๐…๐š๐ข๐ฅ๐ฎ๐ซ๐ž ๐จ๐ซ ๐‘๐ž๐Ÿ๐ฎ๐ฌ๐š๐ฅ ๐จ๐Ÿ ๐„๐ฆ๐ฉ๐ฅ๐จ๐ฒ๐ž๐ซ๐ฌ. Employers who fail or refuse to conduct HIRAC, implement control measures, adopt arrangements to ensure the safety and health of workers, or pay the corresponding wages shall be liable under the applicable provisions of the Labor Code, Republic Act No. 1'1058, and their implementing rules and regulations.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ๐ŸŽ. ๐ƒ๐ข๐ฌ๐ฉ๐ฎ๐ญ๐ž ๐‘๐ž๐ฌ๐จ๐ฅ๐ฎ๐ญ๐ข๐จ๐ง. Employers and workers are encouraged to resolve disputes arising from any provisions of this Advisory through dialogue, consultation, or grievance mechanisms provided in company policies or collective bargaining agreements.

Where necessary, they may seek assistance from the Regional, Provincial, or Field Offices of the Department of Labor and Employment having jurisdiction over their workplace for conciliation and mediation services.

๐’๐ž๐œ๐ญ๐ข๐จ๐ง ๐Ÿ๐Ÿ. ๐“๐ž๐œ๐ก๐ง๐ข๐œ๐š๐ฅ ๐€๐ฌ๐ฌ๐ข๐ฌ๐ญ๐š๐ง๐œ๐ž, ๐Œ๐จ๐ง๐ข๐ญ๐จ๐ซ๐ข๐ง๐ , ๐š๐ง๐ ๐‘๐ž๐ฉ๐จ๐ซ๐ญ๐ข๐ง๐ . Employers may avail themselves of Business Continuity and Resiliency Planning training modules offered by the Department of Labor and Employment (DOLE), including those through the Regional Tripartite Wages and Productivity Boards, to help them develop and implement strategies that mitigate the impact of disruptions and disasters, ensure continuity and resilience, and contribute to environmental sustainability.

Employers are required to maintain employment records for those who worked during disruptive events and to submit reports to the DOLE on the adoption of alternative and flexible work arrangements, including telecommuting and other arrangements.

The Regional Offices shall monitor compliance by private establishments with this Labor Advisory. Non-compliant employers may be reported to the nearest DOLE Regional, Provincial, or Field Offices.
