Pinawalang-sala ng ang isang ina sa kasong parricide kaugnay ng pagkamatay ng kanyang anak na babae. Inabswelto siya sa pananagutang kriminal matapos mapatunayan na mayroon siyang schizophrenia, isang kondisyong nag-alis sa kanyang kakayahang matukoy ang kamalian ng kanyang ginagawa.

Sa desisyong isinulat ni Associate Justice Samuel H. Gaerlan, pinagbigyan ng Ikatlong Dibisyon ng Korte Suprema ang apela ng isang ina at binaliktad ang sentensya nito sa kasong parricide base sa legal insanity o kawalan ng katinuan ng pag-iisip dulot ng schizophrenia, isang exempting circumstance sa ilalim ng Revised Penal Code.

Naharap sa sakdal ang ina matapos siyang makitang kayakap ang kanyang limang-taong gulang na anak habang tumatalon mula sa isang tulay, na nauwi sa pagkamatay ng bata.nBagama’t nailigtas ang ina, hindi na nahanap ang bata hanggang matagpuan ang katawan nito sa ilog kinabukasan.

Ikinatwiran ng ina na wala siya sa tamang pag-iisip nang panahong iyon. Ang huli niyang natandaan ay ang paglalakad niya kasama ang kanyang anak. Sinabi niyang nagkamalay na lang siya habang lumulutang na sa ilog.

Isang lisensyadong doktor mula sa National Center for Mental Health (NCMH) ang nagpatunay na ang ina ay may diagnosis na schizophrenia.

Hinatulan ng Regional Trial Court (RTC) ang ina ng reclusion perpetua o hanggang apatnapung taong pagkakakulong sa paniniwalang matino siya nang mangyari ang insidente. Inihain lamang niya ang depensang insanity matapos ang pagpresenta ng ebidensiya ng prosekusyon. Pinagtibay ito ng Court of Appeals.

Hindi sumang-ayon ang Korte Suprema. Sinabi nito na walang kriminal na pananagutan ang ina dahil naging hadlang ang kondisyon ng kanyang pag-iisip para maunawaan niya ang kamalian ng kanyang ginawa.

Ang insanity o kawalan ng katinuan ay isang sakit o depekto ng utak na makikita sa pananalita o kilos ng isang tao. Sa ilalim ng Artikulo 12 ng Revised Penal Code, isa ito sa mga pagkakataon na nagpapalaya sa isang tao mula sa pananagutang kriminal.

Sa kasong People v. Paña, naglatag ang Korte Suprema ng tatlong basehan para mapatunayang ang insanity bilang exempting circumstance:

•Una, dapat umiiral ang insanity sa oras ng paggawa ng krimen;
•Pangalawa, dapat napatunayan ito ng medisina; at
•Pangatlo, dapat nawalan ng kakayahang unawain ang kamalian ng kanyang kilos ang akusado dahil dito.

Ayon sa Korte Suprema, napatunayan ng ina ang kanyang kondisyon sa tulong ng testimonya at mga ulat mula sa mga psychiatrist. Ang schizophrenia ay isang malalang sakit kung saan hindi na makilala ng tao ang pagkakaiba ng pantasya sa realidad, na kadalasang may kasamang mga guni-guni (hallucinations at delusions).

Bagama't malaya sa pananagutang kriminal, nananatiling may pananagutang sibil ang ina. Iniutos ng SC na magbayad siya sa mga tagapagmana ng biktima ng PHP 75,000 bilang civil indemnity; PHP 200,000 para sa moral, exemplary, at temperate damages.

Iniatas din ng SC ang agarang paglilipat sa ina mula sa Correctional Institution for Women patungo sa NCMH para sa kanyang gamutan. Maaari lamang siyang mapalaya sa utos ng RTC base sa rekomendasyon ng kanyang doktor.

The has laid down guideposts for proving who owns or controls a social media account in criminal cases.

In a Decision written by Associate Justice Ramon Paul L. Hernando, the SC’s First Division affirmed the conviction of an individual (###) for committing psychological violence under Section 5 (i) of the 𝘈𝘯𝘵𝘪-𝘝𝘪𝘰𝘭𝘦𝘯𝘤𝘦 𝘈𝘨𝘢𝘪𝘯𝘴𝘵 𝘞𝘰𝘮𝘦𝘯 𝘢𝘯𝘥 𝘛𝘩𝘦𝘪𝘳 𝘊𝘩𝘪𝘭𝘥𝘳𝘦𝘯 (𝘈𝘯𝘵𝘪-𝘝𝘈𝘞𝘊) 𝘈𝘤𝘵 against his ex-girlfriend (AAA) by posting derogatory statements about her on 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬.

The SC sentenced ### to up to eight years in prison, imposed a PHP 100,000 fine, and ordered ### to undergo psychological counseling or psychiatric treatment.

The SC stressed that in criminal cases, the prosecution must prove not only the elements of the crime but also the identity of the offender.

It explained that for crimes committed through social media, the basic features of the platform such as 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬, must be considered.

Noting that 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬 is widely used in the Philippines, the SC held that a 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬 account can easily be created by anyone claiming to be at least 13 years old with an email address or mobile number.

Once an account is created, the user can add friends, exchange private messages, and post statements, photos, or videos visible to others depending on the user’s privacy settings. Fake or dummy accounts can easily spread, enabling disinformation, identity theft, or crimes.

Given this, the SC ruled that guideposts are necessary to establish who owns or controls a social media account. It said the following must be shown to prove ownership or access:

1. Admission of ownership or authorship;
2. Being seen accessing the account or composing the post;
3. Containing information known only to the offender or a few people;
4. Language consistent with the offender’s characteristics;
5. Records from the internet service provider, telecommunications company, or social media site, and results from device forensic analysis showing geolocation features, and other attributes linking the account to the offender;
6. Acts consistent with previous posts; or
7. Other instances showing ownership, access, or authorship.

Applying these, the SC found that several factors proved ### wrote the 𝘍𝘢𝘤𝘦𝘣𝘰𝘰𝘬 post. The account name bore his full name, and the profile photo showed him with his child from his current live-in partner.

AAA’s sister had also received messages from the same account for years.
