📌Ang Juvenile Justice System sa Pilipinas ay nakabase sa:
Juvenile Justice and Welfare Act of 2006
In-amend ng Republic Act No. 10630
Layunin nito na protektahan at i-rehabilitate ang bata na nagkasala, hindi agad parusahan.

👶 Who is a Child in Conflict with the Law (CICL)?
Ito ang:
➡ Bata na below 18 years old na nakagawa ng krimen
Example:
14 yrs old nagnakaw
16 yrs old nanakit
17 yrs old snatcher
Lahat sila ay CICL.

📌AGE OF CRIMINAL RESPONSIBILITY
Ito ang foundation ng lahat.

❗ 15 YEARS OLD AND BELOW
Automatic rule:
❌ Walang criminal liability
✔ Hindi kakasuhan
✔ Intervention program lang
Kahit serious crime pa yan.

❗ABOVE 15 YEARS OLD to BELOW 18 YEARS OLD

May dalawang possibility:
🧠 A. WITHOUT DISCERNMENT
Meaning:
Hindi niya fully naiintindihan na mali ang ginawa niya.
Result:
❌ No criminal liability
✔ Intervention

Ang Intervention ay program para sa bata na:
➡ Walang criminal liability
Hindi siya criminal.
Hindi siya kakasuhan.
Tutulungan lang siya magbago.

👶 Applicable ang Intervention sa:
✔ Below 15 years old
✔ 15-17 without discernment

🎯 Purpose
Para:
Maitama ang bata
Mabigyan ng guidance
Maiwasan maging criminal paglaki

🛠 Examples ng Intervention
• Counseling
• Guidance
• Values formation
• Education
• Family conference

🧠 B. WITH DISCERNMENT
Meaning:
Alam niya na mali ang ginawa niya.
Result:
✔ May criminal liability
✔ Eligible for Diversion

Ang Diversion ay program para sa bata na:
✔ May criminal liability
PERO
Hindi muna dadalhin sa court
May chance pa siya ma-rehabilitate outside court.

👦 Applicable sa:
✔ 15-17 years old
✔ WITH discernment

🎯 Purpose
Para maiwasan:
Jail
Criminal record
Court trial
Habang tinutulungan siya.

🛠 Examples ng Diversion
• Community service
• Counseling
• Training
• Restitution (bayad danyos)
• Education

📌WHAT IF FAILED ANG DIVERSION?
Ito ang important malaman.
If diversion fails:
➡ Court na ang next step
Possible na:
Trial
Conviction
Pero minor pa rin siya

RA 10630 – BAHAY PAG-ASA
Ito ang dinagdag ng amendment.
🏠 Bahay Pag-asa
Ito ay:
Rehabilitation center for CICL
Hindi ito jail.
Dito nilalagay ang bata for:
• Intervention
• Diversion
• Rehabilitation

1️⃣ Age Rule – CICL pa rin ba?
Below 18 years old – kahit convicted, still considered child in conflict with the law hanggang sa 18.

Kung 18 or above – puwede na i-transfer sa adult facility kung may sentence.

2️⃣ Where are they detained after conviction?
Sa ilalim ng RA 9344 & RA 10630:
🔹 Bahay Pag-asa or Youth Rehabilitation Center
Para sa serious crimes kung convicted pero minor pa rin.
Special facility for rehabilitation.
Separate sa adult prisoners.
May programs para sa education, skills, values formation.

🔹 No Jail with Adults
Strictly bawal ihalo sa adult prison.
Proteksyon laban sa abuse, intimidation, at masamang influence.

3️⃣ Exceptions / Transition
Kung CICL turns 18 while serving sentence, puwede na i-transfer sa adult correctional facility.
Pero habang under 18, rehabilitation center pa rin ang dapat.

📌ang CICL (Child in Conflict with the Law) na nasentensyahan ay mananatili sa Bahay Pag-asa o accredited facility hanggang 18-21 taong gulang. Kung matagumpay ang rehabilitasyon, maaaring palayain o ilagay sa aftercare program. Kung hindi tagumpay, ang korte ang magpapasya kung ililipat sa BJMP/BuCor matapos ang 18-21 taong gulang.

📌Kung matagumpay ang rehabilitation: Kung napatunayang nagbago, maaaring irekomenda ng social worker ang paglaya ng CICL bago pa man mag-18 taong gulang.

📌Kung hindi matagumpay: Kung hindi nagbago o naging mas violent, maaaring mag-utos ang korte na ilipat ang CICL sa regular na kulungan (BJMP/BUCOR) kapag siya ay 18 taong gulang pataas, depende sa gravity ng krimen at desisyon ng hukom.

The SID is a global event celebrated annually to promote safer and more responsible internet use for everyone, with a special focus on over 100 countries, raising awareness about online safety issues. In the Philippines, the SID is officially recognized through Proclamation No. 417, declaring every second Tuesday of February as Safer Internet Day for Filipino Children.

This year’s theme,“Ako, Ikaw, Tayo: Konektado at Protektado Laban sa OSAEC at CSAEM”, emphasizes the importance of a whole-of-nation approach in creating a safer digital space for children.

✨ Let’s come together to promote online safety by encouraging responsible internet use and addressing the challenges and opportunities of the digital world for
Filipino children. At the heart of this celebration are the voices of the youth, who play a crucial role in creating a safer, more secure digital environment for all. Their call
to action aims to inspire bayanihan among government actors, civil society organizations, and the private sector.
