Ang usapin po hinggil sa posibleng pagtanggal sa isang miyembro ng gabinete ay hindi lamang tungkol sa personalidad o naging kontribusyon ng isang opisyal sa peace process โ€” na aming kinikilala at iginagalang โ€” kundi higit sa lahat ay tungkol sa prinsipyo ng governance, accountability, at pagpapanatili ng tiwala ng mamamayan sa Bangsamoro Government.

Sa ilalim ng Bangsamoro Organic Law o Republic Act No. 11054, malinaw na ang Chief Minister ang may kapangyarihang magtalaga ng mga ministro. Kaakibat nito, ayon sa matagal nang prinsipyo sa constitutional at administrative law, ang kapangyarihang magtalaga ay karaniwang may kasamang kapangyarihang magtanggal, maliban na lamang kung may batas na tahasang naglilimita rito. Walang probisyon sa BOL na nagbibigay ng fixed tenure sa mga ministro o nagsasabing hindi sila maaaring tanggalin ng Chief Minister.

Mahalaga ring linawin na ang Bangsamoro Government ay isang legal at constitutional na institusyon na nilikha sa ilalim ng Saligang Batas at ng Bangsamoro Organic Law. Bagamaโ€™t kinikilala ang mahalagang papel ng M**F sa peace process at transition, ang paggamit ng executive powers ng Chief Minister ay nakabatay sa batas at hindi nakadepende sa internal political arrangements ng anumang organisasyon.

Tungkol naman sa usapin ng COA, mahalagang itama na hindi lamang ito simpleng โ€œpreliminary audit observations.โ€ Mayroon nang Notice of Disallowance na inilabas kaugnay ng nasabing usapin. Bagamaโ€™t ang naturang findings ay hindi pa pinal at nananatiling subject sa available legal remedies at due process, hindi rin maaaring ipagsawalang-bahala ng pamahalaan ang seryosong implikasyon nito sa integridad, kredibilidad, at public trust sa gobyerno.

Ang mga posisyon sa gabinete ay mga posisyong political at highly confidential sa katangian. Dahil dito, mahalaga ang trust and confidence ng Chief Minister upang matiyak ang maayos, epektibo, at nagkakaisang pamamahala ng Bangsamoro Government.

Sa huli, ang tunay na diwa ng peace process ay hindi lamang pagtatapos ng armadong tunggalian kundi ang pagtatatag ng mga institusyong gumagana ayon sa batas, may pananagutan, at may malasakit sa kapakanan ng mamamayan. Ang accountability, transparency, at executive discipline ay hindi paglabag sa peace process โ€” bagkus, bahagi ito ng pagpapalakas ng moral governance at ng mga institusyon ng Bangsamoro Government.

Weโ€™re thrilled to share the success of the LLN recent workshop, Deputization in Practice: Designing Draft Guidelines for BAGO Deputization of Bangsamoro Government Legal Officers, held May 8-10, 2026, at the Greenleaf Hotel in General Santos City.

This pivotal event brought together dedicated lawyers and legal officers to breathe clear, coherent, and practical life into key provisions of the Bangsamoro Administrative Code and Bangsamoro Autonomy Act No. 5 (the BAGO Charter). These laws empower the Bangsamoro Attorney Generalโ€™s Litigation Division to deputize government legal officersโ€”with the concurrence of their respective Ministries, Agencies, and Officesโ€”to support critical functions.

Masterfully facilitated by Sir Ahmed Harris โ€œTommyโ€ Pangcoga, Founder and Chair of Transforming Fragilities Inc., participants dove deep into workshop outputs: pinpointing problem areas and solutions, reviewing current practices, recommending deputizable tasks (like court representation), setting defined limitations, embedding governance safeguards, and tackling priority questions. All agreed to collaborate in good faith on formulating and institutionalizing these Deputization Guidelinesโ€”ensuring all deputized work stays within written authority scopes, serves proper government purposes, and upholds strict supervision and accountability.

The outputs were formally endorsed and turned over to the LLN Board for drafting. We capped the event with Atty. Yasmine A. Ibay and Atty. Mohamad Rayyan M. Domado presenting the Draft Expropriation Guidelines for body commentsโ€”finalization now rests with BAGO, ahead of Cabinet approval.

As one of the final major initiatives under the current LLN leadership, this workshop underscores its commitment to excellence. By July, the LLN Board will present its full accomplishment report, delivering a transparent account of its impactful work.
