Supreme Court of the Philippines Recognizes Co-Ownership in Same-Sex Relationships Under the Family Code
Manila, Philippines โ LGBT Pilipinas welcomes and celebrates a landmark and historic decision by the Supreme Court of the Philippines, which formally recognized co-ownership of property in same-sex relationships under Article 148 of the Family Code. This ruling marks a monumental step forward in the legal recognition of LGBTQ+ families and relationships in the country.
Sa loob ng mahabang panahon, maraming same-sex couples ang namuhay, nagtrabaho, at bumuo ng buhay nang magkasama, ngunit nanatiling walang sapat na legal na proteksyon pagdating sa mga ari-arian na kanilang pinaghirapan. Sa desisyong ito, malinaw na kinilala ng Korte Suprema na ang Article 148 ay hindi limitado sa heterosexual relationships, kundi umiiral batay sa aktwal na kontribusyon at pagsasama, anuman ang sekswal na oryentasyon o gender identity ng mga partner.
This decision acknowledges a long-standing reality: LGBTQ+ couples form genuine partnerships that involve mutual contribution, shared responsibilities, and joint economic efforts. The recognition of co-ownership ensures that partners in same-sex relationships are afforded protection against unjust loss of property and are treated with dignity in legal proceedings.
LGBT Pilipinas views this ruling as a powerful affirmation that the Constitutionโs guarantees of equal protection extend to LGBTQ+ Filipinos. While this decision does not yet establish marriage equality, it lays a crucial legal foundation for broader recognition of same-sex relationships and strengthens the push for comprehensive anti-discrimination protections.
Pinupuri namin ang Korte Suprema sa kanilang tapang at malinaw na interpretasyon ng batasโisang interpretasyong nakabatay sa katarungan, karanasan, at karapatang pantao. Kinilala rin namin ang tapang ng mga indibidwal na nagdala ng kasong ito, na sa pamamagitan ng kanilang paninindigan ay nagbukas ng pinto ng pagbabago para sa mas marami.
LGBT Pilipinas remains committed to advocating for full equality, including the passage of the SOGIE Equality Bill and the continued expansion of legal protections for LGBTQ+ Filipinos. This victory reminds us that progress is possibleโand that justice, though long delayed, can move forward.
