MAN GETS 14 YEARS IN PRISON OVER FACEBOOK POSTS; SC EN BANC RULES VAWC COMMITTED THROUGH ICT CARRIES A HIGHER PENALTY

The Supreme Court (SC) En Banc has ruled that psychological violence against women committed through Facebook is subject to a higher penalty because social media is an information and communications technology (ICT) system under the Cybercrime Prevention Act.

The case arose from a criminal complaint filed by a woman against her former boyfriend, who is also the father of their child. According to the records, the accused publicly posted insulting and threatening statements on Facebook, calling the victim degrading names and inviting others to identify her. The victim testified that the public post caused her fear, anxiety, humiliation, sleeplessness, and emotional distress.

The Court held that when psychological violence under Republic Act No. 9262, or the Anti-Violence Against Women and Their Children Act, is committed through Facebook or similar social media platforms, Section 6 of Republic Act No. 10175, or the Cybercrime Prevention Act of 2012, applies, increasing the prescribed penalty by one degree, provided that the use of ICT is properly alleged in the Information and proved during trial. The Court further ruled that alleging the accused committed the offense by posting on his Facebook account was sufficient to inform him that the offense was qualified by the use of ICT.

Supreme Court: Anti-VAWC Law Covers Violence in Le***an Relationships

The Supreme Court has reaffirmed that Republic Act No. 9262, or the Anti-Violence Against Women and Their Children (Anti-VAWC) Act, applies to violence committed in le***an relationships. The Court ruled that the law's use of the gender-neutral phrase "any person" includes a woman who commits violence against another woman with whom she has or had a sexual or dating relationship.

The Court likewise rejected the claim that this pronouncement in “Garcia” was merely obiter dictum, explaining that it directly resolved the issue of whether RA 9262 applies only to male perpetrators.

GENERAL SANTOS CITY — The City Government of General Santos, under the leadership of Mayor Lorelie Geronimo Pacquiao, through the Local Civil Registrar’s Office (LCR-Gensan), is accepting applicants for its FREE Kasalan ng Bayan this August 2026, with slots limited to only 50 couples.

⚠️ FIRST-COME, FIRST-SERVED BASIS. Interested couples are encouraged to complete their documents and submit the requirements personally at LCR-Gensan to reserve a slot.

FOR APPLICANTS AGED 23 AND ABOVE WHO HAVE BEEN LIVING TOGETHER FOR 5 YEARS OR MORE:
• PSA Birth Certificates of both applicants
• Birth Certificate of child/children, if the child is 4 years old or above
• Affidavit of Cohabitation
• Original CENOMAR with official receipt
• Cedula of both applicants
• Valid IDs of both applicants

FOR THOSE APPLYING FOR A MARRIAGE LICENSE:
• PSA Birth Certificates of both applicants
• Original CENOMAR with official receipt
• National ID or any government-issued ID
• Cedula of both applicants

This second category applies to couples, including live-in partners, who have been together for less than five years.
