Debtor refused to pay his loan. Is he liable for estafa?

Complete Question: Debtor refused to pay his loan. Instead, he denies having contracted the same. Creditor argues that under Art. 315, No. 1(b) of the Revised Penal Code, there is an obligation to return the loaned amount and non-payment of it will constitute estafa. Is the creditor correct?

Legal Advice: No, the debtor is NOT liable for estafa.

In the landmark case of US vs. Ibañez, when a contract is a loan of money, the debtor cannot be held liable for the crime of estafa by merely refusing to pay or by denying the indebtedness.

Why? Because in a contract of loan, the ownership of the thing transfers to the debtor. Whereas the obligation to return the thing under the Revised Penal Code pertains to a contract without a transfer of ownership. (Reyes, Book II)

Part 2 of 2: Paano makukuha ang mana nang hindi lumalapit sa korte?

Ayon sa Section 1, Rule 74, ng Rules of Court, mayroong dalawang (2) paraan:
1. Extrajudicial settlement ng mga tagapagmana, o
2. Self-adjudication ng kaisa-isang tagapagmana.

Part 2: Self-adjudication ng kaisa-isang tagapagmana

Ito naman ang proseso kung saan iisa lamang ang tagapagmana ng pumanaw. Ang kaisa-isang tagapagmana ay nangangailangang manumpa at lumagda sa Sinumpaang Salaysay na tinatawag sa Ingles na Affidavit of Self-Adjudication. Ang salaysay na ito ay naglalayong ideklara and katotohanan ng mga sumusunod:

1. Na ang pumanaw ay walang Huling Habilin o “Last Will and Testament”;
2. Na ang pumanaw ay walang naiwang utang o walang pinagkakautangan;
3. Na ang nag-iisang tagapagmana ay kalapit na kamag-anak ng pumanaw (halimbawa: asawa, anak, o magulang); at
4. Na ang mga ari-arian na siyang nais manahin ay tunay at legal na pagmamay-ari ng pumanaw.

Upang magkabisa, ang Sinumpaang Salaysay o Affidavit of Self-Adjudication ay kailangang ipa-notaryo at ihain sa opisina ng Register of Deeds sa probinsya kung saan matatagpuan ang nasabing ari-arian. Matapos ay ilalathala ito sa dyaryo nang hanggang tatlong (3) linggo sa nasabing probinsya.

Bukas, October 31, 2025, ay isang Special Non-Working Holiday. Ano kaya ang magiging epekto nito sa iyong sahod?

Ayon sa Labor Code, sa araw na idineklarang “Special Non-Working Holiday”, ang mga manggagawa na hindi magtatrabaho ay hindi rin mabibigyan ng sahod sa naturang araw. Samantalang kung ang manggagawa ay papasok sa trabaho kahit pa idineklarang holiday, ay mabibigyan siya ng sahod at ito ay maco-compute gamit ang formula na ito: (130% x daily rate).

Kung halimbawa naman na ang araw na idineklarang Special Non-Working Holiday ay napatapat sa iyong rest day pero pumasok ka pa rin sa trabaho, ito naman ang computation ng magiging sahod mo: (150% x daily rate).



Reference: Art. 93(c) of the Labor Code: “Work performed on any special holiday shall be paid an additional compensation of at least 30% of the regular wage of the employee. Where such holiday work falls on the employee’s scheduled rest day, he shall be entitled to an additional compensation of at least 50% of his regular wage.”
