The Zoning Office of LGU Malay would like to inform the residents and lot owners of Boracay Island that the application for Building Permit has been put on hold. All applications within the 15 meters road easement as indicated in their Alienable and Disposable (A&D) Certificate from DENR-PENRO and are also identified by the Cadastral Survey shall no longer be allowed. As such, this announcement is based on the order of MS. MERLENE B. ABORKA, PENR Officer of DENR Kalibo dated September 20, 2022. On November 4, 2022, Municipal Mayor Frolibar S. Bautista informed the concerned offices involved in the building permit applications acknowledging the letter of Ms. Aborka and following the existing Presidential Proclamation 1064.
Therefore, the following must be considered;
1. NO NEW CONSTRUCTION MUST BE ALLOWED,
2. NO EXPANSION NOR ADDITION OF STOREYS IS ALLOWED,
3. AS-BUILT WITHOUT BUILDING PERMIT IS NOT ALLOWED TO APPLY,
4. ONLY RENOVATION BASED ON THE APPROVED PLAN SHALL BE CONSIDERED, and,
5. CONSTRUCTION AFTER THE 15 METERS ROAD EASEMENT or A&D AREAS IS HIGHLY ACCEPTABLE.
With that, for the lot owners to identify the actual status of their land they must secure the following documents;
1. Cadastral Lot Equivalent
2. Sketch Plan based on Cadastral Survey, and
3. A&D Certification from PENRO-DENR.
Hence, a thorough evaluation shall be conducted before the approval of your application. This order shall be in effect until such PP1064 shall be amended.
