Don't Let Your Benefits Sink! know your rights
⚓ When you're a seafarer, your journey doesn't end when you get back home, especially if you're dealing with an illness, injury, or accident. Whether you're a victim of piracy (NAPIRATA), have been medically abandoned by your company (HINDI PINAGAMOT NG KUMPANYA), or are dealing with a personal injury, you have rights.
Knowing these rights is crucial to securing the benefits you and your family deserve. Here are the three key benefits you should always claim:
1. Free Medical Treatment
From the moment you are medically repatriated, you are entitled to free medical care. To secure this benefit, you must report your illness or injury to your company within 72 hours of your arrival. Whether you've finished your contract or are coming home due to a medical issue, this is the first step to a full recovery without the financial burden.
2. Sickness Allowance
While you are recovering, you shouldn't have to worry about your income. Your company is obligated to provide a sickness allowance for up to 120 days while you are being treated. This benefit is based on the contract you signed and is designed to provide you with financial stability during your recovery.
3. Disability Benefits
If your illness or injury persists and you don't fully recover after 120 to 240 days, you are entitled to disability benefits. The primary insurance provider or the P&I Club (Protection and Indemnity Club) is legally responsible for paying you what you are owed. Don't settle for less than what your long-term health requires.
An Extra Anchor: Union Membership
If you are a member of a union or if your vessel operates under a Collective Bargaining Agreement (CBA) from organizations like TCC, JSU, NIS, ITF, or AMOSUP, you may be entitled to additional benefits. These agreements often provide more comprehensive support and compensation.
