– Begin a region-based decentralization path. Empower the provinces. Balance national and local development.

🇵🇭 WHY It’s BETTER to TALK ABOUT CONSTITUTIONAL REFORMS Than IMPEACHMENT TRIALS 🇵🇭

In the middle of all the NOISE about IMPEACHMENT COMPLAINTS and POLITICAL DRAMA, one thing is getting drowned out—the REAL CONVERSATION we SHOULD be HAVING as a NATION: CONSTITUTIONAL REFORMS.

Let’s be honest: it’s tempting to focus on the personalities, the controversies, and the political rivalries. But IF WE WANT REAL, LASTING CHANGE, we have to ask: ARE WE FIXING the SYSTEM, or JUST FIGHTING over WHO SITS at the TABLE?

Here are 10 REASONS why FOCUSING on CONSTITUTIONAL REFORM is FAR MORE IMPORTANT than GETTING CAUGHT up in IMPEACHMENT POLITICS—including the LATEST BUZZ about VP INDAY SARA DUTERTE.

🔹 1. FIX the SYSTEM, NOT JUST the PERSON.
IMPEACHMENT is ABOUT INDIVIDUALS. REFORM is ABOUT INSTITUTIONS. If we keep replacing players without changing the broken rules of the game, nothing truly changes.

🔹 2. BUILD, don’t DIVIDE.
REFORM invites NATIONAL UNITY, CONSULTATION, and a SHARED VISION for the FUTURE. Impeachment often FUELS DIVISION, HATE, and POLITICAL VENDETTAS.

🔹 3. ATTRACT INVESTORS, NOT CHAOS.
ECONOMIC CONSTITUTIONAL REFORM SENDS a CLEAR SIGNAL: the Philippines is ready to compete. IMPEACHMENT, on the other hand, SCREAMS instability—and SCARES INVESTORS away.

🔹 4. TALK SUBSTANCE, NOT SCANDAL.
REFORM forces us to talk about REAL ISSUES—like federalism, economic liberalization, political party reform, and judicial independence. IMPEACHMENT SUCKS all the OXYGEN OUT of the room for more MEANINGFUL DEBATES.

🔹 5. EDUCATE the PUBLIC.
Charter Change discussions offer a chance to raise awareness about how our government works—and where it fails. Impeachment trials often leave the public more confused, misinformed, or emotionally manipulated.

🔹 6. SOLVE ROOT PROBLEMS.
Political dynasties? Overcentralization? Weak checks and balances? These are systemic problems. Impeachment doesn't solve them—it only scratches the surface.

🔹 7. ENGAGE MORE VOICES.
Constitutional reform invites experts, youth, civil society, indigenous groups, LGUs, OFWs, and ordinary citizens into the conversation. Impeachment is mostly fought inside Congress and legal circles.

🔹 8. MOVE from DRAMA to DIRECTION.
Do we want another season of political soap operas, or do we want to write a new chapter for our democracy? Let’s choose direction over distraction.

🔹 9. STRENGTHEN DEMOCRACY.
Reforming the Charter is a democratic tool. It’s how mature democracies evolve. Impeachment is a last resort—not a long-term solution.

🔹 10. LEAVE a LEGACY.
If we push for reform, we’re building something that can benefit future generations. If we only focus on who gets impeached, we’re stuck in short-term power struggles.

💡 BOTTOM LINE: We’re not saying accountability isn’t important. But it’s time we stop reacting and start rebuilding. Let’s STOP BEING TRAPPED in a POLITICAL LOOP and FINALLY ASK: WHAT KIND of PHILIPPINES do we WANT to LEAVE BEHIND?

Pumili ng prayoridad na industriya base sa lokal na lakas (hal. turismo sa Palawan, agrikultura sa Agusan)

Mas tumutugma ang mga programa at proyekto sa tunay na pangangailangan ng rehiyon, imbes na centralized o Manila-centric ang mga desisyon.

2. MAS MALAKING BAHAGI ng KITA ang MANANATILI sa REHIYON

Sa kasalukuyang sistema, karamihan ng koleksyon ng buwis ay napupunta sa national government sa Maynila.

Sa FEDERALISMO:

Mas malaking porsyento ng taxes (hal. VAT, corporate income tax, resource taxes) ang mananatili sa regional/state governments

May kalayaang gamitin ito para sa local development, social services, at MSME support

EPEKTO: Mas maraming pondo para sa mga probinsya — para sa imprastraktura, edukasyon, at kabuhayan.

3. KOMPETISYON ng mga REHIYON sa PAG-AKIT ng NEGOSYO

Kapag may sariling pamahalaan at patakaran ang bawat rehiyon:

Pwede silang magsagawa ng tax incentives o ease of doing business reforms upang makahikayat ng mga negosyante

Magkakaroon ng healthy competition sa pagitan ng mga federal states para sa mga investor

EPEKTO:

Lumalakas ang ekonomiya ng iba't ibang rehiyon, at hindi lang NCR ang sentro ng negosyo.

4. PAGKILALA at PAGTUTOK sa LOKAL na POTENSYAL

Ang bawat rehiyon ay may sariling lakas:

Halimbawa, cacao at coconut sa Mindanao

Tourism at fisheries sa Visayas

Manufacturing at logistics sa CALABARZON

Sa Federalismo, puwedeng ituon ang development plan ng bawat estado sa kanilang comparative advantage.

EPEKTO:

Mas sustainable at inclusive na paglago.

5. KAPAYAPAAN at PAGKAKAKILANLAN

Lalo na para sa mga rehiyon tulad ng BARMM:

Maaaring mapalakas ang self-governance at cultural autonomy

Makakatulong ito sa long-term peace and stability, na mahalaga sa economic growth

EPEKTO:

Mas maraming negosyo at pamumuhunan ang papasok kung may kapayapaan at malinaw ang rules of governance.

6. PAGBAWAS sa OVERCONCENTRATION ng NCR

Federalismo ay magde-decongest sa Metro Manila sa pamamagitan ng:

Paglipat ng ilang national offices sa ibang federal states

Pag-encourage ng regional growth centers

EPEKTO:

Bumababa ang pressure sa NCR at umaangat ang ibang rehiyon.

FEDERALISMO = LOKALISADO,

may AWTONOMIYA, at MAS PATAS na PAG-UNLAD.

Kung tama ang pagpapatupad at may transparency, puwede itong MAGING SUSI para PANTAYIN ang AGWAT ng MAYAYAMAN at MAHIHIRAP na REHIYON sa BANSA.

Para MAISAKATUPARAN ang FEDERALISMO sa PILIPINAS, kailangang BAGUHIN ang ILANG PANGUNAHING BATAS—

lalo na ang 1987 KONSTITUSYON.

Narito ang mga batas at probisyong kailangang ireporma o amyendahan:

---

1. KONSTITUSYON ng 1987 (Saligang Batas ng Pilipinas)

Ang pinakaimportanteng hakbang. KAILANGAN BAGUHIN ang UNITARY FORM of GOVERNMENT at PALITAN ito ng FEDERAL FORM.

Narito ang mga partikular na probisyong kailangang ireporma:

a. Article X – LOCAL GOVERNMENT

Palitan o dagdagan ng bagong seksyon para sa pagtatatag ng Federal States (hal. Luzon Federal State, Visayas State, Mindanao State, BARMM State, atbp).

Tanggalin o i-restructure ang mga probisyon na eksklusibong nagbibigay ng kapangyarihan sa national government.

b. Article VI – The LEGISLATIVE Department

Magtatag ng Federal Parliament o panatilihin ang bicameral setup pero hatiin ang kapangyarihan ng lehislatura sa Federal Congress at mga Regional Legislatures.

c. Article VII – The EXECUTIVE Department

Pwedeng panatilihin ang Presidential system o palitan ng Parliamentary system, depende sa federal model na pipiliin (e.g., tulad ng Malaysia, Germany, o US).

d. Article XII – NATIONAL ECONOMY and PATRIMONY

Baguhin ang centralized control ng ekonomiya at pahintulutan ang mga federal states na kontrolin ang likas-yaman, ekonomiya, at buwis sa loob ng kanilang nasasakupan.

e. Article XIV – Education, Science and Technology

Payagan ang regional adaptations sa curriculum, lalo na sa kultura, wika, at lokal na kasaysayan.

f. Fiscal Provisions (Article VI and Article X)

Itakda kung paano hahatiin ang kita mula sa buwis: ano ang mapupunta sa Federal Government at ano ang mapupunta sa Federal States (hal. 70-30 split o 60-40).

2. LOCAL GOVERNMENT Code of 1991 (RA 7160)

Baguhin upang i-akma sa federal framework. Hindi na lang LGU autonomy, kundi regional self-rule ang kailangang isabatas.

Maaaring gamitin ang prinsipyo ng devolution bilang basehan ng fiscal federalism.

3. ADMINISTRATIVE Code of 1987

Rebisahin upang ang mga ahensya ng gobyerno ay mayroong regional/federal counterparts o kaya'y ma-devolve ang mga function sa regional level.

4. TAX REFORM LAWS (NIRC, Local Tax Code)

Magtakda ng malinaw na division of taxing powers: alin ang kolektahin ng federal government, at alin ang buwis para sa mga federal state (hal. income tax, VAT, property tax).

5. CIVIL SERVICE LAWS & COMELEC Code

Kailangang i-restructure ang appointment powers, elections, at administrative processes para magbigay daan sa bagong layers of government (e.g. state governors, regional parliaments).

6. BARMM Organic Law (RA 11054)

Ang kasalukuyang setup ng BARMM ay prototype ng federal governance. Puwedeng palawakin ang ganitong modelo sa iba pang rehiyon.

Maaring isama ang BARMM bilang isang full-fledged federal state sa bagong konstitusyon.

PAANO ito ISASAGAWA?

a. Constitutional Convention (Con-Con)

Maghalal o magtalaga ng mga delegado para mag-draft ng bagong konstitusyon.

b. Constituent Assembly (Con-Ass)

Babaguhin ng Kongreso mismo ang konstitusyon (3/4 vote ng parehong Kamara).

c. People’s Initiative (PI)

Kakailanganin ng pirma ng 12% ng rehistradong botante sa buong bansa.

Bottomline:

HINDI SAPAT ang ORDINARYONG batas para sa FEDERALISMO—CONSTITUTIONAL REFORM ang pangunahing susi.

Kung maayos ang disenyo at proseso, makatutulong ito sa PANTAY-PANTAY na PAG-UNLAD ng mga REHIYON.

Kailangan ng 5 - 10 Bilyon Peso para sa pagkakaroon ng isang Constitutional Convention.

Ang tantiya na makompleto ang Federalismo sa Pilipinas ay aabot ng 7-10 na taon depende sa political will, suporta ng mamamayan, at kakayahan ng gobyerno.

we AIM to have an ECONOMIC POLICY or SYSTEM same as SINGAPORE?

To ADOPT an ECONOMIC SYSTEM SIMILAR to SINGAPORE'S —

a GLOBALLY COMPETITIVE, FDI-driven, and BUSINESS-FRIENDLY model —

the Philippines would NEED to OVERHAUL several CONSTITUTIONAL provisions, STATUTORY laws, and REGULATORY frameworks.

Below are the KEY LEGAL CHANGES REQUIRED:

I. CONSTITUTIONAL AMENDMENTS

A. Article XII – NATIONAL ECONOMY & PATRIMONY

Current:

60/40 BUSINESS OWNERSHIP LIMITS (60% must be owned by Filipino), land ownership restrictions to Filipino only (Section. 10-11)

REFORMS Needed:

REMOVE ALL THESE RESTRICTIONS from the CONSTITUTION and ALLOW UP TO 100% FOREIGN OWNERSHIP in key sectors: utilities, telecoms, education, renewables.

REMOVE RESTRICTIONS on LAND Ownership for foreign investors or ALLOW long-term LEASEHOLDS (e.g., 99-year leases like Singapore).

B. Article XIV – EDUCATION

Current:

EDUCATIONAL INSTITUTIONS must be majority Filipino-owned(100% for Individuals, if Corporations or Association, must be at least 60% owned by Filipinos) Section 4

REFORMS Needed:

REMOVE these RESTRICTIONS from the CONSTITUTION and

LIBERALIZE EDUCATION SECTOR to ATTRACT world-class universities and education providers like Singapore's YALE-NUS

C. Article XVI – GENERAL PROVISIONS

Current:

MASS MEDIA OWNERSHIP limited to Filipinos. Section 11

REFORMS Needed:

REMOVE MASS MEDIA OWNERSHIP RESTRICTIONS from the CONSTITUTION and

ALLOW and LIBERALIZE FOREIGN OWNERSHIP to permit foreign investment in digital and traditional media.

II. PRIORITY STATUTORY REFORMS

A. FOREIGN INVESTMENTS ACT (RA 7042, amended by RA 11647)

Current:

NEGATIVE List RESTRICTS FDI in many sectors.

REFORMS Needed:

SHORTEN the Foreign Investment Negative List (FINL).

ADOPT Singapore’s OPEN-ACCESS MODEL, Shift to sector-based regulation (e.g., only restrict defense, national security sectors).

B. PUBLIC SERVICE ACT (RA 11659, 2022)

Current:

Partially liberalized telecom, airports, and railways.

REFORMS Needed:

FULLY DEREGULATE shipping, logistics, and energy.

OPEN UP transport, logistics, water, and power distribution to FDI.

CLARIFY that "public utilities" ≠ all infrastructure.

REDEFINE “public utilities” narrowly.

C. RETAIL TRADE LIBERALIZATION ACT (RA 11595)

Current: Minimum $200K–$500K capital for foreign retailers.

REFORMS Needed:

LOWER CAPITAL THRESHOLD for foreign retailers to $50,000 or

REMOVE ALTOGETHER (like Singapore’s no-minimum rule).

D. Corporate Recovery and Tax Incentives (CREATE Act)

Current: 20–25% corporate tax (higher than Singapore’s 17%).

REFORMS Needed:

REDUCE to 15% for all firms (not just PEZA zones).

SIMPLIFY INCENTIVES (copy Singapore’s Productivity and Innovation Credit).

OFFER TARGETED TAX INCENTIVES linked to innovation, R&D, and job creation.

E. General Banking and BSP Laws (RA 8791, RA 11211)

Current: Limits on foreign banks.

REFORMS Needed:

ALLOW Full FOREIGN COMPETITION (like Singapore’s 146 foreign banks).

LIBERALIZE foreign entry into banking.

SUPPORT fintech, digital banks, and offshore finance hubs.

F. LABOR CODE of the Philippines (PD 442)

Current: Rigid hiring/firing rules.

REFORMS Needed:

ALLOW FLEXIBLE LABOR CONTRACTS (project-based, part-time, gig, like Singapore’s Employment Act)

FAST-TRACK expat visas and adopt employment pass systems like Singapore.

III. NEW LAWS or LEGISLATION TO BE ENACTED

A. SOVEREIGN WEALTH FUND Act

CREATE a state fund modeled after Temasek or GIC to manage and invest public assets.

B. EASE of DOING BUSINESS Act 2.0

MANDATE 48-hour online business registration(vs. current 7+ days).

ADOPT Singapore’s online BizFile+ system.

C. LAND REFORM ACT 2.0 (Industrial Land Leasing Law)

Replace agrarian reform focus with industrial land use and leasing framework.

Empower an agency similar to JTC Corporation for industrial land development.

D. SMART NATION ACT

INSTITUTIONALIZE a digital transformation strategy covering ID systems, e-governance, and AI adoption.

Digital ID, cashless payments, and "AI-driven governance" (like Singapore’s Smart Nation Initiative).

IV. REGULATORY OVERHAUL

A. CENTRAL BANK (BSP)

MOVE towards capital account liberalization.

ENABLE international financial services, fintech innovation, and digital assets.

ALLOW full capital account convertibility (like Singapore’s MAS).

FAST-TRACK digital bank licenses.

B. SEC & PEZA Consolidation

MERGE investment and regulatory functions into a Singapore-style Economic Development Board (EDB).

CUT RED TAPE, Set 1-day incorporation, unified permitting, and investor concierge services.

V. ADDRESSING POLITICAL & CULTURAL CHALLENGES

ISSUE: Nationalism(Filipino First Policy) vs. FDI(Foreign Direct Investments)

SOLUTION: Frame reforms as "jobs-first" (e.g., Vietnam’s 2020 FDI success).

ISSUE: Dynastic Resistance

SOLUTION: Tie reforms to anti-monopoly laws.

ISSUE: Bureaucratic Inertia

SOLUTION: Recruit Singaporean consultants to retrain agencies.

VI. POLICY INSTITUTIONS & PROGRAMS TO COPY FROM SINGAPORE

1. PUBLIC HOUSING: Replace NHA with an HDB-like agency.

2. TRANSPORT: Privatize MRT/LRT operations (like SMRT).

3. CORRUPTION: Strengthen anti-graft courts(like CPIB).

4. INVESTMENTS: Merge SEC, PEZA, BOI into a unified investment promotion agency like EDB(Investment Board)

5. SMART NATION Program : Enact digital governance framework

6. ESTABLISH sovereign wealth fund entity like Temasek/GIC

CONCLUSION: THE 4-PILLAR REFORM ROADMAP

To replicate Singapore’s economic success, the Philippines must:

1. AMEND the CONSTITUTION to liberalize investments and ownership (Articles XII, XIV, XVI).

2. REVISE 10+ statute laws to attract FDIs and enable competitiveness (e.g., Foreign Investments Act).

3. PASS 4-5 new enabling laws for innovation, industrialization, and digital governance(e.g., Sovereign Wealth Fund Act).

4. OVERHAUL regulators for pro-business efficiency and global trust(BSP, SEC, PEZA).
