The evolution of aviation security in the Philippines can be traced back to significant domestic and foreign terrorist attacks that necessitated global action. At the national level, one such attack happened in May 1976 in Zamboanga, wherein a PAL flight to Manila was hijacked by some members of the MNLF which resulted in the death of several passengers and serious injuries to others. Globally, the deadliest and grandest terrorist attack in human history, using commercial aviation as weapon of mass destruction occurred on American soil on September 11, 2001, otherwise known as the 9/11 Attack or 9/11 Tragedy. It had a significant impact in air travel as well as in trade facilitation in maritime. This massive act of terrorism revolutionized security in the transport system worldwide; and it was also the catalyst in the creation of OTS. On July 1, 2002 and December 12, 2002, the two international bodies – International Civil Aviation Organization (ICAO) and International Maritime Organization (IMO), respectively – provided additional and new security provisions in their existing Standards. Specifically, ICAO issued Amendment 10 to Annex 17 of the Chicago Convention, wherein each Contracting State are mandated, among others, to designate and specify to ICAO an appropriate authority within its administration to be responsible for the development, implementation and maintenance of the National Civil Aviation Security Program (NCASP). For Maritime, IMO amended the SOLAS in 2002 and included therein Chapter XI-2 – Special measures to enhance maritime security, otherwise known as the International Ship and Port Facility Security (ISPS) Code . The Philippines is a Contracting State to both the Chicago Convention and the SOLAS Convention. In response to the Philippine’s obligation as a Contracting State, then President Gloria Macapagal Arroyo issued, on January 30, 2004, Executive Order No. 277, Approving and Adopting the National Civil Aviation Security Programme (NCASP), Creating the Office for Transportation Security in the Department of Transportation and Communications, and Reconstituting the National Council for Civil Aviation Security (NCCAS) as the National Civil Aviation Security Committee (NCASC). OTS was created to be primarily responsible for the implementation of Annex 17 to the Chicago Convention on aviation security. While there is no similar instruments or international protocol for the land and rail sector, it cannot be gainsaid that the land and rail sector need similar protection from acts of terrorism or other acts aimed to injure and destabilize. Hence, by virtue of Executive Order No. 311 issued on April 26, 2004, the OTS was designated as the appropriate single authority responsible for the security of the transportation systems of the Country, including but not limited to Civil Aviation, Sea Transport and Maritime Infrastructure, and Land Transportation, Rail System and Infrastructure. OTS assumed the functions of the NCASC enumerated in EO No. 277.
